1996-035-RES WHEREAS, FEDERAL AVIATION ADMIN (FAA) HAS REQUESTED A RIGHT-OF-ENTRY AT COX FIELD AIRPORT
RESOLUTION NO. 96-035
WHEREAS, the Federal Aviation Administration (FAA) has requested a right-of-entry
at Cox Field Airport in order to survey a new site for the proposed relocation of the existing
remote center air/ground communications facility (RCAG), remote communications outlet
(RCO) , and direction finder (DF), and it is deemed appropriate that such right-of-entry be
granted; and,
WHEREAS, the form of the Right-of-Entry Permit, attached hereto as Exhibit A,
should, in all things, be approved, and the Mayor of the City of Paris, Eric S. Clifford, should
be authorized to execute the same; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the
form of the Right-of-Entry Permit, attached hereto as Exhibit A, be, and the same is hereby,
approved; and,
BE IT FURTHER RESOLVED, that Eric S. Clifford, Mayor of the City of Paris, be,
and he is hereby, authorized and directed to execute, on behalf of the City of Paris, the Right-of-
Entry Permit at Cox Field Airport to the Federal Aviation Administration for the purpose of
surveying a new site for the proposed relocation of the existing remote center air/ground
communications facility (RCAG), remote communications outlet (RCO), and direction finder
(DF), upon the terms and conditions and in the form shown in Exhibit A, attached hereto.

RIGHT-OF-ENTRY PERMIT
1. For and in consideration of the sum of One dollar ($1.00) and other
valuable considerations, the receipt of which are hereby acknowledged,
the City of Paris, P.O. Box 9037, Paris, TX 75461, hereinafter called
the Owner of the following described property located in Lamar County,
State of Texas:
This site is situated on the Paris, Texas, Municipal Airport (Cox
Field) and is more particularly shown on Exhibit "A", Airport Layout
Plan, attached hereto and by this reference made a part of this permit.
The Owner does hereby grant to the Federal Aviation Administration,
hereinafter called the Government, the right and privilege, for a period
of 180 days from the date hereof, to enter upon the land described
herein for the purpose of making such surveys, and conducting such tests
with portable or other electronic equipment, as may be necessary to
determine whether said property, or any portion thereof, is suitable for
the establishment of an communication/navigational facility.
2. The Owner further agrees, in the event the property or any portion
thereof is determined by the Government to be suitable for a
communication/navigational facility, to enter into negotiations for a
realty agreement covering necessary land requirements, together with the
right of ingress and egress thereto, from the nearest public or private
road.
3. All tools, equipment, buildings, improvements, and other property
taken upon or placed upon the land by the Government shall remain the
property of the Government and may be removed by the Government after
the expiration of this right-of-entry permit.
4. It is understood and agreed that if the Government does not acquire
title or other necessary interest in said land prior to the expiration
of this permit, the Government agrees to be responsible for any damage
arising from the activity of the Government or its agents on said lands,
in the exercise of rights under this permit, and shall repair such
damage, or, in lieu thereof and at the option of the Government, shall
make a cash settlement with the Owner.
EXHIBIT A
5. This agreement shall become effective upon date of execution
thereof, and shall remain in force for 180 days from said date. Should
the test prove favorable, a representative from the Real Estate and
Utilities Branch will contact the Owner to negotiate a land rights
agreement.
6. No member of or delegate to Congress or Resident Commissioner shall
be admitted to any share or part of this agreement or any benefit to
arise therefrom. Nothing, however, herein contained shall be construed
to extend to any incorporated company, if the agreement be for the
general benefit of such corporation or company.
