1993-067-RES WHEREAS, the City Council of the City of Paris, and the Paris Junior College is interested in providing RESOLUTION NO. 93-067 JOINT RESOLUTION NO. WHEREAS, the City Council of the City of Paris, and the Paris Junior College is interested in providing educational services to educationally disadvantaged adults; and, WHEREAS, the City of Paris will provide to Paris Junior College space adequate for instruction of students and will identify individuals who are 17 years of age or older, out-of-school, and des i rous of adul t bas ic educa t ion instruction and will schedule instruction during times that are most convenient for the participants and that will generate an appropriate level of participation; and, WHEREAS, it is deemed to be in the best interest of the citizens of the City of Paris to enter into such agreement in the form attached hereto as Exhibit A; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the Agreement Between Paris Junior College Adult Education Cooperative Program and City of Paris, in the form attached hereto as Exhibit A, be, and the same is hereby approved; and, BE IT FURTHER RESOLVED, that the City Manager of the City of Paris, Michael E. Malone, be, and he is hereby authorized and directed on behalf of the City of Paris to execute said agreement in the form attached hereto as Exhibit A. Passed and adopted this 12th day of July, 1993 ~~6;:or ATTEST: Cunningham, City PARIS JUNIOR COLLEGE ATTEST: son, Secretary A- AGREEMENT BETWEEN PARIS JUNIOR COLLEGE ADULT EDUCATION COOPERATIVE PROGRAM AND CIlY OF PARIS This Agreement is entered into this 1st day of July, 1993 by and between PARIS JUNIOR COU.EGE, hereinafter called PJC, and TIlE CITY, to provide educational services to educationa1ly disadvantaged adults as defined by Adult Basic Education Federal and State Funds Acts under the authority of the Texas Education Agency. WITNESSTH THAT WHEREAS, PJC desires to provide adult education instruction to educationally disadvantaged adults in its service area, and whereas TIlE CTIY desires to provide the services of identifying persons who will qualify under the Adult Basic Education Act for this service and provide space for such instroction, in consideration of the mutual promises herein contained, the parties hereto agree as follows: I. SCOPE OF SERVICES TIfE CITY will provide to PJC during the term hereof the following services: SPACE adequate for instruction of students. It is agreed that availability of space will depend on the scheduling of normal CITY events. IDENTIFICATION of individuals who are 17 years of age or older, out.of-schoo~ and desire adult basic education instroction. SCHEDULE instroction for a minimwn of 2 classroom h011Ill per week during times that are most convenient for the participants and that will generate an appropriate level of participation. II. TIME OF PERFORMANCE This agreement shall be for the grant period commencing on July 1, 1993, and continuing through June 30, 1994. m. COMPENSATION AND METHOD OF PAYMENT PJC will pay all eligible costs: 1. Issue payment warrants to the teacher ofS10.00 per hour. 2. All necessary books, supplies, etc., allowed under the specific grant(s). PJC will schedule instruction for a minimwn of 2 classroom h011Ill per week during times that are most convenient for the participants and that will generate an appropriate level of participation. EXHIBIIA The teacher(s) wiD provide PIC monthly attendance reports and wiD provide descriptive, statistical, financial, and eva1ua1ive reports as may be required by the Texas Education Agency and PIC. Monitoring, coordination and sUperWion of the program wiD be the responsibility of PJC for compliance with federal, state and local guidelines. Staff wiD meet minimwn qualifications and in-service training as required by PJC. An teachers and aides wiD be screened, selected, and employed by PJC with the mutual consent of TIm CITY. A written employment agreement wiD be signed by each staff person, the co-op director, and authorized college personnel. V. FUNDING Notwithstanding anything provided to the contrary, it is expressly understood and agreed that the payments due and owing under this contract are limited and expressly subject to the availability and receipt of fimds by PJC from the Texas Education Agency as designated for the aforementioned educational services to educationally disadvantaged persons. VI. MISCELLANEOUS During the term of this agreement, if 1HE CITY becomes unable or fails to satisfactorily provide the services required of it under this agreement, P JC may at its option tetminate this agreement with fifteen (15) days written notice. Neither this agreement nor any duties or obligations hereunder shall be assignable by either party without the prior written consent of the other party. The validity of this agreement and of any of its terms and provisions, as weD as the rights and duties of the parties hereunder, shaII be governed by the laws of the State of Texas. TIm CITY certifies that this program wiD be conducted on its premise in accordance with all applicable Federal, State, and local laws and requirements. Executed this l2 th day of July .1993.
