1. The Board of Adjustment meeting was called to order by David Hamilton,
Chairman at 12: 00 p.m.
The following members were present: David Hamilton, Brady Fisher,
Benny Plata, Louise Hagood and Ruth Ann Alsobrook.
Also present was Stephanie Harris, Carla Easton, John Ankrum and
concerned citizens.
2. Approval of minutes from previous meeting. (June 18, 2019)
Motion was made by Ruth Ann Alsobrook, seconded by Louise Hagood to approve
minutes for the June 18th, 2019 meeting. Motion carried 5:0.
3. Public hearing to consider and take action on the petition of Jeff White on Lot
12, City Block A, Johnson Woods Park subdivision, being located at 2925 Margaret
Street.
The petition requested a variance of Section 9-600 of the Zoning Ordinance which
provides as follows:
(1) Schedule minimum side yards- Residential districts.
Five (5) feet required in each side yard.
The applicant is requesting a variance of two (2) feet for the required side yard on
an existing home.
Public hearing was declared open.
John Ankrum, the building official, informed the board of the need of the variance,
which was brought to our attention during a remodel, is required for the title
company to complete any future sale of the property. He also addresses that though
it encroaches on a utility easement he does not believe there will be any issues since
the utilities are already in place elsewhere. Ankrum acknowledges that the house is
existing and recommends approval.
Jeff White, of 2925 Margaret St, follows up Ankrum's statement and informs the
board that future title companies will not sign off on the home if it is not in
compliance.
No one else spoke in favor or opposition,
Public hearing was declared closed.
Motion was made by Benny Plata, seconded by Brady Fisher to approve the variance
to Section 9-600 of the Zoning Ordinance. Motion carried 5:0.
4. Public hearing to consider and take action on the petition of Kolton Porter on
Lots 34 through 39, City Block 1, Lamar Terrace subdivision, being located at
2213 Hubbard St.
The petition requested a variance of Section 11.5-3 (b)(1)(a) of the Zoning
Ordinance which provides as follows:
(1) Front yard fence requirements.
a. No fence shall be permitted in the front yard with the following exceptions:
i. On lots zoned in historic overlay district (HD) and in accordance with the
design standards adopted by the historic preservation commission.
ii. On lots in excess of two (2) acres in size which are used for single-family
residential purposes.
iii. On lots which are zoned and used for LI or HI purposes.
The applicant is requesting a variance to reconstruct an existing legal, non-
conforming front yard fence that does not meet the ordinances' requirements.
Public hearing was declared open.
John Ankrum, building official, explains to the board that the need for a variance
was brought to the attention of the applicant when gathering quotes to repair the
fence. Anktum commends the applicant for following the correct process instead of
just constructing the fence without permission. He also states that though the city
does not have any issues with the proposed fence that it is a board decision.
Marcelino Rodrigues, of 210 SE 23' St, is a neighboring property that is in favor of
the fence and states that since it is existing he does not have an issue.
Mr. and Mrs. Kolton Porter, of 2213 Hubbard, state that they would like to
reconstruct a fence of the same style to preserve the character of the home. It is also
beneficial to have the front yard fence since they have three small children.
No one else spoke in favor or opposition.
Public hearing was declared closed.
Motion was made by Ruth Ann Alsobrook, seconded by Brady Fisher to approve the
variance to Section 11.5-3 (b)(1)(a) of the Zoning Ordinance. Motion carried 5:0.
5. Meeting adjourned 12:15 p.m.
