1991-091-RES WHEREAS, the City Council of the City of Paris did heretofore in Resolution No. 89-026, on March 13, RESOLUTION NO. 91-091 WHEREAS, the City Council of the City of Paris did heretofore in Resolution No. 89-026, on March 13, 1989, authorize the execution of Quit Claim Deeds to owners of property adjacent to an alley running approximately midway between Margaret Street and Hubbard Street running East from 17th Street S.E. to a point approximately 186 feet west of 19th Street S.E. where it forms a "T" to intersect with Margaret and Hubbard Streets; and, WHEREAS, one of the property owners appearing on the tax rolls as Oney H. Miller had theretofore conveyed Lot 8 and part of Lot 9, Block 2, Anita Park Addition to Pauline Joel HacDowell and a Quit Claim Deed to one-half of the alley adjacent to said lot was prepared and executed, but not delivered to Oney H. Miller; and, WHEREAS, the City of Paris policy with regard to these matters has changed in that the City now conveys closed streets and alleys by use of a Special Warranty Deed as opposed to Quit Claim Deeds and it was appropriate for the Mayor of the City of Paris to execute a Special Warranty Deed for that portion of said closed alley to the current owner, Pauline Joel MacDowell, a copy of which is attached hereto as Exhibit "A"; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the action of the Mayor of the City of Paris, George Fisher, in executing the Special Warranty Deed from the City of Paris to Pauline Joel MacDowell conveying one-half of the alley adjacent to Lot 8 and part of Lot 9, Block 2, Anita Park Addition, which is more particularly described in the coP,y of said Special Warranty Deed attached hereto as Exhibit "A', should be and the same is hereby ratified. SAVE AND EXCEPT a utility easement is retained by Grantor to the above described property, which utility easement gives the right and privilege to Grantor of placing utilities above, on and over said easement and the right to maintain any and all utilities placed therein.
