MINUTES OF THE REGULAR CITY COUNCIL MEETING
OF THE CITY OF PARIS, TEXAS
August 27, 2018
The City Council of the City of Paris met for a regular session at 5:30 p.m. on Monday,
August 27, 2018, at the City Council Chamber, 107 E. Kaufman, Paris, Texas.

Opening, Agenda
Call meeting to order.
Mayor Clifford called the meeting to order at 5:30 p.m.
2. Invocation.
Finance Director Gene Anderson gave the invocation.
3. Pledge of Allegiance.
Council Member Hughes led the pledge.
4. Citizens' Forum.
Cheri Bedford, Main Street Director — she invited everyone to the Hatch Chile Fest on
Saturday at the Farmers Market. Ms. Bedford also announced the Market Square Affair was
scheduled for September 15 at the Farmers Market and that tickets were still available.
Syble Colson, 819 Lamar Avenue — she spoke about item 14, and expressed her concern
about the zoning being changed. Ms. Colson said the neighborhood was 72 years old and should
be preserved because it was architecturally unique. She asked Council to not change the zoning.
Consent Agenda
Mayor Clifford inquired of Council Members if they wished to pull any items from the
consent agenda for discussion. There being none, a Motion to approve the consent agenda was

made by Mayor Clifford and seconded by Council Member Portugal. Motion carried, 7 ayes — 0
nays.
5. Approve minutes from the meetings on August 13, 2018 and August 20, 2018.
6. Receive reports and/or minutes from the following boards and commissions:

10. Discuss, conduct a public hearing ;and act on RESOLUTION NO. 2018-018: A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AUTHORIZING ' THE APPLICATION FOR THE EDWARD BYRNE MEMORIAL
JUSTICE ASSISTANCE GRANT (JAG) PROGRAM, GMS APPLICATION NUMBER
2018 -H2892 -TX -DJ; AUTHORIZING AN INTERLOCAL AGREEMENT WITH
LAMAR COUNTY; AUTHORIZING THE EXPENDITURE OF FUNDS; ACCEPTING
SAID GRANT AWARD UPON NOTICE THEREOF; AUTHORIZING THE
EXECUTION OF ANY AND ALL DOCUMENTS NECESSARY FOR ACCEPTANCE
AND IMPLEMENTATION OF SAID GRANT UPON NOTICE THEREOF; MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND
PROVIDING AN EFFECTIVE DATE.
Police Chief Hundley said this was the annual grant; it had decreased from last year and
would be split 50/50 with the county. He said the police department planned to use the funds for
video equipment for a bate trailer or a vehicle.

A Motion to approve this item was made by Council Member Pilgrim and seconded by

11. Discuss, conduct a public hearing, and act on ORDINANCE NO. 2018-021: AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, BLOCK
257-B, 0.30 ACRES, BEING LOCATED AT 2531 PINE BLUFF, IN THE CITY OF
PARIS, LAMAR COUNTY, TEXAS, FROM A SINGLE-FAMILY DWELLING
DISTRICT (SF -2) TO A MULTIPLE -FAMILY DWELLING DISTRICT (MF -2);
DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF
THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A
SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
City Manager John Godwin said the owners planned to construct a duplex on the
property, and there were other duplexes in the area. He also said if the zoning was approved, the
owners must seek a variance from the Board of Adjustment due to building setback
requirements. Mr. Godwin said staff recommended approval, as did the Planning and Zoning
Commission.
Mayor Clifford opened the public hearing and asked anyone wishing to speak in support
or opposition of this item, to please come forward. With no one speaking, Mayor Clifford closed
the public hearing.
A Motion to approve this item was made by Mayor Clifford and seconded by Council

12. Discuss, conduct' a public hearing, and act on ORDINANCE NO. 2018=022: AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING ZONING ORDINANCE NO. 1710OF THE CITY OF PARIS, TEXAS,
AS HERETOFORE AMENDED, SO AS TO REZONE LOT 28 AND PT 27, CITY
BLOCK 2, 0.2190 ACRES, IN THE STELLROSE ADDITION, BEING LOCATED AT
741 S.E. 23RD STREET, IN THE CITY OF PARIS, LAMAR COUNTY, TEXAS,
FROM A ONE -FAMILY DWELLING DISTRICT (SF -2) TO A MULTIPLE -FAMILY
DWELLING DISTRICT (MF -1; DIRECTING A CHANGE ACCORDINGLY IN THE
OFFICIAL ZONING MAP OF THE CITY; PROVIDING A REPEALER CLAUSE, A
SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
City Manager John Godwin explained the applicants requested a change in zoning so
they could build a single quadplex. He said there were single family dwellings in the area and
some general retail. Mr. Godwin explained the Future Land Use Plan called for general retail,
and that this area was a transition area so a quadplex could be a good transition. He said staff, as
did the Planning and Zoning Commission recommended approval.

Member Trenado. Motion carried, 7 ayes — 0 nays.
13. Discuss, conduct a public hearing, and act on an Ordinance considering the petition of
Jim Lester for a change in zoning from a One -Family Dwelling (SF2) to Commercial (C),
on City of Paris Block 218, Lot 2, 0.1230 acres being located at 418 S.W. 13'x' Street.
City Manager John Godwin explained that the applicant requested a change from
residential to commercial to bring ongoing vehicle repair activities into compliance with the
city's zoning ordinance. Mr. Godwin further explained that the Future Land Use Plan called for
all of this area to be single family and that staff, as well as the Planning and Zoning
Commission recommended denial of this zoning change.
Council Member Trenado inquired action to be taken for non-compliance. Mr. Godwin
said if the Council denied the zoning, the automotive repair shop would be closed down. Mayor
Clifford said he agreed with city staff on this zoning case.
Mayor Clifford opened the public hearing and asked anyone wishing to speak 'in support
or opposition of,this item, to please come forward. Jim Lester, 418 32nd S.W. spoke in support
of the zoning change, but did say ' he was about ready to retire. With no one else': speaking,
Mayor Clifford closed the public hearing.
A Motion to deny this item was made by Mayor Clifford and seconded by Council
Member Trenado. Motion carried, 7 ayes — 0 nays.
14. Discuss, conduct a public hearing, and act on an, Ordinance considering the petition of
Jimmy Rowland for a change in zoning from a One -Family Dwelling (SF2) to a Multiple -
Family Dwelling (MF1) in the Highland Park Addition, Block 4, Lots 7-A and 8, 0.2470
acres being located at 2015 and 2023 Culbertson Street.
City Manager John Godwin said this case was similar to the previous zoning case, in that
it was brought forward when code enforcement was investigating a code complaint about people
living in the out building. Mr. Godwin explained the current single family house had three
families residing in it, with one family living in the garage which was a violation of the city's
zoning ordinance. Mr. Godwin said staff recommended denial of this zoning change, as did the
Planning and Zoning Commission.

A Motion to deny this item was made by Council Member Portugal and seconded by
Mayor Clifford. Motion carried, 7 ayes — 0 nays.
15. Receive presentation, discuss and act on a -Grand Theater Management Agreement.

Mr. Godwin said the City owned the old Grand Theater, but did not have the expertise or
resources to restore it. He reviewed the main points of the agreement. He explained the Paris
Grand Theater, Inc. was a non-profit organization and that the City had negotiated a management
lease with them to fund raise, restore, operate, and manage the historic theater. Mr. Godwin
introduced Julia Trigg -Crawford, who gave a presentation that included the history of the small
group of people who got together in an effort to preserve the theater of the Grand Theater. She
also gave a history of the Grand Theater and the group's vision of it being used as a multi -use
cultural center. She referenced the theater that was restored in Greenville, Texas, as well as
several others.
Council Member Stone inquired about resources for grants and Ms. Crawford said they
had a great resource to point them in the right direction. Council Member Portugal informed
every one of the film that was being shown about the Grand Theater in the Modern Art Museum
in Ft. Worth.
A Motion to approve the agreement was made by Mayor Clifford and seconded by
Council Member Pilgrim. Motion carried, 7 ayes — 0 nays.
16. Discuss the Paris Regional Medical Center tax abatement agreement and possible
amendments relating to the hospital's south campus, and provide direction to the city
attorney.
EDC Director Michael Paris said Paris Regional was looking at amending the tax
abatement agreement and that CEO Steve Hyde of the hospital was there to answer any
questions.
Mr. Hyde explained that six years into the agreement, the south side campus was no
longer a hospital. He said the agreement talks about both campuses, and they would like to
amend the agreement to delete the south campus. Mr. Hyde said they wanted to unencumber the
building so they could make decisions about the building, as there had been some interest in the
building. He said they had exceeded over 28 million dollars in investments. Mr. Hyde also said
the hospital increased employment over the six years. Council Member Trenado expressed
dissatisfaction over the possibility of having a vacant building. Mayor Clifford said it was agreed
that the hospital would retain sufficient employment to sustain both campuses during the entire
tax abatement, which was ten years. Council Member Hughes asked City Attorney Stephanie
Harris for an opinion. Ms. Harris said that was a policy decision. She said they made the
investment and their employment numbers had not gone down, so that was something City
Council could take into consideration. Council Member Knox said she was not aware that there
was a tax abatement between the hospital and the City, and that she had a problem with an empty
hospital. She said the mayor got a copy of the agreement, but she did not. Council Member
Knox said they did not have anything that reflected the numbers. Ms. Harris said they do have
the reporting forms from TWC on the employment levels. Mayor Clifford said the city attorney
forwarded a summary on employment which reflects the summer of 2013 the hospital had 680
employees and they were now at 769 employees. Mayor Clifford also said the fourth quarter of
2012 reflected the hospital had 701 employees plus 65 plus 1. Mayor Clifford reported that the
first quarter of 2013, after the tax abatement was granted that the hospital immediately dropped

to 680 employees. Mayor Clifford said for January and February 2017, they had no information
at all and they needed the information. Mayor Clifford said he would like to see the employment
information for 2011 and 2012 as well. He said he would like to Council to receive more
information prior to making a decision. Mayor Clifford said it was guaranteed that both
campuses would remain open. Mr. Hyde said the major investment was at the north campus.
Mayor Clifford said the hospital was in violation and the entire agreement was null and void, as
written. Mayor Clifford reiterated the Council should have more information prior to making a
decision.
17. Discuss and act on RESOLUTION NO. 2018-019: A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF PARIS, TEXAS, CALLING A PUBLIC HEARING FOR
SEPTEMBER 4, 2018 ON THE CITY MANAGER'S PROPOSED BUDGET FOR
FISCAL YEAR 2018-2019; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
Mr. Godwin said items 17 and 18 were the resolutions calling the required public
hearings on the budget and tax rate.
A Motion to approve the resolution was made by Mayor Clifford and seconded by
Council Member Portugal. Motion carried, 7 ayes — Qnays.
18. Discuss and act on RESOLUTION NO. 2018-020: A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF PARIS, TEXAS, CALLING TWO PUBLIC HEARINGS
TO RECEIVE PUBLIC COMMENT ON THE CITY'S PROPOSED PROPERTY TAX
RATE FOR FISCAL YEAR 2018-2019; MAKING OTHER FINDINGS NAD
PROVISIONS RELATED OT THE SUBJECT; AND PROVIDING AN EFFECTIVE
DATE.
A Motion to approve the resolution was made by Mayor Clifford and seconded by
Council Members Hughes and Pilgrim. Motion carried, 7 ayes — 0 nays.
19. Discuss and confirm appointment of Del Drake to serve the unexpired term of Sims
Norment on the Civil Service Commission.
Mr. Godwin said Sims Norment was appointed to serve on Planning and Zoning, which
left an unexpired vacancy on the Civil Service Commission, and staff was recommending that
Del Drake be appointed to fill the unexpired term. A Motion to confirm the appointment of Del
Drake was made by Mayor Clifford and seconded by Council Member Trenado. Motion carried,
7 ayes — 0 nays.
20. Consider and approve future events for City Council and/or City Staff pursuant to
Resolution No. 2004-081.
None were referenced.

There being no further business, a Motion to adjourn was made by Mayor Clifford and

2. Conduct the first public hearing on the City's proposal to increase tax revenues from the
preceding tax year and to set the tax rate for 2018.
City Manager John Godwin explained the tax rate would remain the same but because
property values increased, they were required to have a public hearing.
Mayor Clifford opened the public hearing and asking for anyone wishing to speak about
this item, to please come forward. With no one speaking, Mayor Clifford closed the public
hearing.
3. Conduct a public hearing on the City Manager's proposed budget for fiscal year 2018-
2019.
Mr. Godwin said he did not have anything new on this item.

hearing.
4. Discuss and act on a Resolution calling a public hearing on proposed amendments to the

Mayor Clifford said there were no amendments and moved to the next item.
5. Discuss and possibly direct the city attorney to give formal notification to Paris Regional
Medical Center that they are in default of the tax abatement agreement with the City of
Paris.
Mayor Clifford said he put this item on the agenda, because the City was required to give
them sixty days -notice before taking any action, if they chose to do so. Council Member Portugal
said she was in favor of giving them notice, allowing Council time to review everything. It was
a consensus of the City Council for the city attorney to give formal notification to Paris Regional
Medical Center they were in default of the tax abatement agreement.
6. Adjournment.
There being no further business, a Motion to adjourn was made by Council Member
Portugal and was seconded by Mayor Clifford. Motion carried, f7 ayes – 0 nays. The meeting
was adjourned at 5:33 p.m.
