JOINT RESOLUTION NO. 92-003
WHEREAS,
interested in
disadvantaged
the City Council of the City of Paris, is
providing educational services to educationally
adults; and,
WHEREAS, the City will provide to Paris Junior College
space adequate for instruction of students and will identify
individuals who are 17 years of age or older, out-of-school,
and desirous of adult basic education instruction and will
schedule instruction for a minimum of 2 classroom hours per
week during times that are most convenient for the
participants and that will generate an appropriate level of
participation; and,
WHEREAS, the City Manager of the City of Paris did
execute an Agreement for such Adult Education Cooperative
Program with Paris Junior College, which execution should be
in all things ratified; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
That the acceptance of the Agreement

AGREEMENT BETWEEN
PARIS JUNIOR COLLEGE
ADULT EDUCATION COOPERATIVE PROGRAM
AND
THE CITY OF PARIS
This Agreement is entered into this 1st day of July, 1992 by
an between PARIS JUNIOR COLLEGE, hereinafter call PJC, and THE
CITY OF PARIS hereinafter called THE CITY, to provide educational
services to educationally disadvantaged adults as defined by
Adul t Bas ic Educat ion Federal and State Funds Acts under the
authority of the Texas Education Agency.
WITNESSTH THAT
WHEREAS, PJC desires to provide adult education instruction
to educationally disadvantaged adults in its service area, and
'whereas THE CITY desires to provide the services of identifying
persons who will qualify under the Adult Basic Education Act for
this service and provide space for such instruction, in
consideration of the mutual promises herein contained, the

II. TIME OF PERFORMANCE
This agreement shall be for the grant period commencing on
July 1, 1992, and continuing through June 30, 1993.
III. COMPENSATION AND METHOD OF PAYMENT

each staff person, the co-op director, and authorized college

V. FUNDING'
Notwithstanding anything provided to the contrary, it is
expressly understood and agreed that the payments due and owing
under this contract are limited 'and expressly subject to the
availability and receipt of funds by PJC from the Texas Education
Agency as designated for the aforementioned educational services
to educationally disadvantaged persons.
VI. MISCELLANEOUS
During the term of this agreement, if THE CITY becomes
unable or fails to satisfactorily provide the services required
of it under this agreement, PJC may at its option terminate this
agreement with fifteen (15) days written notice. Neither this
agreement nor any duties or obligations hereunder shall be
ass ignable by ei ther party wi thout the pr ior wr i tten consent of
the other party.
The validity of this agreement and of any of its terms and
provisions, as well as the rights and duties of the parties
hereunder, shall be governed by the laws of the state of Texas.
THE CITY certifies that this program will be conducted on
its premise in accordance with all applicable Federal, state, and
local laws and requirements.
