The Board of Adjustment meeting was called to order by David Hamilton, Chairman at
12: 00 p. m.
The following members were present: David Hamilton, Brady Fisher, A.W. Clem,
Louise Hagood, Chris Fitzgerald, and Benny Plata.
Also present was Carla Easton, City Engineer; and concerned citizens.
2. Approval of minutes from previous meetings. (May 1, 2018 and June 22, 2018)
Motion was made by Louise Hagood, seconded by David Hamilton to approve minutes for
the May 1, 2018 and June 22, 2018 meeting. Motion carried 5-0.
3. Public hearing to consider of and take action on the petition of Charles Edwards on behalf
of William Harlan, on Lot 5, City Block 252, being located at 1770 E Washington Street.
The petition requested a variance of Section 9-200 (1) of the Zoning Ordinance which
provides as follows:
9-200 (1):
(1) Schedule minimum lot widths- Residential districts.
2F minimum lot width- 60 FT
The applicant is proposing to construct a home on a lot 54.72 foot wide. The applicant is
requesting a 5.28 foot variance in width.
Public hearing was declared open.
Carla Easton, City Engineer, spoke in favor of the petition. Mrs. Easton stated that during
the plat process, it was discovered that the lot did not meet the zoning requirements;
however, a newly constructed home on this lot would improve the neighborhood and
recommended the petition be approved.
No one spoke in opposition.
Public hearing was declared closed.
Motion was made by A.W. Clem, seconded by Benny Plata to approve the 5.28 foot
variance in width. Motion carried 5-0.
4. Public hearing to consider and take action on the petition of Charles Edwards on behalf
of David and Nancy Leeks, on Lot 15, City Block 88, being located at 705 NW Srh Street.
The petition requests three (3) variances as follows:
A. A variance of Section 9-102 (1) of the Zoning Ordinance which provides as
follows:
9-102 (1):
(1) Schedule minimum lot areas- Residential districts in square feet.
2F minimum lot area- 6,000 SF
The applicant is proposing to reconstruct a home at 705 NW 5th Street. This property does
not meet the schedule minimum lot area of 6,000 SF. The applicant is requesting a variance
of 934.6 square feet to allow the construction of a home on a 5,065.4 SF lot.
B. A variance of Section 9-200 (1) of the Zoning Ordinance which provides as
follows:
9-200 (1):
(1) Schedule minimum lot widths- Residential districts.
2F minimum lot width- 60 FT
The applicant is proposing to reconstruct a home on a lot 53.32 foot wide. The applicant is
requesting a 6.68 foot variance in width.
C. A variance of Section 9-301 (1) of the Zoning Ordinance which provides as
follows:
9-301 (1):
(1) Schedule minimum lot depths- Residential districts.
2F minimum lot depth- 100 FT
The applicant is proposing to reconstruct a home on a lot 95 foot deep. The applicant is
requesting a 5 foot variance in depth.
Public hearing was declared open.
A.W. Clem spoke in favor of the petition, stating that the subject property had plenty of
room for a new home and would be an excellent improvement to the street and
recommended the approval of the petition.
No one spoke in opposition.
Public hearing was declared closed.
Motion was made by Louise Hagood, seconded by A.W. Clem to approve the 934.6 square
foot variance, the 6.68 square foot variance, and the 5 foot variance. Motion carried 5-0
once.
5. Public hearing to consider and take action on the petition of Patricia Adams on Lot 19,
Block 2 of Town North Estates, being located at 2910 Ridgeview Rd.
The petition requests a variance of Section 9-502 (2) of the Zoning Ordinance which
provides as follows:
9-502 SPECIAL FRONT YARD REGULATIONS:
2. "Where a building line has been established by plat or ordinance and such line
requires a greater or lesser front yard setback than is prescribed by this ordinance
for the district in which the building line is located, the required front yard shall
comply with the building line so established by such ordinance or plat."
The applicant is proposing to construct a detached carport in the area defined as the front
yard at 2910 Ridgeview Road. The survey plat of the subject property, called Town North
Estates Part 2 Final Plat, provides a 30 foot setback to the building line along Ridgeview
Road. The proposed carport will extend 21 foot into the setback. The applicant is
requesting a variance of 21 foot to construct the carport.
Public hearing was declared open.
Tommy Harris resides at 2850 Ridgeview Rd, and spoke against the petition, as he lives
directly next door to the subject property and doesn't believe a carport would be fitting for
the area.
Bruce McMonigle resides at 2835 Ridgeview Rd, and spoke against the petition. He has
lived at this residence for 40 years and stated that there was a deed restriction on the home
about carports because it could potentially depreciate the value of the home.
Sherry Washington resides at 2845 Ridgeview Rd. and spoke against the petition. She
stated that a carport could potentially be used for storage, and disapproves.
Carla Easton, City Engineer, spoke against the petition as it would not be consistent with
the integrity of the neighborhood and recommends the petition is denied.
Public hearing was closed.
A.W. Clem asked if there was a possibility to approve the carport to be in a different
location. Carla Easton, City Engineer, stated there was not enough room anywhere else on
the lot for a vehicle to fit, so no modification of the variance would be possible.
Louise Hagood stated that Ms. Adams probably knew her car would not fit in the garage
when she purchased the home; therefore the matter is Ms. Adams' responsibility, and
agrees with all recommendations to deny petition.
Motion was made by Benny Plata, and seconded by A.W. Clem to deny the variance of 21
foot to construct the detached carport. Motion carried 5-0.
6. Meeting adjourned at 12:20 p.m.
