1991-111-RES WHEREAS, on August 27, 1968, a Sewer Line Easement was conveyed from Hal C. Ransom and wife,
RESOLUTION NO. 91-111
WHEREAS, on August 27, 1968, a Sewer Line Easement was
conveyed from Hal C. Ransom and wife, Lynn J. Ransom to Henry
Braswell and wife, Rachel Braswell and filed in Lamar County
Deed Records; and,
WHEREAS, Mr. and Mrs. Henry Braswell are no longer
desirous of holding said easement and have requested the City
Council of the City of Paris to approve the execution of an
assignment of the Sewer Line Easement to the City of Paris;
and,
WHEREAS, the City Council is desirous of obtaining said
easement for utility purposes; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
that the assignment of the Sewer Line Easement from Henry
Braswell and wife, Rachel Braswell to the City of Paris is
hereby approved; and,
BE IT FURTHER RESOLVED, that the Mayor of the City of
Par is, George Fisher, be, and he is hereby author ized and
directed to execute on behalf of the City of Paris the
Assignment in the form of Exhibit A attached hereto.

THAT we, HENRY BRASWELL and wife, RACHEL BRASWELL,
hereinafter called ASSIGNOR, for consideration of the
assumption of the ASSIGNOR'S obligations under the assumed
casement does hereby bargain, sell and assign to the City of
Paris, a municipal corporation, hereinafter called ASSIGNEE,
all our right, title and interest in and to that certain
Sewer Line Easement between Henry Braswell and wife, Rachel
Braswell and Hal C. Ransom and wife, Lynn J. Ransom, dated
February 22, 1968, recorded on August 27, 1968, in Volume
477, Page 192, Lamar County Deed Records. ASSIGNEE will be
responsible for all terms and conditions stated in said
assumed Sewer Line Easement attached hereto as Exhibit A.

That we, Hal C. Ransom and wife, Lynn J. Ransom of the
County of Lamar, State of Texas, for and in consideration of
ONE AND NO/lOa ($1.00) DOLLAR cash and other good and valuable
consideration to us in hand paid by the Grantees named herein,

receipt of which is hereby acknowledged, hereby sell, give and
grant unto Henry Braswell and wife, Rachel Braswell of Lamar
County, Texas, their heirs and assigns, the right to maintain,
use and repair a sewer line for the purpose of serving any dwell-
ing house or houses erected or to be erected within 250 feet of
Audubon Road on the lands presently owned by the Grantees herein,
such sewer line to be upon and across the following described
property in the County of Lamar, State of Texas, to-wit:
A part of the Joseph Leach Survey within the
corporate limits of the City of Paris, being a por-
tion of the 3.884 acre tract of land conveyed by Henry
Braswell and wife, Rachel Braswell, to Hal C. Ransom
and wife, Lynn J. Ransom, by deed recorded in Book
414, Page 116, Deed Records of Lamar County, Texas,
and being a strip of land 10 feet in width 5 feet each
side of center line, said center line being more parti-
cularly described as follows:
BEGINNING at a point in the EBL of said 3.884
acre tract of land conveyed to Hal. C. Ransom and wife,
Lynn J. Ransom, said point being 5 feet North of the
Southeast corner of said 3.884 acre tract and the NBL
of Audubon Road;
THENCE West a distance of 110 feet on a line
parallel to and 5 feet North of the SBL of said 3.884
acre tract and the NBL of Audubon Road to a point in
the WBL of said 3.884 acre tract, which point is 5
feet North of the Easternmost Southwest corner of
said 3.884 acre tract and the NBL of Audubon Road.
TO ~~VE AND TO HOLD the above described property unto
the said Henry Braswell and wife, Rachel Braswell, their heirs,
personal representatives and assigns for the purposes herein
stated, and subject only to the following terms and conditions:
I 1. The easement granted hereby shall automatically
terminate in the event of the termination of the Sewer Line Ease-
I ment granted in the easement from Julian L. Jopling and wife,
I Anna H. Jopling to Henry Braswell dated April 15, 1964 recorded
in Book 414, Page 113, Deed Records of Lamar County, Texas.
2, In the event the sewer line provided for by this

described sewer line becomes stopped up or in need of repair
West of the point where the sewer line from the Ransom house
joins said sewer line, the Grantees herein shall bear the entire
I cost of correcting such situation, and the Grantees, their heirs I
I and assigns, shall have the right to go on the premises and repair I'
or unstop same, but shall at their own cost restore the premises,
including the surface, fences, drive-ways and other improvements I
on the premises, to the same condition which they were in when I
such work was undertaken. !
3. The Grantors hereby r~tain and they, their heirs
and assigns, shall have the right to use the sewer line provided
for in this easement as fully as the Grantees, their heirs and
assigns.
