13 - Authorizating executiion of a professional services agreement with Hayter Engineering for design of the Pump TrackItem No. 13 memorandum TO: Mayor & City Council Gene Anderson, Interim City Manager FROM: Carla Easton, PE, Engineering & Community Development Director SUBJECT: PROFESSIONAL SERVICES AGREEMENT FOR PUMP TRACK DATE: November 22, 2019 BACKGROUND: The City was awarded a Texas Parks & Wildlife Department (TPWD) outdoor recreation grant to fund a 50% cost match for a pump track project. Engineering services are needed to develop the plans and specifications in accordance with the grant requirements. STATUS OF ISSUE: Hayter Engineering has been involved with the preliminary project planning, estimates and grant application process for the pump track. They have overseen many grant projects for the city and are qualified to provide these services. They have submitted a proposal in the amount of $64,400. BUDGET: Funds are available in the 2017 Bond Fund, and payments will be 50% reimbursable by TPWD. RECOMMENDATION: Approve of a resolution authorizing an agreement Hayter Engineering for professional services associated with the pump track project. Draft RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH HAYTER ENGINEERING, INC., FOR DESIGN OF A PUMP TRACK PROJECT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of Paris has received an outdoor recreation grant from Texas Parks & Wildlife Department (TPWD) that would provide a 50% cost match for a pump track project as provided in the City's park plan; and WHEREAS, pursuant to the Texas Professional Services Procurement Act, Texas Government Code Chapter 2254, and Section 2254.004, the City Council finds that Hayter Engineering, Inc. is the most qualified provider of design and engineering services for the design of the pump track project and that city staff has negotiated a fair and reasonable price for said services with said Hayter Engineering, Inc.; and WHEREAS, the City Council of the City of Paris, Texas authorizes the Interim City Manager to enter into a Professional Services Agreement with Hayter Engineering, Inc., in the amount of $64,400.00 for design of a pump track. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: SECTION 1. That the City Council hereby approves and authorizes the Interim City Manager to enter into a Professional Services Agreement in with Hayter Engineering, Inc., in the amount of $64,400.00 for design of a pump track. SECTION 2. That the Interim City Manager is hereby authorized to act on behalf of the City in all matters relating to this Professional Services Agreement and to execute all necessary documents, relative to the pump track project. SECTION 3. This resolution shall become effective upon the date of passage. PASSED AND APPROVED this 9th day of December 2019. Steven J.
