14 - Zoning Change Request-4605 Lamar AvenueItern No. 14 TO: Mayor & City Council :loin Godwin, City Manager FROM: Alan Efi-ussy, AlCP, City Planning Manager SUBJECT: CHANGE IN ZONING FROM A COMMERCIAL TO A COMMERCIAL WITH A SPECIFIC USE PERMIT (SELF-STORAGE/MINI-WAREHOUSE), AT 4605 LAMAR AVENUE. DATE. February 13, 2018 BACKGROUND: This request is to conduct a public hearing and take action regarding the petition of Robert Russell for a change in zoning frorn a Commercial (C) to a Commercial (C) with a Specific Use Pen -nit (SUP) (Self--Storage/Mini--''Warehouse), on City Block 315-A, Lot 1, ABST 208 Crow Survey being located at 4605 Lamar Avenue. This properly is comprised of 3.52 acres. At the February 5, 2018 Planning and Zoning Commission meeting, no person spoke either in favor of or in opposition to, this request. The commission unanimously recommended approval of this rezoning request conditioned upon the submitted Site Plan and conditions. STATUS OF ISSUE: The city staff has determined the following: (A) Existing Land Use: The site includes an existing office building. This building fronts on Lamar; the rear of the property is vacant and that is the location of the proposed self- storage/rnini-warcho use uses. There is no flood plain on this property and there appears to be no other man-made and/or natural environmental constraints on this property (B) The Future Land Use Plan (FLUP) within the Comprehensive Plan: The FLUP recomi-nends, approximately the front one-third of this subject property as Retail (R), and the remaining approximately two-thirds of the property is, Low -Density Residential (LDR), which is the single-family detached homes land use. I-lowever, the current zoning of Commercial (C) on this entire subject property is a more realistic land use recommendation, given the existing businesses in the area. (C), Site Plan Rengirer - - This project requires an SUP along with a site plan, and conditions as appropriate. The city staff recommends approval, in conjunction with the following conditions, all of which have been agreed to by the applicant. 1. This property shall be developed as per the Site Plan dated January 13, 2018 and comprised of three sheets. 2. An existing fence shall be replaced and represent safety and security fencing and shall be subject to the City of Paris Fence Regulations and shall be subject to the approval of the city staff Replaced fencing shall only be required along the border of the land area to be developed. 3. Some existing tree cover exists near the rear of the property, and staff is recommending saturation landscaping to buffer and totally visually screen the proposed storage buildings. Existing single-family homes are north of this property and the FLUP recommends LDR up to and adjacent to the northern property line of this property. Hence, this proposed tree buffer would be an appropriate separation from both existing and proposed LD R uses. Said vegetative buffer shall be subject to city staff approval. 4. One accessible parking space shall be provided and identified on the subject Site Plan, as approved by the city engineer, 5. Illustrate overall entrance and access to, the property, which shall be approved by the city engineer. 6. Illustrate lighting on the Site Plan, recognizing that no lighting shall illuminate beyond the subject property line. Ory ur r AN ORDINANCE OF THE CITY" COUNCIL OF 'THE' CITY OF PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SO AS TO REZONE LOT 1, CITY OF PARIS BLOCK 315-A, MIST 208 CROW SURVEY, BEING LOCATED AT 4605 LAMAR AVENUE, IN THE CITY OF PARIS, LAMAR COUNTY, TEXAS, FROM A COMMERCIAL DISTRICT (C) TO A COMMERCIAL DISTRICT (C) WITH A SPECIFIC USE PERMIT (Sz) FOR A SELF-STORAGE/MINI- WAREHOUSE; DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission received a request for an amendment to the Zoning Ordinance of the City of Paris to rezone Lot 1, City of Paris Block 315-A, being located at 4605 Tamar Avenue, in the City of Paris, Lamar County, Texas, from a Commercial district (C) to a Commercial District (C), with a Specific Use Permit (52) for a. Self -Storage/Mini Warehouse; and WHEREAS, on February 5, 2018, following notice and Publication as required by law, the Planning and Zoning Commission conducted a public hearing on the proposed amendment to the City Zoning Ordinance and, following said hearing, made formal recommendation to the City Council to approve the requested zoning; and, WHEREAS, on February 26, 2018, following notice and publication as required by law, the City Council of the City of Paris conducted a public hearing on the proposed amendment to the City Zoning Ordinance, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid zoning change would be consistent with the City Zoning Ordinance, and in the best interests of the public health, safety, and welfare of the citizens of the City of Paris by a vote of — ayes and ® nays. AOTr PARIS, Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Official Zoning Flap of the City of Paris, Texas and Zoning Ordinance leo. 1710 of the City of Paris as heretofore amended is hereby further amended to rezone Lot 1, City of Paris Block 315-A, being located at 4605 Lamar Avenue, in the City of Paris, Lamar County, Texas, from a Commercial District (C) to a Commercial District (C), with a Specific Use Permit (52) for a Self-Storage/Mini Warehouse, with the following conditions: 1. This subject property shall be developed in accordance with the submitted Site Plan dated January 13, 2018 and comprised of three sheets so dated: (1) Overall general Site Plan that includes Phases 1 and 2; (2) Site Plan illustrating detail of Phase 1 of said self-storage/mini-warehouses, and (3) Site Plan illustrating enlarged image of the detailed plan for Phase 1. 2. Existing fence is indicated to be eliminated on the Site Plan., This current fencing is comprised of chain link fencing. The replaced fence shall represent safety and security fencing and shall be subject to the City of Paris Fence Regulations (Paris, Texas, Code of Ordinances, and Sec. 11.5-3). Replaced fencing shall be subject to the approval of the city staff. Replaced fencing shall only be required along the border of the land area to be developed. 3. There is some existing tree cover near the rear property line. There shall be saturation landscaping to buffer and totally visually screen the proposed storage buildings. Approximately several blocks north, northeast, and northwest of this subject property are existing single-family homes; the Future Land Use Plan map recommends I..,ow-Density Residential (LIAR) (single-family detached homes) up to and adjacent to the northern property line of this subject property, and nearby ,existing commercial properties. Hence, this proposed tree buffer shall be an appropriate separation from LIAR uses and commercial uses, both existing and proposed in this subject area. Said vegetative buffer, shall be subject to city staff approval, 4. One accessible parking space shall be provided and identified on the subject Site Plan, and subject to the city engineer's approval. 5. Illustrate overall entrance and access to the subject property; said entrance and access shall be subject to the approval of the city engineer. 6. Illustrate lighting on the Site Plan, recognizing that no lighting shall illuminate beyond the subject property line. All six conditions shall be implemented per the direction and approval of the City of Paris staff. Section 3. A Final Site Plan shall be submitted with said conditions illustrated on same, as stated herein. Section 4. 'That the Chief Building Official of the City of Paris be, and he is hereby, directed to change the Official Zoning Map of the City of Paris, Texas to reflect the changes set forth in this ordinance. Section 5. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 6. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 7. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable,, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 8. 'That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1-6 of Chapter One of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above -enumerated merated sections shall constitute and be deemed a separate offense, Section 9. This ordinance shall become effective from and after its passage and publication as required by law.
