2005-110-RES DISANNEX RESOLUTION NO. 2005-110 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, STATING THE INTENT OF THE CITY OF PARIS, PURSUANT TO CHAPTER 7 OF THE CITY CHARTER AND SECTION 43.142 OF THE LOCAL GOVERNMENT CODE, TO DISANNEX A 120.01 ACRE TRACT OF LAND AT STATE HWY 19/24 FORMING A PORTION OF THE CURRENT OUTER BOUNDARIES OF THE CITY LIMITS OF THE CITY OF PARIS; ESTABLISHING HEARING DATES; PROVIDING FOR PERSONAL AND PUBLISHED NOTICE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Manager has presented to the City Council proposals for disannexation of property currently located within the City Limits of the City of Paris; and, WHEREAS, the City Council desires to initiate proceedings pursuant to Chapter 7 of the City Charter and Section 43.142 of the Local Government Code to disannex a 120.01 acre tract ofland at State Hwy 19/24 forming a portion of the current boundaries of the city limits of the City of Paris as otherwise described herein; and, WHEREAS, the City Council desires to provide for notice of public hearings, establish the dates for public hearings, and establish the dates to institute and complete said disannexation proceedings; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF P ARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That by adoption of this resolution, the City Council does hereby state its intent to disannex a 120.01 acre tract of land at State Hwy 19/24 currently forming a portion of the outer boundaries of the city limits of the City of Paris, said tract ofland being more specifically described in Exhibit A attached hereto and for all purposes incorporated herein. Section 3. That by or before September 23, 2005, actual written notice of the City's intent to disannex the aforesaid area shall be given to each property owner in said area proposed for disannexation; to each public entity, including, but not limited to Lamar County, the appropriate school district, as well as any and all other public entities which will have to assume responsibility for certain public services following the aforesaid disannexation; and to each railroad company, if any, that serves the municipality if part of the company's right-of-way is in the area proposed for disannexation. Section 4. That the first public hearing regarding said proposed disannexation shall be conducted by City Council at its regular meeting of October 24, 2005, with notice of said public hearing to be carried on the City's internet website and to be published at least once in the Paris News within the time frame beginning October 4,2005, and ending October 13,2005. Section 5. That the second public hearing regarding said proposed disannexation shall be conducted by City Council at a special called meeting on November 7, 2005, with notice of said public hearing to be carried on the City's internet website and to be published at least once in the Paris News between the time frame beginning October 18, 2005, and ending October 27, 2005. Section 6. That City Council shall consider an ordinance calling for the disannexation of the aforesaid described tract at City Council's regular meeting of November 28,2005. Section 7. That this resolution shall be effective from and after its date of passage. PASSED AND APPROVED this 12th day of September, 2005. ATTEST: ~:'Q 'f(X)~O . ce Ellis, City Clerk PROPERTY DESCRIPTION DlSANNEXATION OF 120.01 ACRE TRACT [State Hwv 19/24 South) BEGINNING at a point in the North Right-of-Way Line ofCR 11400, said point being 532 feet East of the intersection of the centerline of State Hwy 19/24 South and North Right-of-Way Line ofCR 11400; THENCE Southerly, parallel to and 500 feet East of the Centerline of the Right-of-Way of State Hwy 19/24 South, a distance of5,2ll feet to a point; THENCE Westerly, parallel to the North Right-of-Way Line of County Road 21400, a distance of 1,073 feet to a point; THENCE Northerly, parallel to and 500 feet West ofthe Centerline of the Right-of-Way of State Hwy 19/24 South, a distance of 5,225 feet to the North Boundary Line of County Road 21400; THENCE Easterly along the North Boundary Line of CR 21400 crossing State Hwy 19/24 South and continuing along the North Boundary Line ofCR 11400 to the place of beginning, containing 120.01 acres.
