1996-107-RES WHEREAS, CITY COUNCIL DID HERETOFORE IN ORDINANCE NO 96-047 ON SEPTEMBER 9 1996
RESOLUTION NO. 96-107
WHEREAS, the City Council of the City of Paris did, heretofore in Ordinance No.
96-047, on September 9, 1996, approve the advertisement for bids for furnishing plant,
labor, materials and equipment, and performing all work required for the resurfacing of
tennis courts one (I) through six (6) at Culbertson Park, Paris, Texas, which bids were
received until 3:00 o'clock p.m., Tuesday, October 1,1996; and,
WHEREAS, the best bid for such construction was made by TRANS TEXAS
TENNIS, INC., of Houston, Texas, and it should be awarded the bid for such
construction; and,
WHEREAS, the form of contract for such construction project attached hereto as
Exhibit A, should in all things be approved, and the Mayor of the City of Paris should be
authorized to execute the same; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the
bid of TRANS TEXAS TENNIS, INC., for the construction project in the amount of
$13,776.00 is hereby accepted and let conditioned upon said contractor meeting all of the
terms and specifications included in the bid documents; and,
BE IT FURTHER RESOLVED, that the Mayor of the City of Paris, Eric S.
Clifford, be, and he is hereby authorized and directed to execute, on behalf of the City of
Paris, the contract with TRANS TEXAS TENNIS, INC. for the resurfacing of tennis
courts one (I) through six (6) at Culbertson Park, upon the terms and conditions and in the
form shown in Exhibit A, attached hereto.

THAT, the CITY OF PAIRS, Paris, Texas, a municipal corporation, acting by and
through its Mayor, Eric S. Clifford, duly authorized, hereinafter called CITY and TRANS
TEXAS TENNIS, INC. of Houston, Texas, acting by and through its President, Jack
Hawkins, duly authorized, hereinafter called CONTRACTOR, do hereby contract and
agree as follows:
I. That CONTRACTOR agrees to supply all labor and materials necessary for
resurfacing six (6) existing tennis courts, being court numbers one (1) through six (6) at
Culbertson Park, Paris, Texas, in accordance with the specifications on Exhibit A attached
hereto and made a part hereof.
2. That CONTRACTOR agrees to complete the project within 30 calendar days
from the start date which shall be approved by the Parks Director.
3. That the CITY agrees, upon completion of the resurfacing six (6) existing tennis
courts at Culbertson Park, to pay CONTRACTOR the amount submitted in bid document,
said amount being $13,776.00.

LEGAL NOTICE
The City of Paris will receive sealed bids at the Office of City Manager, City of
Paris, P.O. 9037, Paris, Texas 75461-9037, for resurfacing tennis courts one
(1) through six (6) at Culbertson Park, Paris, Texas.
Bids will be received until 3:00 P.M., Tuesday, October 1, 1996 at which time all
bids received will be opened, tabulated, and referred to the City Council for
consideration at the Council meeting to be held Monday, October 14, 1996,
starting at 6:00 P.M.
Information, specifications and bids forms may be obtained at the office of the
City Manager, City Hall, Paris, Texas 75461-9037.
Those submitting bids are notified of city exemption from. otherwise applicable
sales and excise taxes.
The City of Paris reserves the right to reject any or all bids, to waive any
informality in bidding, and to award as may be advantageous to the City.

GENERAL CONDITIONS
1. Submissions: Bids must be submitted on the form provided in the bid
documents and signed by an authorized representative of the bidder. Bids shall
reflect the bidder's turnkey price.
2. Bidder Qualifications: A bidder shall be able to demonstrate technical
ability, financial responsibility, and successful experience in providing like
services in similar environments. The bidder shall be an authorized
representative of the surfacing system provided and shall present evidence of
use of trained applicators.
3. Time Frame: The project shall be completed within thirty (30) calendar
days of the award of contract, with allowance for adverse weather or
temperatures.
4. Brand Specifications: Products are specified herein with brand names
as a guide to the type of product meeting specifications. .A product description,
including specifications, shall be attached with the bid form when the use of
alternate products is proposed.
5. Award of Bids: The City reserves the right to accept or reject any or all
bids. In addition to the bid price, the following factors may be considered in the
bid award:
a. Bidder's qualifications
b. Bidder's conformance to conditions and specifications
c. Bidder's capacity to provide warranty and aftercare services
d. Product features and benefits
6. Warranty: The successful bidder shall warrant the surface installed for
one year from the date of completion against fading, peeling, chalking, or
bonding failure. Problems in the new surface caused by cracking or slab
movement shall not be covered.
