03/12/2018 MinutesMINUTES OF THE REGULAR CITY COUNCIL MEETINC OF THE CITY OF PARIS, TEXAS March 12, 2018 The City Council of the City of Paris met for a regular session at 5:30 p.m. on Monday, March 12, 2018, at the City Council Chamber, 107 E. Kaufman, Paris, Texas. Present: Mayor: Steven Clifford Council Members. Billie Sue Lancaster; Billy Trenado; Cleorme Drake; and Paula Portugal City Staff- John Godwin, City Manager;, Stephanie Harris, City Attorney; Janice Ellis, City Clerk; Gene Anderson, Finance Director; Bob Hundley, Police Chief-, Larry Wright, Fire Chief, Carla Easton, City Engineer; Jerry McDaniel, Public Works Director; Alan Efrussy, Planning Director; Doug Harris, Utilities Director; Kent Kfinken-nati, EMS Director; Priscilla McAnally, I-ibrary Director; and Clyde Crews; Fire Marshal Absent: Council Members: Aaron Jenkins & Linda Knox Opening Agenda Call meeting to order. Mayor Clifford called the meeting to order at 5:30 p.m. 1 Invocation, Finance Director Gene Anderson gave the invocation. Pledge of Allegiance, Council Member Drake led the pledge. 4. Citizens' Forurn, Judy Malone, 1975 E. Cherry Street - she said there was an incident in which a city truck pumped water and sewer through the lines and both her toilets exploded with sewer. She also said the city crew helped her clean up the bathrooms. Ms. Malone said the real problem was with the ditch between Cherry and Tudor, one block off of 20"' Street, She said over the years the ditch had become deeper and was full of debris. She also said there was sewer floating down the ditch. Regular Council Meeting March, 12, 2018 Page 2 Kevin Ashmore, 480 S.E. - he introduced himself and said lie was an applicant for the Main Street Advisory Board. He said lie grew up in Paris, moved his family home and wanted to get involved in downtown. Consent Agenda Mayor Clifford inquired of Council Members if they wished to pull any items from the consent agenda for discussion. There being none, a Motion to approve the consent agenda was made by Council Member Drake and seconded by Mayor Clifford. Motion carried, 5 ayes 0 nays. 5. Approve minutes from the meeting of February 26, 2018. 6, Receive reports and/or minutes froom the following boards and commissions: a. Paris -Lamar County Health District (10-16-2017) b, Paris Public Library Advisory Board (12-20-2017) 7, Accept bids and award contracts for the purchase of roadway materials to the lowest responsible bidder(s) for the twelve-month period beginning April 1, 2018, 8. Authorize final payment in the amount of $63,843.70, close out the contract with HWH Construction for construction of the West Paris Multi -Use Trail., and accept improvements. 9. Receive the Paris Economic Development Corporation 2016-17 Annual Audit Report. Regular Agenda 10. Discuss, conduct a public hearing, and act on ORDINANCE NO. 2018-007: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ABANDONING A ONE -HUNDRED FORTY-TWO (142) FOOT PORTION OF ALLEY BETWEEN 627 NE 5"' AND 639 NE 5 T" , BEGINNING AT THE WEST BOUNDARY LINE OF NE 5"" STREET, THENCE WEST ALONG THE SOUTH BOUNDARY LINE OF LOT 36 A DISTANCE OF 142 FEET TO THE SOUTHWEST CORNER OF LOT 361, BLOCK 60, THENCE SOUTH 17 FEET TO THE CORNER OF THE NORTH PROPERTY LINE OF LOT 35, BLOCK 60, THENCE EAST ALONG THE NORTH PROPERTY LINE OF LOT 35 A DISTANCE OF 142 FEET TO THE NORTHEAST CORNER OF LOT 35, THENCE NORTH ALONG THE WEST BOUNDARY LINE OF NE 5T'' STREET 17 FEET TO THE PLACE OF BEGINNING IN THE CITY OF PARIS, TEXAS; DECLARING THAT THERE IS, NOT PUBLIC NECESSITY OR NEED FOR SAID PORTION OF ALLEY FOR, CITY USE; MAKING OTHER FINDINGS AND PROVISIONS RELA'T'ED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Regular Council' Meeting March 12, 2018 Page 3 Mr. Anderson explained the City received a request to abandon 142 feet of alley between 627 N.E. 5'h and 639 N.E. 5"' Street, and that the sarric person owned both pieces of property. Mr. Anderson said Oncor would retain their easement for possible future use. Mayor Clifford opened the public hearing and asked for anyone wishing to speak in favor or opposition of this item, to please come forward. Derek Hughes, 627 5111 Street N.E., spoke in support of this item. Mr. Hughes said lie had maintained the alley for many years. A Motion to approve this item was made by Mayor Clifford and seconded by Council Members Portugal and Trenado. Motion carried, 5 ayes — 0 nays. 11. Discuss and act on RESOLUTION NO. 2018-009: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AUTHORIZING THE EXECUTION OF A DEED OF ABANDONMENT TO THE ADJACENT PROPERTY OWNER OF A ONE -HUNDRED FORTY-TWO (142) FOOT ALLEY ABANDONED BY ORDINANCE NO. 20118-007 LOCATED BETWEEN 627 NE 5T " AND 639 NE STH, BEGINNING AT THE WEST BOUNDARY LINE OF NE 5 T11 STREET, THENCE WEST ALONG THE SOUTH BOUNDARY LINE OF LOT 36, A DISTANCE OF 142 FEET TO THE SOUTHWEST CORNER OF LOT 36, BLOCK 60, THENCE SOUTH 17 FEET TCS THE CORNER OF NORTH PROPERTY LINE OF LOT 35, BLOCK 60 THENCE EAST ALONG THE NORTH PROPERTY LINE OF LOT 35, A DISTANCE OF 142 FEET TO THE NORTHEAST CORNER OF LOT 35, THENCE NORTH ALONG THE WEST BOUNDARY LINE OF NE 5711 STREET 17 FEET TO THE PLACE OF BEGINNING IN THE CITY OF PARIS,, TEXAS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. A Motion to approve this item was made by Council Member Portugal and seconded by Mayor Clifford. Motion carried, 5 ayes - 0 nays, 12. Discuss, accept the bid and award a contract in the amount of $1,01.7,000, with deductive alternates 3, 4, & 5, to McInnis Brothers Construction, Inc. for construction of the Flow Equalization Basin Barscreen Project, Utilities Director Doug Harris said the project was advertised for bids beginning June 2017 through various websites, as well as published in the Paris News. Mr. Harris also said thirty contractors were contacted by phone and thirty-three contractors were mailed bid packets by Hayter Engineering, hic. Mr. Harris informed City Council that seven bids were received and Hayter Engineering recommended the project be awarded to the low bidder, which was McInnis Brothers Construction, Inc. A Motion to approve this item was made by Mayor Clifford and seconded by Council Member Drake. Motion carried, 5 ayes -- 0 nays. 13. Discuss and act on a contract with Archer Construction & Design for construction of the new northwest EMS station, in an amount not to exceed $500,000. Regular Cound Meeting March 12, 2018 Page 4 City Manager John Godwin said a new EMS station would be constructed on 19"' Street N.W. and that after bidding the project last year unsuccessfully, the City entered into negotiations with the low bidder, Archer Construction & Design. He explained Archer was a certified contractor with TIPS and a price had been negotiated in an amount not to exceed $500,000, A Motion to approve this item was made by Council Member Trenado and seconded by Mayor Clifford. Motion carried, 5 ayes — 0 nays. 14. Discuss and act on ORDINANCE NO, 2018-008: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING A TARIFF AUTHORIZING AN ANNUAL RATE REVIEW MECHANISM ("RRM-) AS A SUBSTITUTION FOR THE ANNUAL INTERIM RATE ADJUSTMENT PROCESS DEFINED BY SECTION 104.301 OF THE TEXAS UTILITIES CODE, AND AS NEGOTIATED BETWEEN ATMOS ENERGY CORP., MID -TE X DIVISION (--ATMOS MID -1-1--X" OR "COMPANY") AND THE STEERING COMMITTEE OF CITIES SERVED BY ATMOS; REQUIRING THE COMPANY TO REIMBURSE CITIES' REASONABLE RATEMAKING EXPENSES; ADOPTING A SAVINGS CLAUSE; DETERMINING THAT THIS ORDINANCE WAS PASSED IN ACCORDANCE WITH THE REQUIREMENTS OF THE OPEN MEETINGS ACT; DECLARING AN EFFECTIVE DATE; AND REQUIRING DELIVERY OF THIS ORDINANCE TO THE COMPANY AND LEGAL COUNSEL FOR. THE STEERING COMMITTEE. Mr. Anderson said the previous rate review mechanism ended last year and the revised RRM reduces the rate of return on equity, captured the reduction of federal income tax rates, and allowed more tirne for cities to review the Atrnos filings. A Motion to approve this item was made by Mayor Clifford and seconded by Council Mer nber Treliado, Motion carried, 5 ayes — 0 nays. 15. Discuss and act on ORDINANCE NO. 2018-009: AN ORDINANCE OF THE CITY COUNCIL., OF PARIS, TEXAS, DECLARING UNOPPOSED CANDIDATE IN CITY COUNCIL DISTRICT I FOR THE MAY 5, 2018, GENERAL ELECTION BE ELECTED TO OFFICE; DETERMINING THAT NO GENERAL ELECTION BE HELD IN DISTRICT' 1; DIRECTING THAT A COPY OF THIS ORDINANCE BE POSTED AT APPROPRIATE POLLING PLACES; DIRECTING THAT A CERTIFICATE OF ELECTION BE ISSUED TO THE UNOPPOSED CANDIDATE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A, SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Regular Coundl Meeflng March 12, 2018 Page 5 City Clerk Janice Ellis said the candidate in District I was unopposed and the deadline to file had passed, Ms. Ellis asked Council to declare the unopposed candidate in District I elected to office, Mayor Clifford confirmed that this, would also cancel the election in District 1. A Motion to approve this item was made by Council Member Drake and seconded by Mayor Clifford. Motion carried, 5 ayes — 0 nays. 16, Discuss and appoitit one member to the Main Street Advisory Board to fill an unexpired teen, Mayor Clifford said the City had received three applications and they were Jay Kevin Ashmore, Jenny Wilson, and Lauren Corbell. A Motion to appoint Kevin Ashmore to the board was made by Council Member Portugal and seconded by Council Member Drake, Motion carried, 5 ayes — 0 nays. 17. Consider and approve future events for City Council and/or City Staff pursuant to, Resolution No. 2004-t181. Mr. Godwin reminded everyone of the Oak Park grand opening scheduled for Friday, March 23"d at 12:15 p.m. 18. Adjournment.
