1997-084-RES WHEREAS, CITY COUNCIL DID HERETOFORE IN RESOLUTION NO 96-037 , . . RESOLUTION NO. 97 -084 WHEREAS, the City Council of the City of Paris, did heretofore, in Resolution No. 96- 037, as the nominating entity for the Greater Paris Development Foundation, Inc., apply for the Statewide Transportation Enhancement Program Grant for the project entitled "Paris Santa Fe Frisco Railroad Depot Rehabilitation;" and, WHEREAS, the City Council of the City of Paris did heretofore, in said resolution, accept the donation of the depot from Kiamichi Railroad, which depot will be placed towards the City's twenty peTcent (20 %) cash match necessary under the terms of the gTant; and, WHEREAS, the City Council of the City of Paris did heretofore, on the 13th day of January, 1997, in Resolution No. 97-004, authorize the execution of the agreement with the Texas Department of Transportation for the Paris Santa Fe Frisco Railroad Depot Rehabilitation Project, CSJ #0901-29-012; and, WHEREAS, the Texas Department of Transportation additionally requires the execution of a Lobbying Certification for Contracts, Grants, Loans, and CoopeTative Agreements, and it is deemed appropriate that the form of said certification, attached hereto as Exhibit A, be, in all things, approved, and that the Mayor, Eric S. Clifford, be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the form of the Lobbying Certification for Contracts, Grants, Loans, and Cooperative Agreements, attached hereto as Exhibit A, be, and the same is hereby, approved; and, BE IT FURTHER RESOLVED, that the Mayor of the City of Paris, Eric S. Clifford, be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, the Lobbying Certification for Contracts, Grants, Loans, and Cooperative Agreements as a part of the agreement with the Texas Department of Transportation for the Paris Santa Fe Frisco Railroad Depot Rehabilitation Project, CSJ #0901-29-012, under the terms and conditions and in the form shown in Exhibit A, attached hereto. I ATTACHMENT I Lobbying Certification for Contracts, Grants, Loans, and Cooperative Agreements The undersigned certifies to the best of his or her knowledge and belief, that: (I) No federal appropriated funds have been paid or will be paid by or on behalf of the undersigned, to any person for influencing or attempting to influence an officer or employee of any federal agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with the awarding of any federal contract, the making of any federal grant, the making of any federal loan, the entering into of any cooperative agreement, and the extension, continuation, renewal, amendment, or modification of any federal contract, grant, loan, or coop~rative agreement. (2) If any funds other than federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with this federal contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form - LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions. (3). The undersigned shall require that the language of this certification be included in the award docwnents for all subawards at all tiers (including subcontracts, subgrants, and contracts under grants, loans, and cooperative agreements) and that all subrecipients shall certify and disclosure accordingly. This certification is a material representation of fact upon which reliance was placed when this tran511ction was made or entered into. Submission of this certification is a prerequisite for making or entering into this transaction fmposcd by Section 1352, Title 31, U.S. Code. Any person who fails to file the required certification shall be subject to a civil penalty of not less than $10,000 and not more than $100,000 for each such failure.
