SUBJECT: CITY ORDINANCE SECTION 26-1 COMPOSITION OF DEPARTMENT

BACKGROUND: City Ordinance 26-1 sets the composition of the department as to number of
officers in each classification of Officer, Sergeant, Lieutenant, Captain, Assistant Chief and Chief.
STATUS OF ISSUE: Part of the strategic plan of the department includes a reduction of the total
number of supervisors and their assignments. With the most recent retirement of a CID lieutenant,
I asked and the council authorized a change of one of the two lieutenant positions in CID to an
officer position, leaving a Captain and Lieutenant in our Criminal Investigation Division. Since
that time, it has become apparent that we can enhance our narcotics team in CID by placing a
sergeant back in the team, much as it was several years ago. This sergeant position will work
closely with the other two detectives in this team with more direct supervision. The sergeant will
still carry a caseload. I request that the number of Sergeants in Section 26-1 change from five to
six and the number of officers reduce from 41 to 40. This does not affect the total number of
officer positions in the department.
BUDGET: There is still a minimum savings of $3,646.00 in the department's yearly payroll line
item.
RECOMMENDATION: Authorize the amending of the ordinance to reflect these changes.
Sec. 26-1. - Composition of department.
The police department of the city shall be composed of the chief of police and fifty-six (56) members
classified as follows:
(1) One (1) assistant police chief.
(2) Three (3) police captains.
(3) Six (6) police lieutenants.
(4) Six (6) police sergeants
(5) Forty (40) police officers.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING THE CITY OF PARIS CODE OF ORDINANCES BY REVISING
CHAPTER 26, ARTICLE I, SECTION 26-1 "COMPOSITION OF
DEPARTMENT" TO ADD AN ADDITIONAL SERGEANT POSITION AND
REDUCE ONE POLICE OFFICER POSITION; PROVIDING A REPEALER
CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND DECLARING
AN EFFECTIVE DATE.
WHEREAS, Chapter 26, Article I, Section 26-1, "Composition of Department," of the
Code of Ordinances of the City of Paris, Texas, provides for the classification of the
composition of the Paris Police Department, ("the Department"); and
WHEREAS, changes within the Department since said Section 26-1 was last
amended necessitate further amendments to enhance operations of the Department; and
WHEREAS, the Department has concluded that it is necessary to add a sergeant
position to the narcotics unit of the criminal Investigation Division, thus necessitating the
creation of on sergeant position and the elimination of one patrol officer position; and
WHEREAS, the number of sergeants in the Department would change from five (5)
to (6) and the number of patrol officers would change from forty-one (41) to forty (40);
and
WHEREAS, Council finds that it is in the best interests of the citizens of Paris, Texas
to make the recommended changes to Section 26-1;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby
in all things approved.
Section 2. That Chapter 26, Article I, Section 26-1, "Composition of department"
of the Code of Ordinances of the City of Paris, Texas, be, and the same is hereby, amended to
read in its entirety as follows:
"Sec. 26-1. - Composition of department.
"The police department of the City of Paris shall be composed of the Chief of police
and fifty-six (56) members classified as follows:
"1. One (1) assistant police chief.
"2. Three (3) police captains.
"I Six (6) police lieutenants.
"4. Six (6) police sergeants.
"5. Forty (40) police officers."
Section 3. That all provisions of the ordinances of the City of Paris, Texas in
conflict with the provisions of this ordinance are hereby repealed, and all other provisions
of the ordinances of the City of Paris not in conflict with the provisions of this ordinance
shall remain in full force and effect.
Section 4. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 5. That it is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 6. That this ordinance shall become effective from and after its date of
passage.
