05 - City Council MinutesItem No. 5 MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF PARIS, TEXAS January 14, 2019 The City Council of the City of Paris met for a regular session at 5:30 p.m. on Monday, January 14, 2019, at the City Council Chamber, 107 E. Kaufinan, Paris, Texas. Present: Mayor: Steve Clifford Council Members: Derrick Hughes; Renae Stone; Billy Trenado; Linda Knox; Paula Portugal; and Clayton Pilgrim City Staff: John Godwin, City Manager; Stephanie Harris, City Attorney; Janice Ellis, City Clerk; Gene Anderson, Finance Director; Bob Hundley, Police Chief, Thomas McMonigle - Assistant Fire Chief, Carla Easton, City Engineer; Doug 'Harris, Utilities Director; Kent Klinkerman, EMS Director; Jerry McDaniel, Public Works Director; and Clyde Crews; Fire Marshal Opening Agenda Call meeting to order. Mayor Clifford called the meeting to order at 5:30 p.m. 2. Invocation. Finance Director Gene Anderson gave the invocation. 3. Pledge of Allegiance. Council Member Hughes led the pledge. 4. Citizens' Forum. No one spoke. Consent A enda Mayor Clifford inquired of Council Members if they wished to pull any items from the consent agenda for discussion. There being none, a Motion to approve the consent agenda was made by Mayor Clifford, and seconded by Council Member Portugal. Motion carried, 6 ayes — 0 nays. 5. Approve minutes from the meeting on January 14, 2019. Regular Council Meeting January 14, 2019 Page 2 6. Receive reports and/or minutes from the following boards and commissions: (a) Paris Visitors & Convention Council (11-19-2018) (b) Housing Authority (9-18-2018) (C) Paris -Lamar County Board of Health (9-17-2018) (d) Paris Economic Development Corporation (11-20-2018) (e) Airport Advisory Board (11-15-2018) (f) Planning & Zoning Commission (12-3-2018) (g) Historic Preservation Commission (11-14-2018) (h) Main Street Advisory Board (1-9-2018 amended & 11-13-2018) (i) Board of Adjustment (9-4-2018) 7. Receive the November 2018 financial report. 8. Re -approve the City Investment Policy. } 9. Award the bid to Liberty National Bank to serve as the city's depository beginning March 1, 2019 and ending February 28, 2021. 10 Approve final payment in the amount:of $40,78.9.50, close out the contract with Richard Drake Construction on the 2017 Street Bond Improvements to Collegiate, 33rd.S.E. and Graham Streets, and accept improvements. 11. Approve final payment in the amount of $23,678.85, and close out the contract with Archer Construction & Design on the N.W. EMS Station construction project, and accept improvements. Council Member Pilgrim arrived at 5:32 p.m. Regular Agenda 12. Receive a presentation from the Love Civic Center Board regarding maintenance and needed improvements at the Love Civic Center, discuss, and consider increasing the HOT rate by two cents to help fund capital maintenance and replacements. Lamar County Chamber President Paul Allen gave a presentation to the City Council detailing the age of the civic center, as well as needed capital improvements and repairs. Mr. Allen referenced the long-range improvement and capital plan, and said the board was asking for a two -cent rate increase in order to fund approximately $1.5 million in improvements. He explained that their financial advisor ran a debt schedule on $1.5 million in debt with a 10 -year payback. Mr. Allen said the annual debt payment would around $185,000 and if the debt was issued, the City would control those proceeds and only pass them on to the LCC as a Regular Council Meeting January 14, 2019 Page 3 reimbursement of work completed and invoiced. He also said certificates of obligation would be structured so that only proceeds from the HOT tax would pay the debt. Council Member Portugal, Council Member Knox and Mayor Clifford expressed support for this increase. Mayor Clifford confirmed with Mr. Godwin that the City would retain control over the funds and that the LCC would have to come to City Council for approval of capital improvements and expenses. With the exception of Council Member Hughes, the City Council expressed they wanted City Staff move forward with necessary paperwork to increase the Hotel Motel Tax from seven cents to nine cents, and prepare documents for issuance of a ten-year certificate of obligation. 13. Discuss and act on ORDINANCE NO. 2019-001: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING CHAPTER 5, "ANIMALS AND FOWL," OF THE CODE OF ORDINANCE OF THE CITY OF PARIS, TEXAS RELATING TO THE SETTING OF FEES CHARGED BY THE ANIMAL SHELTER; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SAVINGS ,CLAUSE; AND DECLARING AN EFFECTIVE DATE. Chief Hundley said the current ordinance required any'animal control fee change be considered by City Council. He explained the cost increases on vaccinations, storage of animals or other impacts to the fees were immediate, and staff was asking, that the Chief of Police or his designee be given the ability to set fees as needed. Chief Hundley said the fee schedule would be published on the city web -site. A Motion to approve this item was made by Mayor Clifford and seconded by Council Members Knox and Portugal. Motion carried, 7 ayes — 0 nays. 14. Discuss and act on ORDINANCE NO. 2019-002: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ISSUING A LICENSE TO TRANSPORTATION PROVIDERS, LLC, D/B/A CITY CAB COMPANY, TO OPERATE A TAXICAB BUSINESS ON THE PUBLIC STREETS OF THE CITY OF PARIS, TEXAS; FINDING A PUBLIC NECESSITY AND CONVENIENCE FOR ISSUANCE OF SAID LICENSE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. City Manager John Godwin said items 14 and 15 were the annual taxi cab company license renewals. A Motion to approve this item was made by Council Member Hughes and seconded by Mayor Clifford. Motion carried, 7 ayes — 0 nays. 15. Discuss and act on ORDINANCE NO. 2019-003: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ISSUING A LICENSE TO RANEY DAY ENTERPRISES, D/B/A YELLOW CAB COMPANY, TO OPERATE A Regular Council Meeting January 14, 2019 Page 4 TAXICAB BUSINESS ON THE PUBLIC STREETS OF THE CITY OF PARIS, TEXAS; FINDING A PUBLIC NECESSITY AND CONVENIENCE FOR ISSUANCE OF SAID LICENSE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. A Motion to approve this item was made by Council Member Hughes and seconded by Council Member Pilgrim. Motion carried, 7 ayes — 0 nays. 16. Receive presentation and discuss the Downtown Plan. Mr. Godwin referenced the plan to redevelop downtown presented last spring, and the public input sessions which included the Toole Design Group. Mr. Godwin said the City had begun developing a plan to complete most of the planned changes to downtown in a ten-year span. Mr. Godwin reviewed the twenty-three projects/tasks he said the City hoped to at least begin in 2019. 17.1Convene into Executive Session pursuant to thei following statutes: 6 A. Section 551.072 of the Texas Government Code, to deliberate the purchase, exchange, lease, or value of real property; and B. Section 551.071 of Texas Government Code, Consultation with Attorney, ito receive legal advice from the City Attorney about (1) pending or contemplated litigation and/or (2) on 'matters in which the duty of an attorney to her client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflict with this chapter, regarding 260S. Main Street (Belford Apartments). I Mayor Clifford convened City Council into executive session at 5:56 p.m. 18. Reconvene into Open Section and possibly take action on those matters discussed in Executive Session. Mayor Clifford reconvened City Council into open session at 6:19 p.m. and said they consulted with the city attorney. A Motion to authorize the city attorney to execute on the city's judgment on 260 S. Main and conduct a Sheriff's Sale on the property, with a minimum bid of $50,000 was made by Mayor Clifford, and seconded by Council Member Hughes. Motion carried, 7 ayes — 0 nays. 19. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. None were referenced.
