1991-036-RES WHEREAS, on November 23, 1970, the procured utility easement running north and 6A, City Block 123 RESOLUTION NO. 91-036 WHEREAS, on November 23, 1970, the procured utility easement running north and 6A, City Block 123 from Roy Moody Welch Welch for a sanitary sewer main; and, City of Paris south across Lot and wife Lillian WHEREAS, on February 12, 1991, a new easement has been procured from Roy Moody Welch and wife Lillian Welch across said property and the original utility easement is no longer needed by the City of Paris and same should be abandoned; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the Release and Quitclaim giving the original easement on Lot 6A, City Block 123, back to Roy Moody Welch and wife Lillian Welch, in the form attached hereto as Exhibit A, be and is hereby approved. BE IT FURTHER RESOLVED, that the Mayor of the City of Paris, Eric S. Clifford, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the Release and Quitclaim in the form attached hereto as Exhibit A. Clifford, its Mayor, in consideration of the granting of Utility Easement dated February 12, 1991, recorded in Book 204, Page 194, Real Property Records, Lamar County, Texas, the receipt of which is hereby acknowledged by the City of Paris, does hereby abandon and quitclaim unto Roy Moody Welch, and wife, Lillian Welch, of the county of Lamar, state of Texas, on April 8, 1991, and to their heirs, devisees, or assigns, all the right, title, interest, claim, demand or use the city may have acquired by a certain Easement dated November 23, 1970, wherein Roy Moody Welch and wife, Lillian Welch did grant a Sanitary Sewer Easement for a sanitary sewer main under the hereinafter described premises, which was recorded in Book 521, Page 284, Deed Records, Lamar County, Texas, being a part of Lot 6A, City Block 123, Paris, Texas, more particularly described as follows: Being a strip of land 15 feet in width, located within the corporate limits of the City of Paris and designated as a part of Lot 6A, Block 123, according to the Tax Maps of the City of Paris, and also being a part of a tract of land conveyed to Roy Moody Welch and Lillian Welch, by Ben Taack and Imogene Taack, a description of said tract being recorded in Volume 417, Page 389, Deed Records of Lamar County, and more particularly described as follows: BEGINNING at a point in the North Boundary Line of Grand Avenue, said point being East a distance of 224.5 feet from the East Boundary Line of 7th Street S .W., said point is the Southwest corner of the strip described; THENCE North parallel to the West Boundary Line of Taack Tract 80 feet more or less to a point 14.5 feet East of the Northwest Corner of the Taack Tract; THENCE Eas t wi th the Nor th Boundary Line of the Taack Tract a distance of 15 feet to a point; THENCE South parallel to the West Boundary Line of the Taack Tract 80 feet mOre or less to a point in the WITNESS, its hand at Paris, Texas, this 8th day of April, 1991.
