Item No. 11 TO: Mayor & City Council FROM: John Godwin, City Manager SUBJECT: EASEMENT CONNECTOR DATE: November 5, 2018 BACKGROUND: The city owns a strip of vacant property along the south side of MLK Drive, north of Santa Fe. In addition, the city owns a small empty strip that connects MLK and 3rd Street NE. This 0.24 acre strip (approximately 60' x 180') must have been acquired at one time for a driveway, or more likely a road connector that was never built. STATUS OF ISSUE: A new business that is proposed to open on unused property owned by HWH, generally bounded by 3rd, 1St NE, and East Hickory, seeks to use this small connector strip for more efficient egress and ingress to and from MLK. If approved, the city will convey an easement for use of this strip for vehicular traffic. The city will retain ownership and a right to use the property for any and all purposes required, provided said use does not interfere with the purpose for which the easement was granted. We will require the requestor to supply metes and bounds to be inserted into a formal easement document to be filed with the county, and also to pay an easement fee. BUDGET: The contiguous owner will pay $1,200 to the city. RECOMMENDATION: Authorize the city manager to execute the ingress/egress easement.
