13 - Seniority Pay for Sergeant, Lieutenant, Captain & Assistant ChiefItem No. 13 TO: City Council Gene Anderson, Interim City Manager FROM: Bob Hundley, Chief of Police SUBJECT: AMENDMENT TO CITY ORDINANCE 26-9 DATE: December 31, 2019 BACKGROUND: Under civil service, base pay for police officers is required to be the same amount. In 2004, seniority pay was granted by council action for police officers as an enticement for officers to remain with the department. The ordinance was last amended to provide additional service steps for increases. Seniority pay is the only option for any increase associated with time in grade to promote longevity in the department. When this ordinance was amended last year, there were plans to adjust supervisory pay in the next year's budget. STATUS OF ISSUE: The 2019-2020 Budget was approved with a compression of these steps to allow a supervisor to attain the maximum seniority pay at 12 years' service instead of 20 years by rank. This change will be effective for the payroll including January 1, 2019. BUDGET: The projected cost of $26,146.94 for this change was included in the 2019-2020 approved budget. RECOMMENDATION: Amend the ordinance to reflect the changes in the approved budget. c. 26-9. Seniority pay. Members of the police department below the rank of chief shall be entitled to receive seniority pay, on the basis of time in service and rank achieved, said seniority pay to be in addition to each officer's base pay as follows: (1) For all non -ranking officers, seniority pay shall be added to each officer's base pay, based on the following schedule of years in service to the city police department: a. Officers with two (2) years of service and less than four (4) years of service - Thirty-five dollars ($35.00) per pay period. b. Officers with four (4) years or more of service and less than six (6) years of service - Sixty-eight dollars and sixty-one cents ($68.61) per pay period. c. Officers with five (5) years or more of service and less than eight (8) years of service - Eighty-seven and eighty-five cents ($87.85) per pay period. d. Officers with eight (8) years or more of service and less than ten (10) years of service - One hundred forty-five dollars and fifty-four cents ($145.54) per pay period. e. Officers with ten (10) years or more of service and less than eleven (11) years of service - One hundred eighty-six dollars and sixty-eight cents ($186.68) per pay period. f. Officers with eleven (11) years or more of service - Two hundred twenty-five dollars ($225.00) per pay period. (2) All officers of the rank of sergeant, seniority pay shall be added to each sergeant's base pay, based on the following schedule of time of service in rank: a. For sergeants with less than two (2) years of service and not more than four (4) years - One hundred forty two dollars and twenty cents ($142.206) per pay period. For sergeants with four (4) and not more than eight (8) years of service - One hundred seventy three dollars and eight cents ($173.08) per pay period. C. For sergeants with eight (8) years of service - Two hundred ten dollars and twenty seven ($210.27) per pay period. (3) For Lieutenants, seniority pay shall be added to each lieutenant's base pay, based on the following schedule of time of service in rank: a. For Lieutenants with less than two (2) years of service and less than four (4) years of service - One hundred seventy-one dollars and fifty-four cents ($171.54) per pay period. b. For Lieutenants with four (4) years or more of service and less than eight (8) - Two hundred six dollars and sixty-eight cents ($208.68) per pay period. C. For Lieutenants with eight (8) years or more of service- Two hundred sixty four dollars and thirty five cents ($264.35) per pay period. (4) All officers of the rank of captain, seniority pay shall be added to each captain's base pay, based on the following schedule of time of service in rank: For Captains with less than two (2) years of service and not more than four (4) years of service - One hundred thirty nine and fifty-four cents ($139.54) per pay period. b. For Captains with four (4) years or more of service and less than eight (8) - Two hundred six dollars and sixty-eight cents ($208.68) per pay period. For lieutenants with four (8) years or more of service- Two hundred sixty four dollars and thirty five cents ($264.35) per pay period. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING SECTION 26-9, "SENIORITY PAY," OF CHAPTER 26, "POLICE," OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the employment of police officers in the City of Paris is governed by Chapter 143 of the Local Government Code which authorizes and governs dealing with Civil Service employment; and, WHEREAS, Section 143.021 of said Chapter 143 of the Local Government Code states that that the Civil Service Commission shall provide for the classification of all fire fighters and police officers and the municipal governing body shall establish the classifications of police officers by ordinance; and, WHEREAS, the City of Paris has established the classifications of police officers in Chapter 26 of the Code of Ordinances; and, WHEREAS, Section 143.041 of the Local Government Code further authorizes the governing body of a municipality to provide additional compensation to police officers based on longevity and/or seniority; and WHEREAS, in 2018, City council adopted additional service steps for increases in seniority pay for police officers to assist with recruitment and retention of officers; and WHEREAS, the Department continues to face challenges in officer recruitment and retention; and WHEREAS, the city Council wishes to adopt additional seniority pay for the ranks of sergeant, lieutenant, captain, and assistant chief, and WHEREAS, the City Council has approved seniority pay to allow officers in said ranks to attain the maximum seniority pay at eight (8) years' service in rank rather than at fifteen (15) years' service in rank as is currently provided for by Sec. 26-9 of the Code of Ordinances in order to assist the Department's efforts to recruit and retain officers; and WHEREAS, the City Council of the City of Paris approved a budget for FY 2018-2019 which included seniority pay for police officers employed by the City of Paris, Texas in the ranks of sergeant, lieutenant, captain, and assistant chief. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby Section 2. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 5. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. Section 2 of this ordinance shall become effective February 1, 2020. All other sections shall become effective immediately upon passage. PASSED AND ADOPTED this 13th day of January, 2020.
