The Board qfA4jusiment meeting was called to order by David Hamilton, Chairman at 12. 00 Jr. m, The following mernbers were present: David Hamilton, Louise flagood, Jerry.Haning and Deanna Maiming The following members were absent: Marilyn Smith and Chris Fitzgerald (Alternate Board Member) Also present was Carla Easton, City Engineer; Stephanie Harris, City Attorney, Triniti Frazier, City Staff, Sue Lancaster, City Council I.,iaison and concerned citizens. 2. Approval ofininutesftom previous meetings, (December 5, 2017) Motion was made by David Hamilton, seconded by Louise Hagood to approve minutes for the December 5, 2017 meeting, Motion carried 4-0. 3. Public hearing to consider and take action on the petition qf'Brad Hutchison, Partner on behal/'qf J & B Paris Partners on Lot 4-5-6, Block 3, qflhe Slellrose Addition, being located at 2301 Simpson S51reet. A. Section 11.5-3 (b) (I a -d) of the Fence Ordinance which provides as follows: (b) Fence heights: (1)Frontyardfienee requirements. a. No fence shall be permitted in the front yard with the following exceptions: i. On lots zoned historic overlay district (HD) and in accordance with tile design standards adopted by the historic preservation commission. ii. On lots in excess of two (2) acres in size which are used for single-family residential purposes. iii. On lots which are zoned and used for LI or HI purposes. b. If permitted, ornamental fences may be permitted in a front yard in residentially zoned areas if not designed or serving as an enclosure. Ornamental fences include such things as split rail, picket, decorated metal, and brick fences, but not such things as chainlink, wire, or other similar fences, c. In residentially zoned areas, no fence over forty-two (42) inches in height above the average grade of the yard shall be permitted frorn. the front building line to the street right-of-way line. d. In residentially zoned areas, all front yard fences shall have a minimum of fifty (50) percent open area for passage of air and light. The applicant is requesting a variance to allow a front yard fence at 2301 Simpson Street. This property is not located in the historic overlay district, the lot does not exceed two (2) acres, and is not zoned for industrial purposes. The applicant is proposing to install a seventy-two (72), inch front yard privacy fence. 'The applicant is asking for a 30 inch variance in height. The proposed fence is not an ornamental fence with a minimum of fifty percent area l.or passage of air and light. Public hearing was declared open. One individual spoke in favor of the petition. Brad Hutchison, Partner of J & B Paris Partners, Paris, Texas, spoke in (avor of the petition. Mr. Hutchison stated that he recently purchased the property and wanted to make sure that a bedroom was not compromised, He stated that the wooden privacy fence would provide privacy to the bedroom in the front of the house. Carla Easton, City 1--'ngineer spoke in opposition of the petition recommending denial in order to preserve consistency of the front yard setback in a residential neighborhood. Public hearing was declared closed. Motion was made by David Hamilton, seconded by Jerry 1--laning to consider an act on the variance request as separate items. Motion carried 4-0. Mr. Hamilton requested a motion regarding front yard fence- Motion was made Jerry Harting to allow front yard fence, seconded by Louise Flagood. Motion carried 4-0. Mr. Hamilton requested a motion regarding fence height of 72 in.- Motion was made by Louise Hag ood to approve height, seconded by Deanna Manning. Motion carried 4-0. Mr. Hamilton requested a motion regarding wood privacy fence material- Motion was made by Jerry Haning, seconded by Louise Hagood to approve wood privacy fence material with a stepping down to 4 feet on East side ol'property.
