SUBJECT: ORDINANCE 26-6, POLICE ASSIGNMENT PAY

BACKGROUND: Ordinance 26-6 provides for 'assignment pay' for positions in the police
department in accordance with Civil Service law. The department provides this additional
compensation for duties which are above and beyond the job description for the position
assigned. Ordinance 26-6 provides additional compensation for Field Training Officers, Dispatch
Trainers, ("anine (K-9) Officer, assistant commander, Drug Task Force and the Crime Prevention
Unit.
STAT .JS OF ISSUE: The police department has two teams of officers who respond to very.
specific ]Incidents which require additional training, skills and certification. Those being the
SWAT / Hostage Negotiation Unit and the Accident Reconstruction Unit. When fully staffed,
these units will have a maximum ot'20 positions. Presently, we have 15 officers participating in
these teams with openings in both, I I he assignment pay for the canine officer along with the
drug task force coininander portions of the ordinance should be deleted. The canine officer is
compensated by work schedule allowances and the assistant commander of the drug task force
no longer exists.
BUDGET: We are asking that each officer on these teams be afforded an additional $87.50 per
month ($1050.00 per year) for participation. The cost of implementing the additional pay for the
remainder of the current fiscal year is $10,500.00. There is no cost to the budget for deletion of
the canine officer position and the drug task force commander position,
RECOMMENDATION: Approve the amended ordinance.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING THE CITY OF PARIS CODE OF ORDINANCES BY REVISING
CHAPTER 26, ARTICLEI, SECTION 26-6, "ASSIGNMENT PAY," OF SAID
CODE RELATING TO ASSIGNMENT PAY IN THE PARIS POLICE
DEPARTMENT BY DELETING REFERENCES TO A K-9 OFFICER AND TO
THE DRUG TASK FORCE ASSISTANT COMMANDER; BY ESTABLISHING
ASSIGNMENT PAY IN THE AMOUNT OF $07.50 PER MONTH FOR
PARTICIPATION IN EACH OF THE SWAT/HOSTAGE NEGOTIATION AND
ACCIDENT RECONSTRUCTION UNITS; PROVIDING A REPEALER CLAUSE,
A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, Sections 143.041-143.043 of Chapter 1.43 of the 'Texas Local
Government Code, the Civil ,Service Act, authorizes municipalities covered by said Act to
compensate police officers with assignment pay, in addition to their base pay, when
performing the duties and responsibilities of the position; and.
WHEREAS, Chapter 21, Article 1, Section 26-6, "Assignment pay,'" of the Code of
Ordinances of the City of Paris, Texas, provides for assignment pay within the Paris Police
Department ("'the Department"); and
WHEREAS, changes within the Department since said Section 26-6 was last
amended in 2008 necessitate further amendments to reflect the current composition and
extra -duty assignments of the Department; and
WHEREAS, the Department's K-9 officer, is now compensated by work schedule
allowances and the position of drug task force assistant commander has been eliminated,
the Council finds that references to both positions should be deleted from the ordinance;
and
WHEREAS, the Department maintains a SWAT/Hostage Negotiation Unit and an
Accident Reconstruction Unit, both of which require the officers who serve thereon to
possess additional training, shills and certifications; and.
WHEREAS, maximum staffing for the SWAT/Hostage Negotiation Unit and the
Accident Reconstruction Chit combined is twenty (20) officers; and
WHEREAS, Council finds that in recognition of the additional training, skills and
certifications required for officers serving in each of the SWAT/Hostage Negotiation and.
Accident Reconstruction Units, it is appropriate to provide officers serving in each such
unit assignment pay in the amount $87.50 per month ($1050.00 per year) over and above
each officer's base pay amount;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
,Section 1. That the findings set out in the preamble to this ordinance are hereby
in all things approved.
Section 2. That Chapter 26, Article 1, Section 26-6, "Assignment pay" of the Code
of Ordinances of the City of Paris, Texas, be, and the same is hereby, amended to read in its
entirety as follows:
"Sec. 2'6-6. - Assignment pay.
"Members of the police department, with the exception of the head of the
department, shall be entitled to receive assignment pay, as permitted in Local
Government Code, Sections 143,041, 143.042, and 143.043�, as amended, as follows:
"`(a) Field training officer,
"'(1) 'Field training officer' shall mean a member of the police department
who is assigned to and performs the duties and responsibilities of the field
training officers program.
"(2) The field training officer shall be entitled to compensation at the rate of
$46.153 per pay period when performing the duties and responsibilities of
the position.
"(3) The assignment pay provided by this section shall be in addition to the
regular pay received by the member or members of the police department
assigned as the field training officer,
"(b) Crime prevention officer,
"(1) 'Crime prevention officer' shall mean a member of the police department
who is assigned to and performs the duties and responsibilities of the crime
prevention officers program,
"(2) The crime prevention officer shall be entitled to compensation at the
rate of sixty-five dollars ($65.00) per pay -period.,
"(3) The assignment pay provided by this section shall be in addition to the
regular pay received by the member or members of the police department
assigned as the crime prevention officer.
"(c) Dispatcher training officer.
"(1) 'Dispatcher training officer' shall mean a member of the police
department who is assigned to and performs the duties and responsibilities
of the dispatcher training officers program.
"(2) The dispatcher training officer shall be entitled to compensation at the
rate of six dollars, twenty-five, cents ($6.25) per day when performing the
duties and responsibilities of the position.
"(3) The assignment pay provided by this section shall be in addition to the
regular pay received by the member or members of the police department
assigned as the dispatcher training officer.
"(d) SWAT Officer / Hostage Negotiator
"(1) 'SWAT Officer" shall mean a member of the police department who is
assigned to and performs the duties and responsibilities of the Special
Weapons and Tactical Team Officer,
"(2) 'Hostage Negotiator" shall mean a member of the police department who
is assigned to the Hostage Negotiation Team and is a part of the SWAT team.
"(3) SWAT Officers and Hostage Negotiators shall be entitled to
compensation at the rate of $43.75 per pay period when assigned to the
team.
"(4) The assignment pay provided by this section shall be in addition to the
regular pay received by the member or members of the police department
assigned as a SWAT Officer or Hostage negotiator,
"(e) Accident Reconstructionist
"(1) "Accident Reconstructionist' shall mean a member of the police
department who is assigned to and performs the duties and responsibilities
of the Accident Investigation Team.
"(2) An Accident Reconstructionist shall be entitled to compensation at the
rate of $43,,75 per pay period when assigned to the AM

assigned as an Accident Reconstruction is t."
Section 3. That all provisions of the, ordinances of the City of Paris, Texas in
conflict with the provisions of this ordinance are hereby repealed, and all other provisions
of the ordinances of the City of Paris not in conflict with the provisions of this ordinance
shall remain in full force, and effect.
Section 4. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 5. That it is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 6. That this ordinance shall become effective frorn and after its date of
passage.
