SUBJECT: APPOINTMENTS TO THE BOARD OF ADJUSTMENT
DATE: June 22, 2020
BACKGROUND: The Board of Adjustment is created by State Law and codified under Section
16-100 of the City Zoning Ordinance. This Section states in part: "there is hereby created a
Board of Adjustment consisting of five (5) members, each to be appointed by resolution of the
City Council for a term of two years." The City Council may appoint two alternate members of
the Board of Adjustment who shall serve in the absence of one or more of the regular members
when requested to do so by the Mayor or City Manager.
STATUS OF ISSUE: Currently the terms of the three of the regular board members are expiring
on June 30. There is also a vacant alternate position which needs to be filled. We have received
applications from the following: Chris Fitzgerald, Jerry Harting and William Sanders.
BUDGET: N/A
RECOMMENDATION: Approve a Resolution re -appointing Chris Fitzgerald and Jerry Harting
to the Board, and appointing William Sanders to the Board.
RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
APPOINTING MEMBERS TO FILL THREE REGULAR MEMBERS EXPIRED
TERMS IN ACCORDANCE WITH SECTION 16 OF THE CITY ZONING
ORDINANCE AND THE CITY'S POLICIES AND PROCEDURES FOR
STANDING BOARDS, COMMISSIONS AND COMMITTEES; REAPPOINTING
CHRIS FITZGERALD AND JERRY HAVING TO SERVE AS REGULAR
MEMBERS FOR TWO YEAR TERMS AND APPOINTING WILLIAM SANDERS
TO SERVE AS A REGULAR MEMBER FOR A TWO YEAR TERM; MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 16-100 of the City of Paris, Texas Zoning Ordinance No. 1710
states in part that the Board of Adjustment shall consist of five (5) members, each to be
appointed by Resolution of the City council for a term of two years and two (2) alternate
members for a term of two years; and
WHEREAS, currently the Board of Adjustment has three members with terms that
will expire on June 30, 2020, creating three vacancies; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in
all things approved.
Section 2. That the following appointments are hereby made to the Board of
Adjustment: reappoint Chris Fitzgerald and Jerry Haning to serve as regular members for
two year terms. Appoint William Sanders to serve as a regular member for a two year term.
Section 3. That this resolution shall be effective from and after its date of passage.
