05 - City Council MinutesItem No. 5 MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF PARIS, TEXAS March 26, 2018 The City Council of the City of Paris met for a regular session at 5:3O pm. on Monday, March 26, 2018, at the City Council Chamber, 107 E. Kaufman, Paris, Texas. Present: Mayor: Steven Clifford Council Members: Aaron Jenkins; Billie Lancaster; Billy Trenado; Paula Portugal; and Cleorine Drake City Staff: John Godwin, City Manager; Stephanie Harris, City Attorney; Janice Ellis, City Clerk; Gene Anderson, Finance Director-, Bob Hundley, Police Chief, Larry Wright, Fire Chief; Carla Easton, City Engineer; Jerry McDaniel, Public Works Director; Alan Efrussy, Planning Director; and Clyde Crews; Fire Marshal Absent: Council Member: Linda Knox Oening Ay ,enda I . Call meeting to order. Mayor Clifford called the meeting to order at 5:30 p.m. 2. Invocation. Finance Director Gene Anderson gave the invocation. 3. Pledge of Allegiance. Council Member Drake led the pledge. 4. Citizens' Forum. Grover Glatfelter, 1345 S.E. 6"' Street - he referenced a letter he left with the City Clerk stating that police, city employees or subcontractors were not permitted in or on his property unless the police had a warrant for his arrest. He requested the letter be sent to the City Council, Consent Aggnda Mayor Clifford inquired of Council Members if they wished to pull any items from the consent agenda for discussion. There being none, a Motion to approve the consent agenda was Regular Council Meeting March 26, 2018 Page 2 made by Council Member Drake and seconded by Council Member Trenado, Motion carried, 6 ayes — 0 nays, 5. Approve minutes from the meeting of March 12, 2018. 6. Receive reports and/or ininutes from the following boards, commissions, and committees: a. Airport Advisory Board (2-15-2018) b. Love Civic Center (1-11-2018) c. Historic Preservation Commission (2-14-2018) 7, Receive February monthly financial report. 8. Receive February drainage report. 9. Receive demolition and code enforcement activity reports. 141. Approve RESOLUTION NO. 2018-1110: A RESOLUTION OF THE CITY COUNCIL. OF THE CITY OF PARIS, TEXAS, APPROVING A JOINT ELECTION AGREEMENT BETWEEN THE CITY OF PARIS AND NORTH LAMAR INDEPENDENT SCHOOL DISTRICT FOR THE MAY 5, 2018 ELECTION DATE, MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE, 11. Approve RESOLUTION NO. 2018-011: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING A PROCLAMATION DECLARING THE MONTH OF APRIL AS FAIR HOUSING MONTH; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. Regular A enda 12. Authorize the City Manager to execute a contract for professional engineering and surveying services with KSA for the 171h and 24"' Street Reconstruction Project, in an amount not to exceed $300,000. City Manager John Godwin said that East 17"' and 24th Southeast were scheduled to be fully reconstructed beginning in fall 2018. He also said that prior to construction, engineering design needed to be provided by an outside fin -n and staff bad negotiated a professional services agreement for $283,700. Council Member Drake inquired if 24"' Street would be done in sections or all at one bine. Mr. Godwin said the street would be done in sections and that the two streets would not be under construction at the sarne time. Regular Council Meeting March, 26, 2018 Page 3 A Motion to approve this item was made by Mayor Clifford and seconded by Council Member Portugal. Motion carried, 6 ayes — 0 nays. 13. Discuss and authorize the City Manager to execute an Amended Management Lease Agreement with the Lamar County Chamber of Commerce. City Manager John Godwin said currently the City of Paris collects a 7 -cent Hotel Occupancy Tax, Chamber Chairman Josh Bray explained the current split of the hotel occupancy tax (HOT) proceeds 4/7 went to the Visitors and Convention Council and 3/7 went to the Love Civic Center. He said the entities were asking that the split be changed to 5015,0 which would mean an additional $45,000 to the Love Civic Center. Mr. Bray provided a balance sheet of the Visitor and Convention Council and said they were doing fine but there were a lot of repairs needed at the Civic Center. Love Civic Center Board Chairman Curtis Fendley explained the capital maintenance and repair items needed at the Civic Center. He emphasized that the parking lot had been resurfaced three years ago and that a loan had been secured to pay for it. He referenced lighting, the sound system and the twenty four year old roof. Mr. Fendley provided City Council with a facility assessment and balance sheet for the Love Civic Center. Mr. Fendley said over the next couple of months the Board was going to prioritize items and would like to bring those back to the City Council. Mr. Fendley also said they would be asking for a HOT tax increase, Mr. Bray said that the increase would be dedicated to debt service at the Civic Center, A Motion to approve this item was made by Council Member Drake and seconded by Council Member Lancaster. Motion carried, 6 ayes —19 nays, 14. Discuss and select a service provider for the Texas Capital Fund CDBG application. Mr. Godwin said the PEDC needed to hire a consulting, firm that specializes in grant application and management of an upcoming CDBG grant. PEDC Director Michael Paris said the application process was free and this would be used for the Spiral Weld Project in getting a rail assessment. Mr. Godwin said an RPQ was issued and two qualified finns responded. He also said staff recommended Resource Management & Consulting, as they had provided similar services for the City. A Motion to approve Resource Management & Consulting as the provider was made by Council Merriber Portugal and seconded by Council Member Drake, Motion carried, 6 ayes — 0 nays. 15. Convene into Executive Session pursuant to Section 551 .071 of the Texas Government Code, Consultation with Attomey, to receive legal advice from the City Attorney about pending, or contemplated litigation and/or on matters in which the duty of an attorney to her client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflict with this chapter, as follows: City of Paris v. Boorner Trends Magazine, Trac., Cause No. 87292, in the 62°d District Court of Larnar County, Texas, Mayor Clifford convened City Council into executive session at 5:43 p.m. ReguW Council Meeting March 26, 20,18 Page 4 16. Reconvene into Open Session and possibly take action on those matters discussed in Executive Session, Mayor Clifford reconvened City Council into open session at 5:48 p.m. 17. Consider and approve future events to'- City Council and/or City Staff pursuant to Resolution No. 2004-081. Mr. Godwin reminded everyone of the ribbon cutting and grand opening for Wade Park scheduled for Saturday. City Council complimented staff and the Chamber on the grand opening of Oak Park, 18. Adjournment, There being no further business, a Motion to adjourn was made by Mayor Clifford and was seconded by Council Member Drake, Motion carried, 6 ayes 0 nays.
