RESOLUTION NO. 2005-079
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, REVISING SECTION 6 OF RESOLUTION NO. 2005-070,
ADOPTED JUNE 13,2005, WHICH STATED THE INTENT OF THE CITY
OF PARIS TO DISANNEX TWO TRACTS OF LAND, TO EXTEND THE
ANTICIPATED FINAL DATE OF DISANNEXATION FROM AUGUST 29,
2005, TO SEPTEMBER 26, 2005, TO ACCOMMODATE AND AFFORD THE
OPPORTUNITY FOR FULL VOTER PARTICIPATION OF THOSE
RESIDENTS RESIDING IN THOSE PROPERTIES PROPOSED FOR
DISANNEXATION IN A SPECIAL ELECTION TO BE CONDUCTED BY
THE CITY OF PARIS ON SEPTEMBER 10, 2005; MAKING OTHER
FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris, Paris, Texas, has previously adopted
Resolution No. 2005-070 on June 13,2005, stating the City's intent to disannex two tracts ofland
as described therein; and,
WHEREAS, Section 6 of said Resolution proposed as a final date for disannexation August
29,2005; and,
WHEREAS, because of an Initiative Petition filed with the City of Paris proposing an
ordinance related to issues associated with possible privatization of garbage collection, the City of
Paris has called a Special Election for September 10,2005 to afford the voters ofthe City of Paris
the opportunity to vote for or against the proposed initiative ordinance; and,
WHEREAS, if the City of Paris followed its proposed schedule for completion of
disannexation, the proposed disannexed property would be finally disannexed in the middle of the
voting process with regard to said Special Election; and,
WHEREAS, the City Council desires to afford those voters, if any, located in the proposed
disannexed areas to have a full opportunity to participate in the voting process; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved,
Section 2. That Section 6 of Resolution No, 2005-070, adopted June 13, 2005, stating the
intent of the City of Paris to disannex two tracts of land forming a portion of the current outer
boundaries of the City Limits of the City, shall be and is hereafter in all things amended to read as
follows:
"Section 6. That City Council shall consider on first reading an ordinance
calling for the disannexation of the aforesaid described Tracts One and Two and City
Council's regular meeting of August 22, 2005, and if passed on first reading which
said disannexation to be considered for approval on the second and final reading at
City Council's regular meeting of September 26,2005."
Section 3. That all other provisions of resolution No, 2005-070, save and except as
amended as provided herein, shall be and remain in full force and effect.
Section 4. That this resolution shall be effective from and after its date of passage,
PASSED AND APPROVED this 11 th day of July, 2005.
