2005-007-ORD AMENDING ZONING ORDINANCE NO 1710 AND CHANGING BOUNDARIES ESTABLISHED BY ZONING MAP OF SAID CITY ON LOT 27-A CITY BLOCK 251 ON PROPERTY BELONGING TO BRAD DRAKE ORDINANCE NO. 2005-007 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY; ESTABLISHING A LIGHT INDUSTRIAL DISTRICT (LI) ON LOT 27-A, CITY BLOCK 251, ON PROPERTY BELONGING TO BRAD DRAKE, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A COMMERCIAL DISTRICT (C); DESIGNATING THE BOUNDARIES OF THE LIGHT INDUSTRIAL DISTRICT (LI) SO ESTABLISHED; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris, Paris, Texas, has previously received a request for an amendment to the zoning ordinance of the City of Paris; and, WHEREAS, the City Council has subsequently referred said request for amendment to the Planning and Zoning Commission for its review and recommendation in accordance with the City zoning ordinance and State law; and, WHEREAS, the Planning and Zoning Commission did conduct a public hearing on said proposed amendment to the City zoning ordinance and, following said hearing, made formal recommendation to the City Council regarding said proposed change; and, WHEREAS, the City Council of the City of Paris did subsequently conduct a public hearing on the aforesaid proposed amendment to the City zoning ordinance, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid zoning change would be consistent with the comprehensive plan of the City of Paris, consistent with the City zoning ordinance, and in the best interests and to the benefit of the public health, ~afety, and welfare of the citizens of the City of Paris; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the boundaries heretofore established by the Zoning Map and Ordinance No. 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a LIGHT INDUSTRIAL DISTRICT (LI) be, and the same is hereby, established on LOT 27-A, CITY BLOCK 251, on property belonging to BRAD DRAKE, so as to include in such LIGHT INDUSTRIAL DISTRICT (LI) the hereinafter described property, which was formerly and is presently designated as a COMMERCIAL DISTRICT (C), and that the boundaries of said LIGHT INDUSTRIAL DISTRICT (LI) be, and the same are hereby, established as follows: SITUATED within the corporate limits of the City of Paris, County of Lamar, and State of Texas, being a part of the Reddin Russell Survey #786, and being a part ofa called 22.128 (tr. #1) acre tract ofland and all ofa called 0.34 (tr. #2) acre tract ofland conveyed Paris Investments by deed recorded in Vol. 612, Page, 851, of the Deed Records of said County and State. BEGINNING at a post (f) for comer at the Southwest comer of said 22.128 acre tract, the Northerly Southeast comer of a called 37.545 acre tract of land conveyed Artis Edzards by deed recorded in Vol. 576, Page 889, of said Deed Records, and in the North Boundary Line of a called 14.299 acre tract of land conveyed Virgil Lee Williams et ux by deed recorded in Vol. 679, Page 597, of said Deed Records. THENCE along a fence along the South Boundary Line of said 22.128 acre tract as follows: North 88'45'55" East a distance of 797.05 feet to a post (f) at the Northeast comer of a called 2 acre tract ofland conveyed said Williams by said deed, said point also being the Northwest comer of tract 2 as conveyed Billy Brockway et ux by deed recorded in Vol. 674, Page 48, of said Deed Records; North 88'07'06" East along the North Boundary Line of said Brockway tract 2 a distance of 251.07 feet to an iron pin (f) for comer at the Southwest comer of a called 2.150 acre tract of land conveyed HermanF. Maurer et ux by deed recorded in Vol. 836, Page 57, of the Real Property Records of said County and State; THENCE North 1'13'03" West a distance of339.05 feet to an iron pin (f) for comer at the Northwest comer of said 2.150 acre tract; THENCE North 89'02'46" East a distance of240.18 feet to a nail (f) in a washer for comer at the Northerly Northeast comer of said 2.150 acre tract; THENCE North 2'12'19" West a distance of 19.60 feet to a capped (JMN- 4025) iron pin (s) for comer at the Northwest comer of a 0.4860 acre tract of land surveyed July 12,2000; THENCE North 89'04'05" East a distance of 154.09 feet to a capped (JMN - 4025) iron pin (s) for comer at the Northeast comer of said 0.486q acre tract; THENCE in a Northerly direction along the West Boundary Line ofN. Main St. around a curve (R=3879.72', C=North 2'30'33" East 60.11 ft.) to the right a distance of60.l1 feetto a capped (JMN - 4025) iron pin (s) for comer at the Easterly Northeast comer of said 22.128 acre tract, said point being the Southeast comer of a called 6.390 acre tract ofland conveyed A. John Hecht & Sue Ellen Cravatt by deed recorded in Vol. 654, Page 367, of said Deed Records; THENCE South 89'04'05" West a distance of756.81 feet to an iron pin (f) for comer at the Southwest comer of a called 1.7431 acre tract ofland conveyed out of said 22.128 acre tract to a. John Hecht & Sue Ellen Cravatt by deed recorded in Vol. 280, Page 219, of said Real Property Records; THENCE North 0'55'34" West a distance of536.34 feet to a capped (JMN- 4025) iron pin (frs) for corner at the Northwest comer of said 1.7431 acre tract; THENCE along the Southerly Boundary Line of Loop Hwy. 286 as follows: South 83'52'28" West at 13.02 ft. passing the Westerly Northwest corner of said 22.128 acre tract and the Northeast corner of said 0.34 acre tract, and continuing on a total distance of 47.02 feet to a concrete marker (f); South 74'38'55" West a distance of 578.23 feet to the intersection of the Southerly Boundary Line of said Loop Hwy 286 and the Easterly Boundary Line of the Kiamichi Railroad, said point being a Northwest corner of said 22.128 acre tract, said point also being South 74'38'55" West a distance of 0.37 ft. from a concrete marker (f); THENCE South 22'17'40" West along the Easterly Boundary Line of said Kiamichi Railroad a distance of212.4 7 feet to a capped (JMN - 4025) iron pin (s) for corner at the Westerly Northwest corner of said 22.128 acre tract, said point being the Northerly North corner of said 37.545 acre tract; THENCE South 1'15'37" East along a fence a distance of619.96 feet to the place of beginning and containing 17.9023 acres ofland, or 779,822.71 sq. ft. ofland, being numbered 205 Loop 286 N.W. Section 3. That the Chief Building Official of the City of Paris be, and he is hereby, directed to change the Zoning Map of the City of Paris in accordance with the provisions of Ordinance No. 1710 and the land use map accompanying the same, and in accordance with the provisions of this ordinance. Section 4. That any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each and every day's continuance of any violation of the above-enumerated sections shall constitute and be deemed a separate offense. Section 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. That this ordinance shall become effective March I, 2005.
