1991-126-RES WHEREAS, the Housing Authority of the City of Paris, Texas, is desirous of locating a residential housing ,~ ',--~ RESOLUTION NO. 91-126 WHEREAS, the Housing Authority of the City of Paris, Texas, is desirous of locating a residential housing facility at 2452 East Price Street; and, WHEREAS, to properly develop said site, utilities and drainage could best be constructed from the south end of said lot westerly to and across Lot 9, City Block 222-A owned by the City of Paris to connect with existing sewer and drainage utility facilities existing upon said lot; and, WHEREAS, in keeping with the City of Paris' cooperative attitude toward the development of the aforesaid site, it would be right and proper for the City of Paris to grant to the Hous ing Author i ty of the City of Par is, a ut ili ty and drainage easement in the form of Exhibit A attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the Utility and Drainage to the Hous ing Author i ty of hereby approved; and, Easement from the City of Paris the City of Paris, Texas, is BE IT FURTHER RESOLVED, that the Mayor of the City of Paris, George Fisher, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the Utility and Drainage Easement in the form of Exhibit A attached hereto. O. Box 688, Paris, Texas 75461, a Utility and Drainage easement for the purpose of constructing and maintaining a permanent sanitary sewer line and a permanent storm sewer line in, under, along, upon, and across the property being described as follows: All that certain tract or parcel of land situated in the City of Paris, Lamar County, Texas, being a portion of the George W. Cox Survey, Abstract No. 164, and being out of Block 222-A of said City, and being out of that lot described in deed from J. K. Guest, Jr., et al to the City of Paris, Paris, Texas, recorded in Volume 652, Page 408, of the Deed Records of said County, and bounded as follows: BEGINNING at a 3/8-inch steel rod found at the nor theas t corner of the Ci ty of Par is lot, same being the northwest corner of a lot described in deed from Ella Bee Crews to Ralph Crews recorded in Volume 689, Page 946 of the Deed Records of said County, and being the southeast corner of a lot described in deed from Vallas C. Brown, et ux to Murill Allen, et ux, recorded in Volume 617, Page 854 of the Deed Records of said County, and also being the southwest corner of a lot owned by Lee Ford; THENCE South 0 Deg. 26 Min. 20 Sec. the east boundary line of the City of same being the west boundary line of Crews lot, 15.0 feet to a corner; THENCE North 88 Deg. 59 Min. 00 Sec. East with of Paris lot, of the Murill of beginning, (3153 square unto Housing Author i ty of the Ci ty of Par is, Texas, for the purposes aforesaid, with the right and privilege at any and all times to enter said premises, or any part thereof, and maintaining any and all utility and drainage facilities placed therein; provided that Grantee will, after doing any work in connection with the construction, reconstruction, relocating or maintenance of said utility and drainage facilities, restore the surface to the condition to which said surface was found when such work was undertaken insofar as permitted under the plans and specifications approved for projects to be located within the herein described easement, and that in the use of said rights and privileges herein granted Housing Authority of the City of Paris, Texas, will not create a nuisance or do any act that will be detrimental to said premises. Grantor does hereby bind itself, its successors and assigns, to warrant and forever defend, all and singular, said premises unto the Housing Authority of the City of Paris, Texas, against every person whomsoever lawfully claiming or to claim the same or any part thereof.
