1994-139-RES WHEREAS, CITY COUNCIL DID HERETOFORE IN RESOLUTION NO 94-123
RESOLUTION NO. 94-139
WHEREAS, the City Council of the City of Paris did heretofore in Resolution No.
94-123, authorize the procurement of right-of-way for the construction of a new street
from the West boundary line of 1st Street S.W., formerly Wall Street, to a point in
the center line of 4th Street S.W. along the old Southern Pacific Railroad Right-of-
Wll-Y; and,
WHEREAS, the City Council of the City of Paris did heretofore in Resolution No.
94-129, authorize the City Attorney to make a final offer of the appraised amount of the
referenced right-of-way; and,
WHEREAS, the City Attorney reached agreement with Southern Pacific
Transportation Company on a consideration of $8,500.00 for the property described on
Exhibit A attached hereto, being the appraised price plus the estimated cost of
condemnation, and said agreement must be ratified by the City Council of the City of Paris
and such ratification must be returned to Southern Pacific Transportation Company prior
to November 11, 1994; and,
WHEREAS, there being no regular scheduled council meetings which would
accommodate such ratification, it is found to have been necessary to call an emergency
special council meeting for 4:30 p.m. on this the 3rd day of November, 1994, in order to
meet the time restraint enumerated; NOW, THEREI<'ORE,
BE IT RESOLVED BY THE CITY COUNCIL 01<' THE CITY OF PARIS, that
the agreement of the City Attorney with Southern Pacific Transportation Company for a
consideration of $8,500, for the property described on Exhibit A attached hereto, be, and
the same is hereby ratified and accepted; and,
BE IT FURTHER RESOLVED, that the City Clerk of the City of Paris, Mattie
Cunningham be, and she is hereby directed to prepare a certified copy of this resolution
to be transmitted to Southern Pacific Transportation Company.

Being all that certain tract of land situated within the Corporate Limits of the City of
Paris, Lamar County, Texas, a part of the Larkin Rallan Survey, #778 and being a tract of land
now owned by the Southem Pacific Transportation Company being further described as follows:
Beginning at a point for comer in the South line of said Company at the center line of 4th
Street S.W.;
Thence North with the center of said .4th Street a distance of 30.0 feet to a point for
comer;
Thence South 89 Degrees, 57 Minutes, 40 Seconds East with the North line of said
Company a distance of 265.98 feet to a point for comer;
Thence North 81 Degrees, 23 Minutes East with said North line a distance of 303.64 feet
to a point for comer;
Thence North 68 Degrees, 06 Minutes East a distance of 333.67 feet to an iron pin set
for comer in the West Une of Wall Street;
Thence South 0 Degrees, 19 Minutes West with said West line a distance of 103.00 feet
to an iron pin set for comer in the South line of said Southem Pacific Transportation Company;
Thence South 80 Degrees, 15 Minutes West with said South line a distance of 247.96
feet to a point for comer;
Thence South 81 Degrees, 23 Minutes West a distance of 366.64 feet to a point for
corner;
Thence South 89 Degrees, 57 Minutes, 40 Seconds West with said South line a distance
of 268.33 feet to the place of beginning and containing 0.869 acres of land.
