1991-102-RES WHEREAS, on July 11, 1991 the City of Paris procured a drainage and utility easement along the south RESOLUTION NO. 91-102 WHEREAS, on July 11, 1991 the City of Paris procured a drainage and utility easement along the south side of Lot ll-D, City Block 316, dedicated to the Public by Earnest W. Cochran, II and Merrick H. Reese in REPLAT LOT 11 CITY BLOCK 316 dated June 30, 1991, accepted by the City of Paris on July 11, 1991, which replat was recorded on September 10, 1991, in Envelope 304B, Plat Records, Lamar County, Texas; and, WHEREAS, the City of Paris and the public at large have no further need for the part of drainage and utility easement described in the Partial Release and Quitclaim of Drainage and Utility Easement attached hereto as Exhibit A and the same should be abandoned and quitclaimed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the Partial Release and Quitclaim of Drainage and Utility Easement abandoning a part of the easement along the south side of Lot I1-D, City Block 316, allowing the same to revert to Earnest W. Cochran, II and Merrick H. Reese, in the form attached hereto as Exhibit A, be and the same is hereby approved; and, BE IT FURTHER RESOLVED, that the Mayor of the City of Paris, George Fisher, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the Partial Release and Quitclaim of Drainage and Utility Easement in the form attached hereto as Exhibit A. Cochran, II of the County of Lamar, and Merrick H. Reese, of the County of Dallas, State of Texas, the receipt and sufficiency of which is hereby acknowledged, has abandoned and qu i tc laimed, and by these presents do quitclaim, a part of the drainage and utility easement along the south side of Lot II-D, City Block 316 hereinafter more particularly described unto the said Earnest W. Cochran, II and Merrick H. Reese, all of its right, title, interest, claim and demand in and to a part of that certain drainage and utility easement dedicated to the Public by Earnest W. Cochran, II and Merrick H. Reese, in REPLAT LOT 11 CITY BLOCK 316, dated June 30, 1991, accepted by the City of Paris on the 11th day of July, 1991,' which replat was recorded on September 10, 1991, in Envelope 304B, Plat Records, Lamar County, Texas, situated within the corporate limits of the, City of Paris, Lamar County, Texas, described as follows: BEING a drainage and utility easement situated in the Ci ty of Par is, Lamar County, Texas, wi th in the Joseph Leach Survey, Abstract No. 524 and being part of that certain drainage and utility easement adjacent to the South Boundary Line of Lot ll-D, City Block 316 dedicated to the Public by Earnest W. Cochran, II and Merrick H. Reese, in REPLAT LOT 11 CITY I!.L<~CK 316, . THENCE North 00010'27" East, a distance of 5.0 feet to a point; THENCE North 89049'33" West, a distance of 297.61 feet to a point; THENCE North 00010'27" East a distance of feet to a point in the North Boundary Line aforesaid drainage and utility easement; THENCE South 89049' 33" East with said North boundary line line a distance of 505.94 feet to a point, said point being the most Southerly Northeast corner of said easement within Lot ll-D, City Block 316; THENCE South 60000'00" East a distance of 30.16 feet to the PLACE OF BEGINNING and containing 0.154 acre. 10.00 of the with all and singular its right, title, interest, estate, claim and demand in and to the hereditaments and appurtenances thereto belonging or in any wise pertaining; to have and to hold the above released, abandoned and quitclaimed rights, titles, interests, claims, and demand, to the said Earnest W. Reese, their heirs and assigns, forever, so that neither it nor its successors, legal representatives or assigns shall have any right or title to or interest in such easement, or any part thereof, at any time hereafter.
