Item No. 11 <br />TO: Mayor & City Council <br />FROM: John Godwin, City Manager <br />SUBJECT: EASEMENT CONNECTOR <br />DATE: November 5, 2018 <br />BACKGROUND: The city owns a strip of vacant property along the south side of MLK Drive, <br />north of Santa Fe. In addition, the city owns a small empty strip that connects MLK and 3rd Street <br />NE. This 0.24 acre strip (approximately 60' x 180') must have been acquired at one time for a <br />driveway, or more likely a road connector that was never built. <br />STATUS OF ISSUE: A new business that is proposed to open on unused property owned by <br />HWH, generally bounded by 3rd, 1St NE, and East Hickory, seeks to use this small connector strip <br />for more efficient egress and ingress to and from MLK. If approved, the city will convey an <br />easement for use of this strip for vehicular traffic. The city will retain ownership and a right to use <br />the property for any and all purposes required, provided said use does not interfere with the purpose <br />for which the easement was granted. We will require the requestor to supply metes and bounds to <br />be inserted into a formal easement document to be filed with the county, and also to pay an <br />easement fee. <br />BUDGET: The contiguous owner will pay $1,200 to the city. <br />RECOMMENDATION: Authorize the city manager to execute the ingress/egress easement. <br />
