1. The Board of Adjustment meeting was called to order by David Hamilton,
Chairman at 12:14 p.m.
The following members were present online via www.zoom.us: David
Hamilton, Brady Fisher, Ruth Ann Alsobrook and Jerry Haning.
Also present was John Ankrum and Carla Easton.
2. Approval of minutes from previous meeting. (February 4, 2020)
Motion was made by Ruth Ann Alsobrook, seconded by David Hamilton to approve
minutes for the February 41, 2020 meeting. Motion carried 4:0.
3. Public hearing to consider and take action on the petition of Amira Sadik
Vartanian on Lot 11, City Block 70-C, being located at 1323 Pine Bluff.
The petition requested a variance of Section 11.5-3 (b)(1)(a) of the Fence
Ordinance which is as follows:
(1) Front yard fence requirements.
a. No fence shall be permitted in the front yard with the following exceptions:
i. On lots zoned historic overlay district (HD) and in accordance with the
design standards adopted by the historic preservation commission.
ii. On lots in excess of two (2) acres in size which are used for single-family
residential purposes.
iii. On lots which are zoned and used for LI or HI purposes.
The applicant is requesting a variance to have a front yard fence for a lot that is not
in the historical district nor does it exceed 2 acres.
Public hearing was declared open.
John Ankrum, City Building official, presented the case on behalf of the applicant
to the Board speaking neither in favor nor against the variance.
No one else spoke in favor or opposition.
Public hearing was declared closed.
Ruth Ann Alsobrook, spoke in favor of the fence stating that there are similar fences
on the same street already so she is not opposed.
Jerry Haning, spoke in favor of the fence but wanted to ensure that the proper steps
would be taken so that the fence did not cross any neighboring property lines.
Motion was made by Brady Fisher, seconded by Ruth Ann Alsobrook to approve the
variance to Section 11.5-3(b)(1)(a) of the Zoning Ordinance. Motion carried 4:0.
4. Public hearing to consider and take action on the petition of Raymond Jones
on lot PT of 6-7-8, City Block 4, being located at 2830 E Cherry Street.
The petition requested variances of Section 9-200 Area Regulation of the
Zoning Ordinance 1710, which provides as follows:
(1) 9-201 (1) Schedule minimum lot widths -Residential districts
SF -2 Zoning requires single family a minimum of 60' lot width
The applicant is requesting a variance of 9' to reduce the required lot width from 60'
to 51' to at 2830 E Cherry.
Public hearing was declared open.
John Ankrum, City Building official, presented the case on behalf of the applicant
to the Board speaking in favor of the variance and stating that the lot is a lot of record
that has previously had a house on it without being platted, but will be required to
have the lot platted before he can build.
No one else spoke in favor or opposition.
Public hearing was declared closed.
Ruth Ann Alsobrook, spoke in favor of the variance stating that building on the lot
will improve its value and generate tax revenue for the city.
Motion was made by Ruth Ann Alsobrook, seconded by Brady Fisher to approve the
variance to Section 9-200 of the Zoning Ordinance. Motion carried 4:0.
5. Meeting adjourned 12:23 p.m.
