11 - Private Tax Re-SalesItems No. I I TO: Mayor& City Council FROM: John Godwin, City Manager SUBJECT: PRIVATE TAX RE -SALES DATE: February 21, 2018 BACKGROUND: Through a previously rarely used provision of state law, The Pounders, Law Firm has arranged for the private sale of six tax delinquent properties that failed to get bids during previous public tax sales. STATUS OF ISSUE: The twenty-three trustee tax properties will be sold to multiple persons for a total of $4,250.00 This sale will move six properties frorn the city's care to private ri,iaintenance, and at the sarne time place them back on tax rolls. BUDGET: The city will receive unbudgeted revenue of $4,250.00. RECOMMENDATION: Approve Resolution Approving the Private Re -Sale of Multiple Tracts of Bid -Off Tax Foreclosed Properties. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING THE PRIVATE RE -SALE. OF MULTIPLE TRACTS OF TAX FORECLOSED PROPERTIES AND AUTHORIZING THE MAYOR TO EXECUTE DEEDS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT AND PROVIDING AN EFFECTIVE DATE. WHEREAS, numerous tracts of real property (the "Trustee Properties") were previously bid off to the City of Paris as Trustee for itself, Lamar County, Paris ISD and Paris junior; and WHEREAS, Texas Property Tax Code Section 34.05(i) provides that the Trustee Properties may be sold by private sale in lieu of a public sale under Texas Property Tax Code Section 34.05(c) & (d) with the approval of all taxing units entitled to receive proceeds from the sale, being the City of Paris, Lamar County, Paris ISD and Paris Junior College; and WHEREAS, private offers to purchase several of the Trustee Properties have been received by the City of Paris (the "Private Sale"); NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City Council of Paris, Texas, that: Section 1. The following offers to purchase the following tracts of real property, being the highest bids received, are hereby accepted and the Private Sales are hereby approved:. • LCAD #10966 - 'EAST PARK ADDITION, BLOCK A, LOT 12, 1775 KITH NE' to Zenia Gilmore for $508 • LCAD #107968 - 'EAST PARK ADDITION,, BLOCK A, LOT 14, 1785 18TH NE' to Zenia Gilmore for $5807 • LCAD #11814 - 'EAST PARK ADDITION, BLOCK B, LOT 18, 16507 NE 10TH' to Zenia. Gilmore for $1000 • LCAD ##1.5557 - 'CITY OF PARIS, BLOCK 181-8, LOT 3, 111-H NW CAUSE 71173' to Hillsboro Inlet LLC, a Wyoming LLC for $9070 • LCAD #1072156 - 'CITY OF PARIS, BLOCK 44-A, LOT 5-13' to Hillsboro Inlet LLC, a Wyoming LLC for $8.507 • LCAD #200592 - 'WESTSIDE ADDITION, BLOCK 12, LOT 3, 2131 W CHERRY CAUSE 82314' to Joletta Sutton for $50707 Section 2. Subject to the Private Sales also being approved by Lamar County, Paris ISD and Paris Junior College, and the receipt of the monies bid for the 'Trustee properties, Private Pro erty 'lax. Re -Sale Resolution, Page I of the Mayor is hereby authorized to execute a tax deed conveying the Re -Sale Properties to the Purchaser or designee. Any prior approval to re -sell this Trustee Property is hereby withdrawn. Section 3. The proceeds of the Private Sale shall be distributed in accordance with the Texas Property Tax Code and the orders of the District Courts of Lamar County, Texas.
