12/03/2018 MinutesMINUTES PLANNING AND ZONING COMMISSION CITY COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY DECEMBER 3 2018 5:30 O'CLOCK P.M. The meeting of the Planning and Zoning Commission was called to order at 5: 30 p.m. by Keith Flowers, Chairman. The following members were present: John Lee, Chad Lindsey, Rick Hundley, Keith Flowers, James O'Bryan and Sims Norment. Also present were John Godwin, City Manager; Carla Easton, City Engineer; Clyde Crews, Fire Marshal; Steve Clifford, Mayor/City Council Liaison; Billy Trenado, City Council Liaison; Triniti Frazier, Community Development Coordinator and concerned citizens. Absent member(s): Mihir Pankaj. 2. Approval of minutes from previous meeting. (November 5, 2018) Motion was made by Sims Norment, seconded by John Lee to approve minutes for the November 5, 2018 meeting. Motion carried 6-0. 3. Public hearing to consider and take action regarding the petition of George Fisher for a change in zoningfrom an Agricultural District (A) to a General Retail District (GR), in the B.D. T. Subdivision, Block A, Lot 2, being located behind 3850 Lamar Ave. John Godwin advised this is an item we discussed last month where we recommended denial of the request for Commercial because we believed that General Retail was more appropriate and is also what is on the Comprehensive Plan. Staff recommends approval of the item for a change in zoning from Agricultural to General Retail. Public hearing declared open. Vic Ressler, 4020 Holbrook, states he is representing the seller of the subject property and is in favor of the petition. Ressler states he lives in the neighborhood and doesn't want to see anything that would make the property values go down. This property is currently under contract with the owners of the retail shopping center located at 3850 Lamar Ave. He states the only access to the property is through a 30 ft. easement. The buyer has no use for the property other than he doesn't want anyone to have ingress/egress access across his property and creating more of a traffic problem there than it currently has. Ressler asks that the board approves the petition. Patty Metzcher, 340 39th SE Street, states she is against the petition due to the fact they are already covered with retail and commercial businesses in this area. There is lots of traffic and noise from Town Center to 42nd Street. Metzcher states she is concerned of the property values going down if something is built on this property. Any dirt work will cause flooding problems. They have put a lot of time and money into making their homes beautiful and don't want anything to change that. Ruth Patterson, 320 SE 39th Street, her backyard looks into this empty field and states she would not have purchased her home if she knew retail was going to be there. The traffic would be a burden and the property values would go down. Patterson asks the board to deny this petition. Lynn English, 3905 Oleander Street, states this property backs up to the corner of his property. He states there is currently so much noise from the dumpsters, traffic and late night activity. Stating late at night you can hear people congregating around PETCO and drag racing. He doesn't want anything to add to that and is against this petition. Public hearing was declared closed. Commissioner Lindsey asked Ressler for clarity as to what the buyer's intentions are with this property. Ressler states the buyers have no interest to build anything on the property. They merely want to keep people from back there and keep the traffic down. Motion was made by Keith Flowers, seconded by Chad Lindsey to approve the zoning change. Motion carried 6-0. 4. Public hearing to consider and take action regarding the petition ofKacy Smyers on behalf of Linda McCarrell for a change in zoning from an Agricultural District (A) to a Commercial District (C), in the A208 E Crow Survey, Tract 60, being located at 4115 Pine Mill Rd. Godwin states Agricultural has historically been used as a holding district in Paris, in many cases awaiting an actual use before final zoning is approved. This is already part of an existing business area, and this specific parcel is adjacent to a Commercial zoned lot. We concur with this request and recognize this property should be rezoned from Agriculture to Commercial to bring this new business into compliance and recommends approval of the zoning change. Public hearing declared open. Linda McCarrell, owner of subject property, states she purchased this property prior to it being annexed into the City of Paris limits. McCarrell asked the board to approve this petition for her business. Public hearing declared closed. Motion was made by Sims Norment, seconded by Rick Hundley to approve the zoning change from Agricultural to Commercial. Motion carried 6-0. 5. Consideration of and action on the Preliminary Plat of Lot 1, BlockA of the House Aikin Addition CB 294, being located at 3145 E Houston St. Carla Easton states the owner proposes to subdivide the lot into two residential lots and has submitted a preliminary and final plat of the property. Easton states water and sewer services are available along E Houston Street. It appears the preliminary and final plats comply with the City of Paris subdivision regulations and zoning ordinance. Easton recommends approval. Motion was made by Keith Flowers. Seconded by John Lee to approve the Preliminary Plat. Motion carried 6-0. 6. Consideration ofand action on the Final Plat of Lot 1, BlockA of the House Aikin Addition CB 294, being located at 3145 E Houston St. Easton states same comments as previous item and recommends approval. Motion was made by Keith Flowers. Seconded by John Lee to approve the Final Plat. Motion carried 6-0. 7. Consideration of and action on the Preliminary Plat of Lots 1, 2, 3, Block A, American Spiral Weld CB 355 Addition, being located in the 2600 Block of Park St. Easton states The Paris Economic Corporation owns 144.78 acres along the NW Loop 286 and in the Industrial Park along Park Street. In preparation of the American SpiralWeld steel pipe manufacturing development, the PEDC has prepared a preliminary plat of the property in order to layout the proposed lots for phased development, called Lots 1, 2 and 3, Block A of American SpirilWeld Addition CB 355, ultimately to be conveyed to the developer in accordance with the master development agreement. The property is currently zoned Heavy Industrial District. The PEDC has submitted a preliminary plat of the property, and a site plan of the overall development of the steel mill plant. Water and sewer utilities exist in the project area, but due to site development, approximately 1,500 feet of water line will be relocated at the developer's cost to accommodate the new plant. The preliminary plat identifies both the existing easements to be abandoned, and the proposed easements accommodating the relocation. It appears that the preliminary plat complies with the City of Paris subdivision regulations, subject to the following revisions: 1. Provide a drainage easement for the detention pond. 2. Designate the fire lane / access easement around the proposed building. 3. Provide a finished floor elevation for all proposed buildings. 4. Coordinate and define an easement to Atmos Gas for their existing high pressure gas main onsite, eliminating the blanket easement. 5. Coordinate and define an easement to Oncor Electric (as needed) for their existing, undefined easement to Texas Power & Light. Motion was made by Keith Flowers and seconded by John Lee to approve the Preliminary Plat with the City Engineer recommended revisions. Motion carried 6-0. 8. Discussion regarding the uses in General Retail zoning. Godwin states from time to time we have discussed the need to review all of our zoning districts to help make sure allowable uses within our zoning ordinance still make the most sense for our community and its orderly growth. We have especially run into the uses in General Retail and Commercial and their significant overlap. In response to Commissioner Lindsey's request, as well as past discussions, we have included a list of allowable uses in General Retail, as well as a list of those in Commercial for comparison. Chad Lindsey states the reason he wanted to bring this forward is because we seem to keep running into situations where we have neighborhoods coming up against retail. When it comes to someone asking can we protect them from the back of a shopping center he wants to see if the City can have more authority of putting a buffer zone requirement in there. Godwin states we have a little bit in our ordinance and we can bring something back over the next few months. James O'Bryan states he would like more time to review some of the schedules to figure out why some of these are laid out the way that they are. Godwin states these two lists need to be more distinct to define the margins and he will add it to his list of things to bring back before the board. 9. Discussion regarding Accessory Residential Dwelling Units. Godwin reviewed the draft accessory dwelling ordinance with the board and O'Bryan provided feedback regarding percentage of land use, building to building ratio and expressed not allowing covered parking or a separate driveway/entrance for the accessory dwelling units. Godwin states the plan is to bring this back for the January 7th meeting for recommendation for an ordinance amendment. 10. Adjournment.
