WHEREAS, the Housing Authority of the City of Paris has
undertaken a project of construction of public housing for
the Jackson Street Site in accordance with plans and
specifications prepared by Hayter Engineering, Inc.; and,
WHEREAS, said plans require a draining easement on Block
15 of the Gibbons-Braden Addition; and,
WHEREAS, the easement description
completion of said drainage project is
attached hereto; and,
necessary for the
shown on Exhibit A
WHEREAS, the
described drainage
housing project and
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the City Attorney, T. K. Haynes, be, and he is
hereby authorized and directed to proceed to condemn the
above described property to be used for a drainage easement
for the Housing Authority of the City of Paris Public Housing
Jackson Street Site.
City Council finds that the above
easement is necessary for said public
that the same should be condemned; NOW,
Passed and adopted this 30th day of March, 1992.

KNOW ALL MEN BY THESE PRESENTS:
That I, COL. ROBERT STELL, of McLennan County, Texas, for and
in consideration of the sum of ONE DOLLAR ($1.00) cash, and
other good and valuable consideration, to me in hand paid by
the CITY OF PARIS, Paris, Texas, the receipt and sufficiency
of which is hereby acknowledged, do hereby sell, give and
grant unto the said CITY OF PARIS, a municipal corporation,
of Lamar County, Texas, a drainage easement described as
follows:
SITUATED in the City of Paris, Lamar County,
Texas, being a portion of the Larkin Rattan Survey,
Abstract No. 778, and being out of that property owned
by Co1. Rober t Stell and fur ther be ing descr ibed as
being out of Block 15 of the Gibbons-Braden Addition,
and Addition to the City of Paris, and bounded as
follows:
BEGINNING at a t inch steel rod set for corner in
the north right-of-way line of the Texas and Pacific
Railroad, same being in the south boundary line of the
Robert Stell tract, said point of beginning lies North
83 deg. 07 min. 00 sec. Wes t, 36.03 feet from the
southeast corner of Block 15 of said Gibbons-Braden
Addition;
THENCE North 83 deg. 07 min. 00 sec. West along
the north right-of-way line of the Texas and Pacific
Railroad, 23.69 feet to a -! inch steel rod set for
corner;
THENCE North 57 deg. 36 min. 51 sec. East, 71.24
feet to a -! inch steel rod set for corner in the east
boundary line of the Rattan Survey and being in the
west boundary line of the George W. Cox Survey,
Abstract No. 164; said stake also lies in the west line
of Lot 1 of City Block 253-F;
THENCE South 1 deg. 06 min. 32 sec. West along the
common boundary line between the Rattan and Cox Survey,
17.98 feet to a t inch steel rod set for corner; said
corner lies North 1 deg. 06 min. 32 sec. East, 27.34
feet from the southwest corner of Lot 1 of City Block
253-F;
THENCE South 57 deg. 36 min. 51 sec. West, 42.98
feet to the place of beginning, and containing 0.0197
of an acre of land.
TO HAVE AND TO HOLD the above property unto the CITY OF
PARIS for the purposes aforesaid, with the right and
said surface was found when such work was undertaken insofar
as permitted under the plans and specifications approved for
projects to be located within the herein described easement,
and that in the use of said rights and privileges herein
granted the CITY OF PARIS will not create a nuisance or do
any act that will be detrimental to said premises.
Grantor does hereby bind himself, his heirs, executors
and administrators, to warrant and forever defend, all and
singular, said premises unto the CITY OF PARIS against every
person whomsoever lawfully claiming or to claim the same or
any part thereof.
