BACKGROUND: Cities collect fees for various development related services in order to recoup
the costs of the municipality for providing those services. Fees are not used to generate revenue
for the sake of making a profit, however most cities make an effort to break even when it comes
to development costs, the notion being that development should pay for itself. When it fails to pay
for itself, those services are subsidized by taxes paid by those not benefiting directly from the
services rendered. One concern is that such fees may drive development away. However, virtually
every study on development fees shows that is not the case, especially in a city like Paris which
does not even collect many of the typical charges, like impact fees, assessed on new development.
To test that theory here, a few years ago we placed a moratorium on the collection of all
development fees for six months. There was no impact on the number of permits requested;
however, there was a loss of revenue and a greater reliance on taxes paid by existing residents.
Paris has not raised permitting fees for many years, and as a result the current fee schedule lags
behind actual costs to the city for completing the work.
Furthermore, recent state legislation prohibits a municipality from collecting residential permit
fees based on project valuation, rather requiring the cost for permit to be based on square footage
of improvements. Because of this, Paris must change the method by which we charge for
residential permits.
STATUS OF ISSUE: Staff has compared our current fee schedule to that of other cities similar in
size, and we are proposing several adjustments in order to cover the city costs associated with the
work.
BUDGET: Will potentially generate additional revenues.
RECOMMENDATION: Approve of an ordinance revising the schedule of building permit and
miscellaneous fees.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING SECTIONS 7-19, "PERMIT FEES," AND 34-4, "APPLICATION
AND FEE FOR WATER AND SEWER TAPS," OF THE CODE OF
ORDINANCES TO CONFORM WITH STATE LAW; MAKING OTHER
FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A
REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A
PENALTY CLAUSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the Sec. 7-19 of the City of Paris Code of Ordinances sets forth construction
permit fees and Sec. 34-4 sets forth fees for water and sewer taps; and
WHEREAS, the Texas Legislature, in HB 852, effective September 1, 2019, added Sec.
214.907 to the Texas Local Government Code providing that building permit fees for
construction or improvements to residential dwellings may not take into account the value of the
dwelling or the cost of the construction of or improvements to the dwelling, thus necessitating
the amendment of Sec. 7-19 to conform with the new law; and
WHEREAS, the City has not revised its building permit fee schedule and water and sewer
tap fee schedule since at least 2009; and,
WHEREAS, the City Council finds it desirable to revise these fee schedules so as to allow
the city to perform the services related to said permits and related work on a break even basis,
thus avoiding having to subsidize those services from the taxes of those not directly benefitting
from the development;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby in all
things approved.
Section 2. That Article II, Section 7-19 of the Code of Ordinances of the City of Paris
shall be and is hereby amended to read as follows in its entirety:

Section 4. That all provisions of the ordinances of the City of Paris, Texas in
conflict with the provisions of this ordinance are hereby repealed, and all other provisions
of the ordinances of the City of Paris not in conflict with the provisions of this ordinance
shall remain in full force and effect.
Section 5. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 6. That it is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 7. That any person violating any provision of this ordinance shall be
guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with
provisions of Sec. 1-6 of Chapter One of the City of Paris Code of Ordinances, and each and
every day's continuance of any violation of the above -enumerated sections shall constitute
and be deemed a separate offense.
Section B. That this ordinance shall become effective from and after its passage and
publication as required by law.
