1992-064-RES WHEREAS, the City Council of the City approve Map Resource, Inc., to prepare and submission of a plan RESOLUTION NO. 92-064 WHEREAS, the City Council of the City approve Map Resource, Inc., to prepare and submission of a plan of redistricting to the Department of Justice; and, of Paris, did assist in the United States WHEREAS, the services to be provided are initial evaluation which includes a review and written evaluation of the City's Charter and related voting laws and ordinances which will affect redistricting; a narrative evaluation of the current district boundaries; statistical analysis of current City Single Member Districts; maps showing current Single Member District boundaries and ethnic minority concen- trations; a personal visit to the city to meet with City Council to discuss initial evaluation and recommendations for conducting public hearings; and, WHEREAS, as directed, the City Manager of the City of Paris, Michael E. Malone, did execute said contract for such plan of redistricting, which execution should be in all things ratified; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the acceptance of the proposal of Map Resource, Inc., in the form of the contract attached hereto as Exhibit A is hereby ratified and the form of such contract is approved; and, BE IT FURTHER RESOLVED; that the execution of the contract attached hereto as Exhibit A with Map Resource, Inc., by the City Manager of the City of Paris, Michael E. Malone, on the 29th day of July, 1992 is hereby ratified. Texas, hereinafter referred to as the "City", hereby retains and employs Map Resource, Inc., hereinafter referred to as "MRI", to prepare, and assist in the submission of a plan to the United States Department of Justice for the reapportionment and redistricting of City single member districts, together with all related voting precincts for City election boundaries. MRI shall participate in the formulation of such political boundaries and shall provide such statistical, demographic, mapping and graphics services as may be necessary to complete the project Also under this contract, the fum of McGinnis, Lochridge & Kilgore, L.L.P. will provide all necessary legal advice to accomplish the stated objectives of the project Services Provided The services provided are: . Initial Evaluation which includes: A review and written evaluation of the City's charter ll!ld related voting laws and ordinances which will affect redistricting. A narrative evaluation of the current diS'.rict boundaries, noting issues which need to be corrected. Statistical analysis of each of the current City Single Member Districts (SMD's). Maps showing current SMD boundaries and ethnic minority concentrations. A personal visit to the city to meet with the City Council to discuss the Initial Evaluation document and gather information for the redistricting process. Recommendations for conducting public hearings. . Preliminary Redistricting Plan which includes: Statistical analysis of the SMD's for up to three (3) alternative proposed redistricting plans. Maps showing the proposed SMD boundaries for all three alternatives. A list of recommended action steps to arrive at the Final Redistricting Plan. One personal visit to City to meet with the City Council and/or participate in public hearings. . Fmal Redistricting Plan which includes: One revision (if necessary) to one of the proposed alternative redistricting plans to arrive at the [mal district bOlllldaries for the SMD' s. A narrative evaluation of the proposed redistricting plan emphasizing why it should be adopted. Statistical analysis of the new SMD's illustrating equal apportionment Maps showing the new SMD's along with natural boundaries and other significant geographic features (i.e. roads, railroad tracks, rivers, polling places) which influenced the selection of proposed boundaries. A personal visit to City to present the Final Redistricting Plan and to answer questions regarding it Development and submission of a document to the U.S. Justice Department seeking pre-clearance for the proposed SMD boundaries. Billings from MRI are due for payment within 10 days of receipt by City. LATE PAYMENT PENALTY- 9% APR ni~lInt for Mllltinle Rntitie~ Due to the economies of doing several redistricting projects at the same time. the above fee (not including travel expenses) will be reduced by 40% for all entities (City, County, ISD's or Junior College) which redistrict at the same time, so long as the total contract is at least $17,000. For example, MRI will redistrict the City, County, Paris ISO and Junior College for $18,000 with City's fee being $9,000 rather than $15.000. Additional Services The following services are not provided in the fixed-price contract, but will be performed by MRI at extra cost (at the rate of $100.00 per hour plus direct out-of-pocket expenses) to CeHBly: C,t: f ~ More than three personal visits to County. Preparation of more than three alternative plans prior to the Fmal Plan. Additional road maps or voting precinct maps. Participation in litigation associated with the filing. Personal trips to meet with the U.S. Justice Department. Neither Map Resource. Inc. nor McGinnis. Lochridge & Kilgore, L.L.P. is responsible for errors which may occur in the PL94-171 data. Public Law 94-171 required that all voter tabulation districts (VTDs) follow census block boundaries. In many cases. voting districts had been drawn in a manner which did not follow a census block boundary. This required the State of Texas. acting in conjunction with the State Data Center and the Texas Legislative Council, to move the actual voting district boundary to coincide with a nearby census block boundary for tabulation purposes only. The resulting VTD was no longer "actual" . but an approximation of the voting district referred to as a "pseudo voting district." Every reasonable effort will be made to conform the pseudo voting district to actual boundaries. However. due to the nature of the available data base, and the requirements of Public Law 94-171. there may be a necessity to alter voting district boundaries to match the census block format. In this event. every reasonable effort will be made to insure accuracy while retaining the integrity of the data base upon which reapportionment must rely. V\.
