1992-075-RES Joint 92-004 WHEREAS, interested in disadvantaged the City Council of the City providing educational services to RESOLUTION NO. 92-075 JOINT RESOLUTION NO. 92-004 WHEREAS, interested in disadvantaged the City Counc il of the City providing educational services to adults; and, of Paris, is educationally WHEREAS, the Paris Public Library will provide to Paris Junior College space adequate for instruction of students and will identify individuals who are 17 years of age or older, out-of-school, and desirous of adult basic education instruction and will schedule instruction during times that are most convenient for the participants and that will generate an appropriate level of participation; and, WHEREAS, the City Manager of the City of Paris did execute an Agreement for such Adult Education Cooperative Program with Paris Junior College, which execution should be in all things ratified; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the acceptance of the Agreement in the form attached hereto as Exhibit A is hereby ratified and the form of such Agreement is approved; and, BE IT FURTHER RESOLVED; that the execution of the Agreement to provide educational services to educationally disadvantaged adults, attached hereto as Exhibit A between Paris Junior College and the Paris Public Library, by the City Manager of the City of Paris, Michael E. Malone, on the 10th day of August, 1992, is hereby ratified. Passed and adopted this 14th day of September, 1992. ~s&: ATTEST: FORM: PARIS JUNIOR COLLEGE By .//j) t:l~/_ b;{ff^ ~on Wal , President AGREEMENT BETWEEN PARIS JUNIOR COLLEGE ADULT EDUCATION COOPERATIVE PROGRAM AND THE PARIS PUBLIC LIBRARY This Agreement is entered into this 1st day of July, 1992 by and between PARIS JUNIOR COLLEGE, hereinafter call PJC, and THE PARIS PUBLIC LIBRARY hereinafter called THE LIBRARY, to provide educational services to educationally disadvantaged adults as defined by Adult Basic Education Federal and State Funds Acts under the authority of the Texas Education Agency. WITNESSTH THAT WHEREAS, PJC desires to provide adult education instruction to educationally disadvantaged adults in its service area, and whereas THE LIBRARY desires to provide the services of identifying persons who will qualify under the Adult Basic Education Act for this service and provide space for such instruction, in consideration of the mutual promises herein contained, the parties hereto agree as follows: I. SCOPE OF SERVICES THE LIBRARY will provide to PJC during the term hereof the following services: SPACE adequate for instruction of students. It is agreed that availability of space will depend on the scheduling of normal LIBRARY events. IDENTIFICATION of individuals who are 17 years of age or older, out-of-school, and desire adult basic education instruction. II. TIME OF PERFORMANCE This agreement shall be for the grant period commencing on July 1, 1992, and continuing through June 30, 1993. III. COMPENSATION AND METHOD OF PAYMENT PJC will pay all eligible costs: I. Issue paYlent vamnts to the teacher of $9.00 per hour. 2. All necessary boots, supplies, etc., alloved uDder the specific 9rant(s). PJC will schedule instruction during times that are most convenient for the participants and that will generate an appropriate level of participation. EXHIBIT A The teacher(s) will provide PJC monthly attendance reports and will provide descriptive, statistical, financial, and evaluative reports as may be required by the Texas Education Agency and PJC. Monitoring, coordination and supervision of the program will be the responsibility of PJC for compliance with federal, state and local guidelines. staff will meet minimum qualifications and in-service training as required by PJC. All teachers and aides will be screened, selected, and employed by PJC with the mutual consent of THE LIBRARY. A written employment agreement will be signed by each staff person, the co-op director, and author i zed college personnel. V. FUNDING Notwi thstand ing anything provided to the contrary, it is expressly understood and agreed that the payments due and owing under this contract are limited and expressly subject to the availability and receipt of funds by PJC from the Texas Education Agency as designated for the aforementioned educational services to educationally disadvantaged persons. VI. MISCELLANEOUS During the term of this agreement, if THE LIBRARY becomes unable or fails to satisfactorily provide the services required of it under this agreement, PJC may at its option terminate this agreement with fifteen (15) days written notice. Neither this agreement nor any duties or obligations hereunder shall be assignable by either party without the prior written consent of the other party. The validity of this agreement and of any of its terms and provisions, as well as the rights and. duties of the parties hereunder, shall be governed by the laws of the state of Texas. THE LIBRARY certifies that this program will be conducted on its premise in accordance with all applicable Federal, state, and local laws and requirements. Executed this 10th day of AUQust , 1992.
