MINUTES OF THE REGULAR MEETING
OF THE
BUILDING AND STANDARDS COMMISSION
MONDAY, JULY 16, 2018

1. Johnny Norris called the Building and Standards Commission Meeting to order at
3:30 P.M.
Roll was called.

2. Approval of minutes from previous meeting. (May 21, 2018)
Motion made by Ben Vaughan, seconded by Sally McEwin to approve minutes with
change. Motion carried unanimously. 6-0

3. Public Hearing to consider presentations by City of Paris Code Inspectors and
owner(s) and/or lien holder(s) of the below properties who have been given notice of
a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris,
Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures;"
Article II of Chapter 17, entitled "Control of Weeds, Junk, and Other
Objectionable, Unsightly, or Unsanitary Matter of Private Premises;" Chapter 1-6
of the Code of Ordinances of the City of Paris, Paris, TX:
E. 3473 rd NE; City Block 59, Lot 19
Owner: Celestine Thomas, c/o Rita C. Dixon PLLC, 8700 Stonebrook Pkwy
Box 1996, Frisco TX 75034
Robert Talley stated Rita Dixon, Ms. Thomas' attorney, is present. House is
unsecure; deteriorated wood on exterior; windows missing; needs new roof
covenng.
Robert Talley's recommendation: Declare a nuisance, demo within 30 days
or city has the right to do so.
Rita Dixon, appointed by Dallas County Court #2 as guardian of Celestine
Thomas' estate. Appointed June 22, 2017, to liquidate real properties of Ms.
Thomas. Has signed 6 -month contract with local realtor to sell property. No
plans to fix it up. Court date 09/13/18 to follow up with properties. Dependent
guardianship; needs approval from court to make decisions other than putting up
for sale. Request hold on decisions here today until that date has come.
Commission questions:
Q — What value did they put on the house?
A - $5,000 for house and lot next to it.
Q — Did the realtor give you any indication of whether the property would sell?
A — Said they would do the best they can.
Q — If we grant an extension, what about securing the property?
A — (Talley)Would recommend owner/guardian secure the property rather than
the city.
Q — Ms. Harris, can this commission issue orders to demolish if there's a contract
with a realtor to sell?
A — See no reason the commission cannot issue demo order.
Q — Mr. Talley, do you believe this house is repairable?
A — I've seen houses in worse condition that have been repaired. Also, it is
easier to sell these properties without a demo order on it.
Motion was made by Ben Vaughan to table for 90 days, seconded by Johnny
Norris. Motion carried. 4-2. Ken Kohls and Mike Folmar voted no.
A. 2591 W Houston; Sperry's 3`d Addition Block 1, Lot 5
Owner: Arnelle Camster, 715 E Cherry, Paris TX 75460
Robert Talley stated owner is deceased. No known living relatives. Missing
siding; roof beginning to sag; back of house has fallen in; unsecure.
Robert Talley's recommendation: Declare nuisance, demo with 30 -days or
city has the right do so.
Motion was made by Mike Folmar, seconded by Sally McEwin to accept
amended recommendation. Motion carried unanimously. 6-0
B. 11374 Ih SW; Locust Hill Addition Block 1, Lot PT of 1
Owner: Robbie Pantano, 8012 Tatum Ln, Lyles TN 37098
Robert Talley stated house is a total burn -out. Fire damage to front; unsecure;
inside still full of burned junk and rubbish; underpinning beginning to bow.
Robert Talley's recommendation: Declare a nuisance, demo within 30 days
or city has the right to do so.
Motion was made by Johnny Norris, seconded by Ben Vaughan to accept
Robert's recommendation. Motion carried unanimously. 6-0
C. 628 W Austin; City Block 119-A, Lot 11
Owner: Hattie Blankenship, 618 W Austin, Paris TX 75460
Robert Talley stated owner is deceased. Owner's son lives across the street.
Told me wants to fix it up, but after several months nothing has happened. Has
been to HPC and they moved it to BSC. Hole in roof; porch beginning to sag;
front left of house beginning to sag.
Robert Talley's recommendation: Declare nuisance, demo within 30 days
or city has right do so.
Motion was made by Mike Folmar, seconded by Ben Vaughan to accept
Robert's recommendation. Motion carried unanimously. 6-0
D. 1430 W Kaufman; Talkington-Hodge Addition Block 2, Lot PT 9-10,11
Owner: Grove Trust, JL Moore Trustee, 813 Simmons Dr, Euless TX 76040
Robert Talley stated this case is for the shed in back, not the house. Contacted
by neighbors concerned it will fall into their yard. Roof is beginning to collapse.
No contact from owners or renters.
Robert Talley's recommendation: Declare a nuisance, demo within 30 days
or city has right to do so.
Motion made by Johnny Norris, seconded by Sally McEwin to accept
Robert's recommendation. Motion carried unanimously. 6-0
F. 534 5th NW; City Block 81, Lot 2
Owner: Mitchell Ray, 750 Graham, Paris TX 75460
Robert Talley stated no contact with owners. Total burn -out. Right side about
to collapse. Unsecure.
Robert Talley's recommendation: Declare a nuisance, demo within 30 days
or city has right to do so.
Commission Questions:
Q — When did this catch fire?
A — Not sure. Been at least 6 months.
Motion was made by Mike Folmar, seconded by Ben Vaughan to accept
Robert's recommendation. Motion carried unanimously. 6-0
G. First National Bank — NW Corner; City Block 8, Lot 7 & 8
Owner: CTRA Property Holdings Corp., 8004 Two Coves Dr., Austin TX

Robert Talley stated no contact with owner. Received complaint from
neighboring business that pieces from roof were falling off. Confirmed this was
the case. Piece of safety fence was missing; has been replaced. Parts of
parapet underneath missing.
Robert Talley's recommendation: Declare a nuisance, repair of parapet
within 30 days, or back to BSC at which time we can entertain civil penalties.
Commission Questions:
Q — Do we have to wait the 30 days?
A — Yes; State Law gives owner 30 days to appeal.
Q — Is distance from wall and fencing adequate?
A — Yes; but that's just my opinion.
Q — Can netting be added to chain link fence to prevent small pieces from
flying through?
A — We're already absorbing a cost for the fencing; don't know how much
more the netting would cost.
Q — If a piece falls off and causes damage or harm, are we responsible?
A — No.
Q — Does the city have a responsibility to prevent debris from harming
someone or causing damage?
A — The city is not under obligation or liable for harm or damages. The
fence was put up to keep people off sidewalk because of it's condition.
Q — Can we require the owner to put up netting or repair the sidewalk to
make it safer?
A — Yes to both.
Motion was made by Sally McEwin, seconded by Ben Vaughan to accept
Robert's recommendation. Motion carried unanimously. 6-0
4. Code Enforcement update.
Demo contractors are caught up with Resource Mgmt, and back on our work load.
House on Pine Bluff has been demoed; 13th & Graham up next; 41s' SE coming up.
These were moved up due to complaints. 600 blk 12th SE and house on 12th NE, both
on list.
Is parking lot fencing at 1St Nat'l Bank gone?
Yes.
5. Future agenda items.
Status of Westgate Apartments on 7th NW.
Concrete steps left behind; piers and beams; in the way for mowers.
Why can't our Code Enforcement officers write tickets?
What type of system do we have for the end of orders issued, next step?
Copy of demo spreadsheet.
Update on purple house on Fitzhugh.
Update on Matthew Allen's position, and make elections in September.
