RESOLUTION NO. 2004-082
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, APPROVING AND AUTHORIZING THE REGIONAL
CONTROLLED SUBSTANCE APPREHENSION PROGRAM DRUG TASK
FORCE TO SOLICIT BIDS FOR THE COMPETITIVE SALE OF
FIREARMS AND OTHER WEAPONS CONFISCATED AS A RESULT OF
THE TASKFORCE'S DRUG INTERDICTION ACTIVITY; AUTHORIZING
THE SOLICITATION AND ACCEPTANCE OF COMPETITIVE BIDS
FROM LICENSED, REGISTERED FEDERAL FIREARMS DEALERS
ONLY; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO
THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Regional Controlled Substance Apprehension Program Drug Task Force
(hereinafter referred to as the "Drug Task Force"), for which the City of Paris is the Project Entity,
by and through its drug interdiction activities, has lawfully confiscated and obtained ownership of
a number of firearms and other weapons; and,
WHEREAS, the aforesaid confiscated firearms and other weapons do not include those
firearms customarily involved in actual drug activity, such as the so-called infamous "Saturday Night
Specials", but rather consist of primarily high quality rifles and shot guns and a small number of high
quality handguns along with knives and other weapons which were obtained by their prior owners
with the proceeds of or as a result of illicit drug activity; and,
WHEREAS, the aforesaid confiscated firearms and other weapons constitute a burden to the
Drug Task Force with regard to storage, security, and other associated problems; and,
WHEREAS, the Drug Task Force has sought input from the United States Alcohol,
Tobacco, and Firearms Agency (A TF) regarding the disposition of said confiscated goods, and the
A TF has recommended that such firearms and other weapons be auctioned as a group for purchase
by licensed, registered Federal Firearms Dealers; and,
WHEREAS, such method of divestiture to licensed, registered Federal Firearms Dealers is
necessary to avoid the requisite paper work which would be required for individual sales of said
firearms to individual purchasers, but such extensive paper work requirements are avoided by sale
of said weapons to licensed, registered, Federal Firearms Dealers; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the City Council of the City of Paris, Texas, as the Project Entity, does
hereby authorize the Chief of Police and/or his designee on behalf of the Regional Controlled
Substance Apprehension Program Drug Task Force (the "Drug Task Force") to advertise for and
solicit bids for those certain firearms and other weapons confiscated as a result of the drug
interdiction activities of the aforesaid Drug Task Force, as those firearms and other weapons are
identified in that list of such firearms and other weapons attached hereto as Exhibit A and for all
purposes incorporated herein.
Section 3. That the aforesaid firearms and other weapons as listed in Exhibit A herein have
been and are authorized for disposition as a result oflawfuljudicial orders placing ownership of said
firearms and other weapons in the Drug Task Force, and as a result said Drug Task Force is
authorized by law to sell such firearms and other weapons and apply the proceeds from said sale to
further drug interdiction activities.
Section 4. That following advertisement for bids for the sale of said firearms and other
weapons, bids shall be received at the office of the City Manager on such date and such time as the
City Manager and Police Chief shall direct, and following receipt of said bids, the highest bidder
shall be identified and presented to the City Council for subsequent award.
Section 5. That bids shall be received for said confiscated firearms and other weapons only
from registered, licensed Federal Firearms Dealers as said individuals are authorized for said
purchase pursuant to state and federal law.
Section 6. That the proceeds of said sale shall be applied to future drug interdiction activity
undertaken by the Drug Task Force as said expenditures are authorized pursuant to state and federal
law.
Section 7. That this resolution shall be effective from and after its date of passage.

SPECIFICATIONS
1. This bid requires the following documentation:
a. A copy of the valid Federal Firearms Dealer's License the person
possesses, along with the current address ofthe business.
b. A copy of a valid states drivers license possessed by the person holding
the valid Federal Firearms Dealer's License.
2. The bid price will be for the complete lot of firearms and knives. No
firearms or knives will be sold separately.
3. The firearms and knives can be viewed on Sunday, May 16,2004, between
1 :00 p.m. to 5 :00 p.m., and Saturday, May 22, 2004, between 10:00 a.m. and
2:00 p.m. at the Paris Police Department Municipal Court Room located at
811 Bonham Street in Paris, Texas. A valid Federal Firearms Dealer's
License and state's valid driver's license must be presented to view the
firearms and knives.
4. Bids will be received until 3:00 p.m., Tuesday, June 8, 2004, at which time all
bids received will be publicly opened, read aloud, tabulated, and forwarded to
the city manager. All bids will then be referred to the City Council for
consideration at the meeting on Monday, June 14,2004 at 6:00 p.m.
5. All bids must be submitted on City of Paris Bid Forms.
6. Payment will be made by cashier's check made out to the RCSAP - City of
Paris.
7. The firearms and knives will be picked up at a time and place agreed to after
