PLANNING AND ZONING COMMISSION

The meeting of the Planning and Zoning Commission was called to order at 5:30 p. m. by
Keith Flowers, Chairman.
All members were present.
Also present were staff members John Godwin, Carla Easton, Triniti Frazier, Clyde
Crews, city council liaisons Dr. Steve Clifford, Billy Trenado and concerned citizens.
2. Approval of minutes from previous meeting. (May 6, 2019)
Motion was made by Sims Norment, seconded by John Lee to approve minutes for the May
6, 2019 meeting. Motion carried 7-0.
Motion was made by James O'Bryan to move item 6 to the last item on tonight's agenda
to allow more time for discussion, seconded by Mihir Pankaj. Motion carried 7-0.
3. Public hearing to consider and take action regarding the petition of Lisa Short for a
change in zoning from a Two -Family Dwelling District (2F) to Neighborhood Service
(NS), in the Mayer Addition, Block 4, Lot 23, located at 3206 Bonham Street.
Godwin states what has happened before does not affect this case in a legal sense. The
comprehensive plan has broad zoning categories. For example, the zoning language in the
comprehensive plan shows Retail, which is not the same as General Retail. It does include
General Retail as well as Commercial, Neighborhood Services, Parking and other uses.
This agenda item is consistent with the comprehensive plan, therefore, staff recommends
approval of this request.
Public hearing was declared open.
Sherry Pritchett, 99 NW 32"d Street, spoke in favor of the petition stating this would not
affect the quality of life in this neighborhood nor would there be any interference with
traffic by this action. Pritchett further states that she believes Ms. Short provides a
necessary service to the community without disrupting their neighborhood.
Lisa Short, 3206 Bonham Street, states she has owned the business at this location for 30
years and did not know she was not in compliance, therefore, she is requesting this zoning
change in order to be in compliance.
Kim McCann, states she is speaking on behalf of her mother, Sheila Smithey, homeowner
at 3220 Bonham Street, as well as nine other neighbors that signed a petition expressing
opposition to this zoning request. McCann states they have safety concerns due to tax
customers walking into their yard confused by Google maps, increased traffic and illegal
parking. McCann states they are directly affected by loitering and this business should be
in a retail area with a parking lot to accommodate customers. McCann submitted the
petition and pictures to the commissioners.
Steve Thompson, 3206 Bonham Street, spoke in favor of the petition stating they are not
adding or changing anything. They are not growing or getting any bigger.
Godwin advised a letter of support was received from Jill O'Bryan, 3150 Bonham Street.
A copy of the letter was distributed to commissioners.
Public hearing declared closed.
Commissioner Lindsey states this is along a major thoroughfare and the future land use
calls for this entire corridor to be retail of some sort. Lindsey asked Godwin what is allowed
in Neighborhood Service. Godwin states Neighborhood Service is a light retail, typically
to serve a specific neighborhood and that might include a dry cleaners or donut shop but
not things such as a grocery store or sit down restaurants.
Motion was made by Keith Flowers, seconded by Chad Lindsey to approve this item.
Motion carried 7-0.
4. Public hearing to consider and take action regarding the petition of Melissa Schaffer on
behalf of Ben Faber for a change in zoning from a Commercial District (C) to
Commercial District (C) with a Specific Use Permit (SUP) for Used Auto Sales, in the
City of Paris, Block 41-A, Lot 1, 2 and 8, located at 305 N Main Street, 330 NW I" and
vacant lot NW I" Street.
Godwin states this an area that has been used for this purpose in the past. It is already zoned
Commercial and in order to operate a used auto car lot a Specific Use Permit is required.
Public hearing was declared open.
Melissa Shaffer states she is asking the commission for approval for a used car lot as it has
been in the past. They are currently adding on to the pipe fencing to make a safer route into
the car lot.
Public hearing declared closed.
Motion was made by John Lee, seconded by Keith Flowers to approve this item with no
time constraints. Motion carried 7-0.
5. Public hearing to consider and take action regarding the petition of Raymond W. Smith
for a change in zoning from a Commercial District (C) to Commercial District (C) with a
Specific Use Permit (SUP) for Auto Fuel Sales, in the City of Paris, Block 306, Lot PT of
2, located at 2510 N Main Street.
Godwin states a Special Use Permit is required for auto fuel sales. This is currently a
commercial zoning. Buildings will be demolished and new buildings constructed with new
driveway and this will be a significant improvement for that corner, therefore, city staff
recommends approval of the SUP.
Public hearing was declared open.
Shawn Napier with EST, Inc. is representing Mr. Smith. Napier states they will
eventually demolish the existing Exxon CEFCO station and build a 6000 s.f. CEFCO
facility behind the tire store as it exists today with a driveway down to the Loop frontage
road. This is a new concept plan but the aesthetics will be similar to the other locations on
Lamar.
Motion was made by Rick Hundley, seconded by Keith Flowers to approve this item.
Motion carried 7-0.
6. Public hearing to consider and take action regarding the petition of the City of Paris,
Texas to update Zoning Ordinance No. 1710 of the City of Paris, Texas, specifically
modifying regulations for Planned Development Districts.
Godwin states Planned Development districts are intended to be used to allow integration
of multiple land uses on large tracts. Godwin is recommending a minimum of ten acres
for Planned Developments, smaller than in many municipalities, but an improvement
over current practice in Paris. The final development plan, showing all integrated uses
and how they will fit into and affect surrounding properties becomes the custom-built
zoning district. A smaller area without very specific planning and performance standards
cannot support a truly integrated mixed-use project. O'Bryan asked if developers have
room to negotiate the minimum acreage. Godwin states you can make exceptions because
Planned Developments are a negotiated deal. If you approve a PD, the site plan that
shows where all the buildings and driveways are becomes the zoning ordinance, which is
enforceable by law. Like any zoning ordinance, it can be amended.
Motion was made by Chad Lindsey, seconded by John Lee to approve this item. Motion
carried 7-0.
7. Consideration of and action on the Preliminary Plat of Lot 1, Block A of the Tylers 's
Pizzeria Addition, located at 3610 N Main Street.
Easton states the owner is proposing to remodel the existing building to be a pizza
restaurant and has submitted a preliminary plat of the property. Water is available to the
site along US 271 N but that actual location of the water main must be identified and
proper easements dedicated as needed. Easton states we are working with them on their
water and sewer. Easton recommends approval with the following revisions:
1. Provide a site plan showing all proposed changes to the existing structures and
parking areas, water and sewer services, fire lanes, fire hydrants, and green space.
2. Provide a 20' utility easement along the frontage of US 271 N.
3. Identify the fire lane access easement.
4. Clarify ROW/Easement along the south property line, and show dimensions.
Motion was made by Keith Flowers, seconded by Sims Norment to approve this item
with City Engineer recommendations. Motion carried 7-0.
8. Consideration of and action on the Preliminary Plat of Lot 1, Block of the Modern
Pyramids Addition 170-C, located at 2735 S Church Street.
Easton states the owner is proposing to develop the lot into a convenience store with a
Taco Casa drive through restaurant. The water main serving the lot is of a substandard
size and cannot support the development needs. The owner will extend an 8" water main
through the lot as part of the required improvements. Sewer is available to serve the site
along Church St. It appears that the preliminary plat complies with the City of Paris
subdivision regulations and she recommends approval subject to the following revisions:
Provide a drainage plan showing detention requirements or accommodations.
2. Provide a 10' utility easement along the frontage of Church Street and Loop 286.
3. Provide off-site easements as necessary for construction of the water line
improvements.
Motion was made by Keith Flowers, seconded by John Lee to approve this item with City
Engineer recommendations. Motion carried 7-0.
9. Consideration of and action on the Preliminary Plat of Lots 4, 5, 6, 7, Block A of the
Lamar Business Park Phase HAddition, located in the 600 Block of NE Loop 286.
Easton states the owner is proposing to subdivide the tract into 4 lots, creating lots 4, 5, 6
and 7 of the Lamar Business Park Phase 2 addition. The property is currently zoned
Commercial. The owner has submitted a preliminary plat of the proposed subdivision.
Water service is available along Loop 286, along with street access to the frontage road.
An 8" sewer main shall be extended to serve the proposed lots, by the developer. Easton
recommends approval subject to the following revision:
Provide minimum finished floor elevations on all proposed lots.
Motion was made by Mihir Pankaj, seconded by John Lee to approve this item with City
Engineer recommendation. Motion carried 7-0.
10. Consideration of and action on the Preliminary Plat of Lots 24, 25, 26, Block A of the
The Hills Addition Phase VI, located in the 3600 Block of Summerhill Dr.
Easton states owner is proposing to subdivide the property into three residential estate
lots. There are several comments on the plat. This addition will require Summerhill Drive
to be extended as well as water lines, sewer lines and some channel improvements.
Easton recommends approval with the following revisions:
1. Show the City Limit line.
2. Provide drainage easements for channelized surface drainage, and provide a storm
sewer plan to accommodate flows from developable lots.
Provide minimum finished floor elevation for each lot, and approximate location
of building pad for lots with cross drainage.
4. Increase property line radii around the cul-de-sac to accommodate parkway width.
5. Identify trees to be removed.
6. Label the width of street Right -of -Way, and utility easements.
7. Consider extension of street to property line in lieu of cul-de-sac.
Flowers asked Mr. Brown if he had any input. Wayne Brown states they are trying to
clean up what they have there. This is a dead end street and they are trying to put in a cul-
de-sac to clean it up. They are not planning any large development but rather estate lots.
Motion was made by Sims Norment, seconded by John Lee to approve this item with
City Engineer recommendations. Motion carried 7-0.
