02/25/2019MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF PARIS, TEXAS February 25, 2019 The City Council of the City of Paris met for a regular session at 5:30 p.m. on Monday, February 25, 2019, at the City Council Chamber, 107 E. Kaufinan, Paris, Texas. Present: Mayor: Steve Clifford Council Members: Derrick Hughes; Renae Stone; Billy Trenado; Linda Knox; Paula Portugal; and Clayton Pilgrim City Staff John Godwin, City Manager; Stephanie Harris, City Attorney; Janice Ellis, City Clerk; Gene Anderson, Finance Director; Bob Hundley, Police Chief; Thomas McMonigle, Assistant Fire Chief; Carla Easton, City Engineer; Priscilla McAnally, Library Director; Kent Klinkerman, EMS Director; Doug Harris, Utilities Director; and Clyde Crews; Fire Marshal Opening, Agenda Call meeting to order. Mayor Clifford called the meeting to order at 5:30 p.m. 2. Invocation. Finance Director Gene Anderson gave the invocation. 3. Pledge of Allegiance. Council Member Hughes led the pledge. 4. Citizens' Forum. Carolyn Williams, 1205 W. Center Street — she said the city wanted to change the address of her duplex and she had that same address for twenty-five years. Ms. Williams said there was ongoing work on her street for the past three months, and the street signs and stops signs were removed and never replaced. She also said cones were placed on 11th N.W. and had been there for three months. Consent Agenda Mayor Clifford inquired of Council Members if they wished to pull any items from the consent agenda for discussion. There being none, a Motion to approve the consent agenda was Regular Council Meeting February 25, 2019 Page 2 made by Mayor Clifford, and seconded by Council Member Portugal. Motion carried, 7 ayes — 0 nays. 5. Approve minutes from the meeting on February 11, 2019. 6. Receive reports and/or minutes from the following boards and commissions: a. Paris -Lamar County Board of Health (11-19-2018) b. Main Street Advisory Board (1-8-2019) c. Historic Preservation Commission (1-9-2019) d. Building & Standards Commission (1-28-2019) e. Paris Economic Development Corporation (1-15-2019) f. Paris Visitors & Convention Council (1-28-2019) 7. Receive the January monthly financial report. 8. Receive January drainage report. 9. Receive demolition and code enforcement activity reports. 10. Approve RESOLUTION NO. 2019-009: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING A JOINT ELECTION AGREEMENT BETWEEN THE CITY OF PARIS AND NORTH LAMAR INDEPENDENT SCHOOL DISTRICT FOR THE MAY 4, 2019 ELECTION DATE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. 11. Accept bids and award contracts for the purchase of roadway materials to the lowest responsible bidder(s) for the twelve-month period beginning April 1, 2019. 12. Accept the bid and award the contract for the replacement of concrete curbs and gutters, driveway approaches, and reinforced concrete sidewalks to the lowest responsible bidder(s) for the twelve-month period beginning April 1, 2019. 13. Award the bid to Prime Solution, Inc. in the amount of $250,000.00 for the wastewater treatment plant rotary sludge press. 14. Approve the final payment in the amount of $45,656.93, and close out the contract with Williams Equipment Services to construct the Paradise Estate Sewer and S.E. Outfall Main Project, and accept improvements. 15. Approve RESOLUTION NO. 2019-010: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS APPROVING THE SUBMISSION OF A NIBRS CONVERSION GRANT FOR CONVERSION OF PARIS POLICE DEPARTMENT'S RECORDS MANAGEMENT SYSTEM (RMS) FROM UNIFORM CRIME REPORTING SYSTEM TO NATIONAL INCIDENT BASED REPORTING SYSTEM Regular Council Meeting February 25, 2019 Page 3 WHICH BECOMES MANDATORY FOR ALL LAW ENFORCEMENT AGENCIES BY 2021; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. Regular Agenda 16. Confirm appointment of the new fire chief for the City of Paris. City Manager John Godwin introduced Mike Vogel, and explained there had been an extensive selection process, six candidates were interviewed, and two finalists were selected. Mr. Godwin said that he had offered the job to Mike Vogel, who was currently a deputy chief in Arlington, Texas. He also said that if confirmed by the City Council, Mr. Vogel was scheduled to begin work on April 1. A Motion to confirm the appointment was made by Council Member Portugal and seconded by Council Members Knox and Trenado. Motion carried, 7 ayes — 0 nays. 17. Discuss and possibly act on a petition by Church Street residents, to be presented by a delegation led by Randy Hider to restore the green space between the sidewalk and the street. Mayor Clifford said several months ago the City Council heard about a petition that was being circulated in opposition of having green space between the sidewalks and street on the Church Street Project. Mayor Clifford said after hearing from the people, Council voted to remove the grassy strip. He said today Randy Hider wanted to present a new petition to the City Council. Randy Hider presented to City Council a petition of twenty property owners on Church Street who were requesting the grassy strip remain. Mayor Clifford asked those in support to please stand, which resulted in approximately twenty people. Mr. Hider said he initially signed the petition that was circulated but had since learned that the utilities would not be located underground, and that was his primary reason for wanting the grassy strip to remain. He depicted photographs and said the green space was historically appropriate and Church Street was a historic neighborhood. Mayor Clifford said since this was a little unusual because residents were asking Council to change their minds about something that they wanted a few months earlier. Mayor Clifford said he wanted to get input from each Council Member. Council Member Portugal said since so many residents wanted this changed back, she was fine with it. Randy Hider said there were a few other Church Street residents who wanted to speak. Mike Lazar, 913 South Church Street, he said was in favor of this because he was opposed to having commercial sidewalks in a historic neighborhood. Michael King, 801 South Church Street, he said agreed with Randy and expressed concerned about curbs being broken from people parking on sidewalks. Brad Bedford, 624 South Church Street, he said he wanted the grassy strip to remain because he saw it as a safety issue with no buffer between the sidewalk and street. Council Member Pilgrim said he was for what Regular Council Meeting February 25, 2019 Page 4 the people wanted. Council Member Knox expressed appreciation to the residents who came to the meeting and said she was fine with the grassy strip remaining. Council Member Trenado said he wanted what the people wanted. Council Member Stone said she was for what the majority of the people wanted but they could not keep changing their mind because of the project timeline. Council Member Hughes said would want to table this in order to be able to speak to everyone and the city engineer, but progression of the project gave him no time to do so. Mr. Godwin said the original recommendation of staff was to have the green space between the sidewalk and the street, and that was also in the design plan for the project. Council Member Portugal said she had heard from the person who wanted this changed and was told she would not oppose this change if that is what the majority wanted. A Motion to go back to the green strip was made by Council Member Knox and seconded by Council Member Trenado. Motion carried, 6 ayes — 1 nay, with Council Member Hughes casting the dissenting vote. 18. Discuss and act on ORDINANCE NO. 2019-012: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS DECLARING UNOPPOSED CANDIDATES IN CITY COUNCIL DISTRICTS 4, 5, AND 7 FOR THE MAY 4, 2019 GENERAL ELECTION BE ELECTED TO OFFICE; DETERMINING THAT NO GENERAL ELECTION BE HELD IN DISTRICTS 4, 5 AND 7; DIRECTING THAT A COPY OF THIS ORDINANCE BE POSTED AT THE APPROPRIATE POLLING PLACES; DIRECTING THAT A CERTIFICATE OF ELECTION BE ISSUED TO THE UNOPPOSED CANDIDATES; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Godwin said council member candidates for Districts 4, 5 and 7 were unopposed and the deadline had passed to make application to be on the ballot. He said the special election was still scheduled for May 4, 2019. A Motion to approve this item was made by Mayor Clifford and seconded by Council Member Pilgrim. Motion carried, 7 ayes — 0 nays. 19. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. Council Member Trenado reminded everyone of the upcoming Kiwanis Pancake Days. 20. Adjournment. There being no further business, a Motion to adjourn was made by Mayor Clifford and was seconded by Council Member Hughes. Motion carried, 7 ayes — 0 nays.
