PLANNING AND ZONING COMMISSION

The meeting of the Planning and Zoning Commission was called to order at 5:30p. m. by Keith
Flowers, Chairman.
The following members were present: John Lee, Chad Lindsey, Rick Hundley, Mihir
Pankaj, Keith Flowers, James O'Bryan and Sims Norment.
Also present were John Godwin, City Manager; Carla Easton, City Engineer; Steve
Clifford, Mayor/City Council Liaison; Billy Trenado, City Council Liaison; Triniti Frazier,
Community Development Coordinator and concerned citizens.
2. Approval of minutes from previous meeting. (December 3, 2018)
Motion was made by Sims Norment, seconded by Mihir Pankaj to approve minutes for the
December 3, 2018 meeting. Motion carried 7-0.
3. Public hearing to consider and take action regarding the petition of Estela Ortega for a
change in zoning from a One -Family Dwelling District (SF -2) to a General Retail
District (GR), in the City of Paris, Block 201, Lot 14, being located at 2024 Bonham
Street.
John Godwin states that Estela Ortega has requested a zoning change from a Single -Family
Dwelling District (SF -2) to General Retail District (GR) for the purpose of establishing a
restaurant use at this currently vacant, 0.235 acre site. The applicant anticipates operating
a food truck on the site initially, then subsequently constructing and operating a traditional
brick -and -mortar restaurant. The owner also owns the vacant lot immediately north of the
subject property. Godwin advise despite the current residential zoning, there are a number
of existing non-residential uses in close proximity, including other food service
establishments, an empty bank building, a fire station and several retail uses. Bonham
Street has significant traffic counts, so noise and additional traffic should not be issues.
The future land use plan calls for this lot to eventually become General Retail so the request
is consistent with the city's recently updated plan. The lot which faces Bonham Street
should be able to handle this use adequately and city recommends approval of the zoning
change from SF -2 Residential to General Retail.
Public hearing declared open.
No one spoke in favor nor against.

Commissioner Hundley asked Godwin if parking is going to be a problem. Godwin advised
that would be addressed with the site plan.
Motion was made by Sims Norment, seconded by John Lee to approve the zoning change from
One -Family Dwelling District (SF -2) to a General Retail District (GR). Motion carried 7-0.
4. Public hearing to consider and take action regarding the petition of Sharon Houchins for
a change in zoning fi°om a Commercial District (C) to a Commercial District (C) with a
Specific Use Permit (SUP) for a Self -Service Storage Facility, in the City of Paris, Block
170-C, Lot 14-A, being located at 2455 S. Church Street.
Godwin states that Sharon Houchins is requesting a change in zoning from a Commercial
District to a Commercial District with a Special Use Permit (SUP) for Self -Service Storage.
Ms. Houchins currently operates a carwash on this 3.85 acre lot which she plans to close
and convert into a storage facility. She already has storage units on the back (east side) of
her property. Property to the east is zoned and used as residential. Other properties are
zoned Light Industrial and Commercial. The Future Land Use Plan calls for all of this area
to remain Commercial. Adding an SUP to an existing Commercial zoning should neither
increase nor decrease the intensity of use or traffic counts. Performance standards (light,
noise, dust, etc.) should not be an issue due to the distance to the nearest residential use.
City recommends approval of the zoning change from Commercial to Commercial with an
SUP.

Ramona Hill spoke on behalf of her mother, property owner at 4225 Old Clarksville Rd. She
asked if the applicant is wanting to build behind the property. Godwin advise the applicant is
wanting to convert existing carwash into a storage

Motion was made by John Lee, seconded by Rick Hundley to approve the zoning change from
a Commercial District (C) to a Commercial District (C) with a Specific Use Permit (SUP) for
a Self -Service Storage Facility. Motion carried 7-0.
5. Public hearing to consider and take action regarding the petition of the City of Paris, Texas
to update Zoning Ordinance No. 1710 of the City of Paris, Texas, specifically modifying
regulations for Accessory Residential Dwelling Units.
Godwin advised this has been on the agenda for discussion previously regarding Section 13 of
the zoning ordinance regulating accessory buildings within the city. Since the December
meeting, based on commission input Godwin advised he restricted placement of a separate
driveway and limited the size of the accessory to no more than 35% of the size of the
primary dwelling. City recommends approval of the attached ordinance to the city council.
Flowers states he only has a problem with where it says no covered parking allowed.
Godwin advised the reason for it is that you don't want it to be like a real house and that
would be no separate water meter, sewer, driveway or car port. The accessory building
would be dependent on the main structure. O'Bryan states the language needs to be
changed so the main structure and accessory dwelling unit can be built concurrently. Lee
states a lot of the verbiage here are solutions for problems that he hasn't really become
aware of. He is not comfortable that we will have it that well done when we really don't
know what the magnitude of the bulk of the issues will be. He is open for more discussion.
Godwin advised he doesn't want to wait until the next problem arises before this issue is
addressed.

Motion was made by Mihir Pankaj. Seconded by Chad Lindsey to approve the adoption of
ordinance Section 13. Accessory Building Regulations sub -section 13.102 Regulations for
Accessory Residential Dwelling Units with noted revisions to item H.1. by changing the
language to concurrent construction of both a primary and accessory dwelling unit, as well as
change the language on item J to include (1) covered parking space per resident and eliminating
item K. Motion carried 7-1 with John Lee in opposition.
6. Consideration of and action on the Preliminary Plat of Lots 1 & 2, Block A of the
Killingsworth Addition, being located at 4300 Bonham Street.
Carla Easton states that Max and Jamie Killingsworth own 50.185 acres located at 4300
Bonham Street. They propose to subdivide the property into 2 lots in order to build a single
family home on each lot. The 50.185 acre property is a combination of 2 larger tracts of
land. In order to build a home in the desired location, the property must be platted to
dissolve the existing property lines and establish the 2 proposed lots. The property is
currently zoned Agricultural District (A). The owners have submitted a preliminary plat of
the property, creating Lots 1 and 2, Block A, of the Killingsworth Addition. Water service
is available along Bonham Street and Tigertown Road. Sewer infrastructure is not available
to serve the lots; however, the lot size is adequate to accommodate an alternative sewer
system. It appears that the plat complies with the City of Paris subdivision regulations,
subject to the following revisions
1. Show all proposed structures
2. Provide the minimum finished floor elevation for all structures
City Engineer recommends approval of the preliminary plat with noted revisions.
Motion was made by Keith Flowers. Seconded by John Lee to approve the Preliminary Plat
with noted revisions. Motion carried 7-0.

Motion made by Norment Sims and seconded by Mihir Pankaj to adjourn.
