PLANNING AND ZONING COMMISSION

The meeting of the Planning and Zoning Commission was called to order at 5:30 p.m. by
Keith Flowers, Chairman.
All members were present.
Also present were staff members John Godwin, Carla Easton, Triniti Frazier, Clyde
Crews, city council liaison Billy Trenado and concerned citizens.
2. Approval of minutes from previous meeting. (April 1, 2019)
Motion was made by Mihir Pankaj, seconded by John Lee to approve minutes for the April
1, 2019 meeting. Motion carried 7-0.
3. Public hearing to consider and take action regarding the petition ofAdam Bolton for a
change in zoning from an Agricultural District (A) to a Two -Family Dwelling District
(2F), in the Newberry Addition CB 167, Block A, Lot 1, located at 2805 SE 3rd Street.
Godwin states this is an item brought before the board last month but now with a reduction
in density over what was requested the first time. The city still recommends denial for the
same reasons such as traffic and so forth. In addition, the future land use does not support
this and there are single-family properties on three of the four sides.
Public hearing was declared open.
Rickey George spoke against this petition stating this area has a bad intersection and it is
not the area for this at this time.
Ivory Baldwin, 325 York Street, spoke against this petition stating he has been living in
the York Addition for 27 years and wants to protect his investment. He is concerned about
increased traffic and safety.
Susan Baldwin, 325 York Street, spoke against this petition stating she has had to work
hard for everything she has and wants to protect her investment. She does not want
apartments/duplexes constructed at this location. Baldwin states the traffic off the Loop is
dangerous and has concerns about safety.
Billy Hill, 305 York Street, spoke against this petition stating there has been several
accidents near this location and duplexes will increase the traffic. He is concerned about
safety.
Debra George, 2735 SE 3rd Street, spoke against this petition. She states she has lived there
since 1997 and has done her research prior to coming to this meeting. George states she
has talked to real estate agents that have informed her that property value would decrease
if duplex apartments were constructed in this area. George further states she has been
advised that it is nearly impossible to sell a home that is next door to a duplex apartment.
She states if the builder wants to build a single-family home then she would not be opposed
that.
Public hearing declared closed.
Motion was made by Chad Lindsey, seconded by Keith Flowers to deny this item. Motion
carried 6-1 with Sims Norment in opposition.
4. Public hearing to consider and take action regarding the petition of the City ofParis, Texas
to update Zoning Ordinance No. 1710 of the City of Paris, Texas, specifically establishing
regulations for mobile food units and food truck parks/courts.
Easton states this item is returning from last month's meeting. The city's zoning ordinance
does not provide for mobile food units as a defined land use. We currently have a number
of mobile food trucks that operate on a temporary basis in the city and there are no
regulations. Easton states we are attempting to address those needs and reviewed the
provided draft ordinance with the commission. Commissioners expressed their views on
the draft ordinance regarding insurance, hours of operation, portable seating and restroom
requirements.

Audie Early states he had a productive meeting with city staff along with several other
mobile food truck owners. The question that he had was what type of policy would be
required, whether it be general liability insurance or food liability insurance. He does not

requirement for brick and mortar restaurants. He states he is not opposed to the draft

noted changes to 6c: The mobile food unit hours of operation shall be limited to Monday
through Thursday and Sunday: 7:3 0 a.m. to 10: 00 p.m. and Friday through Saturday: 7:3 0
a.m. to 11:00 p.m. Striking items 4c, 6k and 61 from the draft. Motion carried 6-1 with
James O'Bryan in opposition.
5. Public hearing to consider and take action regarding the petition of the City ofParft'
Texas to update Zoning Ordinance No. 1710 of the City of'Paris, Texas, specifically
modifying regulationsfir residential dwellings minimum squarefootage.
Godwin states staff is proposing to establish minimum sizes for each of the single-family
zoning districts: SF -I, 1800 SF; SF -2, 1500 SF; and SF -3, 1000 SF (700 SF with a
Specific Use Permit) Godwin further states using this zoning tool we can better maintain
the feel and integrity of zoning districts. He states this would also ensure that we do not
have very small residential structures showing up in established neighborhoods.
Commissioners reviewed and discussed small homes created as a land use and small

Public hearing was declared open. With no one speaking, the public hearing was declared
closed.
Motion was made by Chad Lindsey, seconded by Rick Hundley to approve this item.
Motion carried 7-0.
6 Public hearing to consider and take action regarding the petition of the City ofParis,
Texas to update the Subdivision Regulations of the City ofParis, Texas, specifically
establishing requirementsfor pedestrian sidewalks.
Easton states staff is proposing to amend the subdivision regulations with requirements
for the construction of sidewalks with all new development and substantial
redevelopment projects. This was identified on the ADA transition plan as part of our
ordinance that we needed to amend. Commissioners reviewed and discussed the draft
ordinance.
Public hearing was declared open. With no one speaking, the public hearing was declared
closed.
Motion was made by Rick Hundley, seconded by Mihir Pankaj to approve this item.
Motion carried 4-3 with Lee, Sims and Flowers in opposition.
7. Consideration of and action on the Preliminary Plat of Lots 1, 2, 3, Block (CB 186) of
the Paris Pregnancy Care Addition, located at 425 E Houston.
Easton states Paris Pregnancy Care Center Inc. owns Lot 1 of City of Paris Block 186
located at 425 E Houston St. They are proposing to acquire a portion of the adjacent lots
in order to develop an office building to support the main office located across the street
at 500 E Houston. The owner has submitted a preliminary and final plat, which
establishes a new lot line to the west and to the north. The lot north will not meet the
minimum lot depth prescribed by Section 9 of the Zoning Ordinance and will require a
variance before proceeding. Easton's recommendation is to approve the preliminary and
final plat subject to approval of a variance for Lot 3 by the Board of Adjustment.
Motion was made by Keith Flowers, seconded by Mihir Pankaj to approve this item with
City Engineer recommendations. Motion carried 7-0.
8. Consideration of and action on the Final Plat of Lots 1, 2, 3, Block (CB 186) of the
Paris Pregnancy Care Addition, located at 425 E Houston.
Easton states this is same plat with the same comments.
Motion was made by Keith Flowers, seconded by John Lee to approve this item with City
Engineer recommendations. Motion carried 7-0.
