18 - Ordinance Repealing Section 7-2 Decorative Canvas Awnings in the Central Area DistrictItem No. 18 "I, ffiff1m, I r, , M, TO: Mayor & City Council FROM: John Godwin, City Manager SUBJECT: CANVAS AWNING ORDINANCE DATE: November 30, 2018 BACKGROUND: Section 7-2, "Decorative canvas awnings in the Central Area District," of Chapter 7, "Buildings and Building Regulations," dating from 1970, is an old, outdated ordinance that provides for a Committee of Architectural Preservation of the Central Business District of the City to review and approve or disapprove any decorative canvas awnings proposed in downtown. STATUS OF ISSUE: However, the Historic Preservation Commission (HPC) was created in 2000-01 and assumed that review role, but the old ordinance that created the 1970 committee was never rescinded. The latter committee does not exist, nor has it for very many years, and at this time, the review of awnings is completed either in-house or by the HPC, depending on the circumstance. This is a only an administrative cleanup issue, but we need to officially repeal the old ordinance for clarity and consistency. BUDGET: NA RECOMMENDATION: Approve attached ordinance. Draft ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING THE CITY OF PARIS CODE OF ORDINANCES TO REPEAL SECTION 7-2, "DECORATIVE CANVAS AWNINGS IN THE CENTRAL AREA DISTRICT;" MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, in 2002, the City Council of the City of Paris adopted Ordinance 2002-033, a historic preservation ordinance, vesting certain powers and duties in the Historic Preservation Commission relating to renovations and exterior appearance of buildings in historic overlay districts including buildings in the Central Area zoning district; and WHEREAS, Section 7-2, "Decorative canvas awnings in the Central Area District," of the Code of Ordinance predates the historic preservation ordinance and was made obsolete by said historic preservation ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That Section 7-2, "Decorative canvas awnings in the Central Area District," of Chapter 7, "Buildings and Building Regulations," is hereby repealed in its entirety. Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section S. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That this ordinance shall become effective from and after its passage. PASSED AND ADOPTED on this 10th day of December, 2018. Steven J.
