BACKGROUND: City Ordinance 26-1 sets the composition of the department as to number of
officers in each classification of Officer, Sergeant, Lieutenant, Captain, Assistant Chief and
Chief.
STATUS OF ISSUE: Part of the strategic plan of the department includes a reduction of the
total number of supervisors and their assignments. With the recent and expected retirements of
three Lieutenants, John Berry, Raymond Moss and James Mazy, the department will offer
promotional opportunities for two of these positions. I am asking that the third open lieutenant
position be changed to that of a police officer. I request that the number of Lieutenants in Section
26-1 be changed from 7 to 6 and the number of officers be increased from 40 to 41. There is no
change to the total number of officer positions.
BUDGET: There is a minimum savings of $6,883.00 in the department's payroll line item.
RECOMMENDATION: Authorize the amending of the ordinance to reflect these changes.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING SECTION 26-1, "COMPOSITION OF DEPARTMENT," AND
SECTION 26-9, "SENIORITY PAY," OF CHAPTER 26, "POLICE," OF THE
CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; MAKING OTHER
FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A
REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, the employment of police officers in the City of Paris is governed by
Chapter 143 of the Local Government Code which authorizes and governs dealing with Civil
Service employment; and,
WHEREAS, Section 143.021 of said Chapter 143 of the Local Government Code
states that that the Civil Service Commission shall provide for the classification of all fire
fighters and police officers and the municipal governing body shall establish the
classifications of police officers by ordinance; and,
WHEREAS, the City of Paris has established the classifications of police officers in
Chapter 26 of the Code of Ordinances; and,
WHEREAS, with the retirement of three (3) Lieutenants, it is in the best interest of
the efficient operations and use of resources of the Paris Police Department (the
"Department") to reduce the total number of Lieutenant positions from seven (7) to six (6)
and to increase the total number of Police Officer positions from forty (40) to forty-one
(41), which is consistent with the strategic plan of the Department; and
WHEREAS, Section 143.041 of the Local Government Code further authorizes the
governing body of a municipality to provide additional compensation to police officers
based on longevity and/or seniority; and
WHEREAS, the Department continues to face challenges in officer recruitment and
retention; and
WHEREAS, the City Council has approved seniority pay to allow an officer to attain
the maximum seniority pay at eleven (11) years' service rather than at twenty (20) years'
service as is currently provided for by Sec. 26-9 of the Code of Ordinances in order to assist
the Department's efforts to recruit and retain officers; and
WHEREAS, the City Council of the City of Paris approved a budget for FY 2018-2019
which included seniority pay for police officers employed by the City of Paris, Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby
in all things approved.
Section 2. That Section 26-1, "Composition of department," of Chapter 26,
"Police," of the Code of Ordinances of the City of Paris, Texas, is hereby amended to read as
follows:
"Sec. 26-1. Composition of department.
The police department of the city shall be composed of the chief of police and
fifty-six (56) members classified as follows:
(1) One (1) Assistant Police Chief
(2) Three (3) police captains.
(3) Six (6) police lieutenants.
(4) Five (5) police sergeants
(5) Forty-one (41) police officers."
Section 3. That Section 26-9(1) of Section 26-9, "Seniority Pay," of Chapter 26,
"Police," of the Code of Ordinances of the City of Paris, Texas, is hereby amended to read as
follows:
"(1) For all non -ranking officers, seniority pay shall be added to each officer's
base pay, based on the following schedule of years in service to the city police
department:
"a. Officers with two (2) years of service and less than four (4) years of
service — Thirty-five dollars ($35.00) per pay period.
"b. Officers with four (4) years or more of service and less than six (6)
years of service — Sixty-eight dollars and sixty-one 61 cents
($68.61) per pay period.
"c. Officers with five (6) years or more of service and less than eight (8)
years of service — Eighty-seven and eighty-five cents ($87.85) per
pay period.
"d. Officers with eight (8) years or more of service and less than ten (10)
years of service — One hundred forty-five dollars and fifty-four
cents ($145.54) per pay period.
"e. Officers with ten (10) years or more of service and less than eleven
(11) years of service — One hundred eighty-six dollars and
sixty-eight cents ($186.68) per pay period.
"f. Officers with eleven years (11) or more of service — Two hundred
twenty-five dollars ($225.00) per pay period."
Section 4. That all provisions of the ordinances of the City of Paris, Texas in
conflict with the provisions of this ordinance are hereby repealed, and all other provisions
of the ordinances of the City of Paris not in conflict with the provisions of this ordinance
shall remain in full force and effect.
Section 5. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 6. That it is the intention of the City Council of the City of Paris that this
ordinance and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 7. Section 3 of this ordinance shall become effective January 1, 2019.
All other sections shall become effective immediately upon passage.
