1997-090-RES WHEREAS, CITY COUNCIL IS IN RECEIPT OF A REQUEST FORM FROM PARIS JUNIOR COLLEGE FOR . . RESOLUTION NO. 97 -090 WHEREAS, the City Council of the City of Paris is in receipt of a request from Paris Junior College for an exchange of services between the two entities, and the City of Paris is agreeable to providing such services as it has available and to receiving such services as Paris Junior College has available; and, WHEREAS, in order to furnish and receive such services, it is necessary for the City of Paris and Paris Junior College to enter into an Intergovernmental Cooperative Agreement for Services; and, WHEREAS, the form of the agreement, attached hereto as Exhibit A, should, in all things, be approved, and Mayor of the City of Paris, Eric S. Clifford, should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the form of the Intergovernmental Cooperative Agreement for Services between the City of Paris and Paris Junior College, attached hereto as Exhibit A, be, and the same is hereby, approved; and, BE IT FURTHER RESOLVED, that Eric S. Clifford, Mayor of the City of Paris, be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, the Intergovernmental Cooperative Agreement for Services with Paris Junior College, under the terms and conditions and in the form shown in Exhibit A, attached hereto. INTERGOVERNMENTAL COOPERATIVE AGREEMENT FOR SERVICES STATE OF TEXAS COUNTY OF LAMAR ) ) ) KNOW ALL MEN BY THESE PRESENTS: THAT, the CITY OF PARIS, PARIS, TEXAS, a municipal corporation, by and through its Mayor, Eric S. Clifford, duly authorized, hereinafter called CITY, and PARIS JUNIOR COLLEGE, by and through its President, Bobby Walters, duly authorized, hereinafter called PJC, do hereby contract and agree as follows: 1. CITY and PJC agree to perform services for the other, at cost. Such services shall include any service which can be performed or any accommodation which can be provided by each respective entity or any other service agreed upon by the parties. 2. The cost of any such services performed by one entity shall be offset by the other entity providing services equaling a like sum. Each entity shall bill the other for any excess amounts as agreed. 3. This agreement shall be for a term of five (5) years, commencing on September 1, 1997, and ending on August 31, 2002. 4. CITY and PJC have the right to unilaterally terminate this agreement at any time. In the event of unilateral termination of this agreement by either party hereto, such amounts still owing shall be paid in full within thirty (30) days of cancellation hereof.
