04/08/2019MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF PARIS, TEXAS April 8, 2019 The City Council of the City of Paris met for a regular session at 5:30 p.m. on Monday, April 8, 2019, at the City Council Chamber, 107 E. Kaufrnan, Paris, Texas. Present: Mayor: Steve Clifford Council Members: Derrick Hughes; Billy Trenado; Linda Knox; and Paula Portugal City Staff John Godwin, City Manager; Stephanie Harris, City Attorney; Janice Ellis, City Clerk; Gene Anderson, Finance Director; Bob Hundley, Police Chief; Mike Vogel, Fire Chief; Carla Easton, City Engineer; Kent Klinkerman, EMS Director; Doug Harris, Utilities Director; Priscilla McAnally, Library Director; Jerry McDaniel, Public Works Director; and Clyde Crews; Fire Marshal Absent: Council Members: Renae Stone and Clayton Pilgrim O pening Agenda 1. Call meeting to order. Mayor Clifford called the meeting to order at 5:30 p.m. 2. Invocation. Finance Director Gene Anderson gave the invocation. 3. Pledge of Allegiance. Council Member Hughes led the pledge. 4. A. Citizens' Forum. No one spoke. B. Proclamation recognizing Louise Hagood for her outstanding achievements and contributions to the community. Mayor Clifford read the proclamation and presented it to Louise Hagood. Regular Council Meeting April 8, 2019 Page 2 Consent Agenda Mayor Clifford inquired of Council Members if they wished to pull any items from the consent agenda for discussion. There being none, a Motion to approve the consent agenda was made by Council Member Hughes, and seconded by Council Member Portugal. Motion carried, 5 ayes — 0 nays. 5. Approve minutes from the meeting on March 25, 2019. 6. Receive reports and/or minutes from the following boards and commissions: (a) Paris Public Library Advisory Board (2-20-2019) (b) Paris Visitors & Convention Council (2-18-2019) (c) Airport Advisory Board (2-21-2019) 7. Authorize the City Manager to execute a contract for professional engineering services on the Texas Capital Fund Main Street Project, for construction of downtown sidewalk improvements along North Main from Lamar Avenue to Price, and along Houston Street from North Main to 1St N.W. Street. Re ,alar Agenda 8. Discuss and award a bid to RBIS for completion of the Johnson Woods Drainage construction project, in an amount not to exceed $1,600,000. City Engineer Carla Easton said the Johnson Woods Drainage construction project was planned and scheduled as part of the 2013 bond fund for water and sewer improvements. She also said it included replacement of sanitary sewers and channel restoration along the drainage channel running from Lamar Avenue to Clark Lane, located between Johnson Woods Drive and 31St Street S.E. Ms. Easton explained four bids were received, and the low bid was submitted by Atkins Brothers Equipment Co., but the bid was withdrawn due to errors. She said the second lowest bid was submitted by RBIS, and staff recommended awarding the bid to RBIS. A Motion to award the bid to RBIS was made by Council Member Hughes and seconded by Mayor Clifford. Motion carried, 5 ayes — 0 nayes. 9. Discuss and act on ORDINANCE NO. 2019-015: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ADOPTING A REVISED AND CONSOLIDATED WATER CONSERVATION/DROUGHT CONTINGENCY PLAN IN ACCORDANCE WITH THE REQUIREMENTS OF SECTIONS 11.1271 AND 11.1272 OF THE TEXAS WATER CODE AND APPLICABLE RULES OF THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL PRIOR DROUGHT CONTINGENCY AND WATER CONSERVATION PLANS IN CONFLICT HEREWITH; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A Regular Council Meeting April 8, 2019 Page 3 SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Utilities Director Doug Harris said the Texas Commission on Environmental Quality required five year updates to the Drought Contingency/Water Conversation Plans, and the last update was in 2014. A Motion to approve this item was made by Council Member Knox and seconded by Council Member Portugal. Motion carried, 5 ayes — 0 nays. 10. Discuss and provide direction to city attorney regarding sale of Belford Apartment Building (260 S. Main Street) sheriff's sale. City Attorney Stephanie Harris said the City had a judgment against Boomer Trends Magazine, owner of the Belford Apartments building and the property was auctioned at a sheriff's sale on April 2. Ms. Harris also said no bids were received on the property, and she was seeking direction with regard to a possible second sheriff's sale of the property. Following discussion by the City Council, it was a consensus of the City Council that the property be sent to a second sheriff's sale in May, with the exact same stipulations on the property as the April 2 auction. 11. Convene into executive session pursuant to Section 551.074 of the Texas Government Code, (1) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee, as follows: annual evaluation of the city manager. Mayor Clifford convened City Council into executive session at 5:42 p.m. 12. Reconvene into open session and possibly take action on those matters discussed in executive session. Mayor Clifford reconvened City Council into open session at 7:05 p.m. 13. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. Council Member Knox inquired about a date for the council retreat. City Clerk Janice Ellis said they did not have a date, because she had only heard from two Council Members. 14. Adjournment. There being no further business, a Motion to adjourn was made by Mayor Clifford and was seconded by Council Members Knox and Portugal. Motion carried, 5 ayes — 0 nays.
