1991-001-RES WHEREAS, the City Council of the City of Paris did heretofore on the 15th day of October, 1990, pass RESOLUTI ON NO. 91-001 WHEREAS, the City Council of the City of Paris did heretofore on the 15th day of October, 1990, pass Resolution No. 90-088, which said resolution was incorrect and requires correction; and, WHEREAS, the City Council of the City of Paris did heretofore on the 12th day of November, 1990, pass Resolution No. 90-095, which said resolution requires amendment due to the fact that the presiding judge for District Seven is unavailable to perform her duties and must be replaced in order that the election may be orderly conducted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That Resolution Nos. 90-088 and 90-095, be, and the same are hereby amended to read as follows: "A RESOLUTION ORDERING A SPECIAL ELECTION TO BE HELD ON THE THIRD SATURDAY IN JANUARY, 1991, SAME BEING THE 19TH DAY OF JANUARY, 1991, BETWEEN THE HOURS OF 7:00 O'CLOCK A.M. AND 7:00 O'CLOCK P.M., BY THE QUALIFIED VOTERS OF THE CITY OF PARIS, PARIS, TEXAS, FOR THE PURPOSE OF AUTHORIZING THE IMPOSITION OF SALES AND USE TAX UNDER SECTION 4A OF ARTICLE 5190.6 of VERNON'S ANNOTATED TEXAS STATUTES WHICH WOULD ASSESS AN ADDITIONAL ONE-HALF OF 1% SALES AND USE TAX WITHIN THE CORPORATE LIMITS OF THE CITY OF PARIS, WHICH WOULD FUND A CORPORATION TO CARRY OUT INDUSTRIAL DEVELOPMENT PROGRAMS AS PERMITTED BY LAW. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That a special election be held by the qualified voters of the City of Paris, Paris, Texas, on the th i rd Sa turday in January, 1991, same be ing the 19th day of January, 1991, between the hours of 7:00 o'clock A.M. and 7:00 o'clock P.M., for the purpose of authorizing the imposition of sales and use tax under Section 4A of Article 5190.6 of Vernon's Annotated Texas Statutes which would assess an additional one-half of 1% Sales and Use Tax within the Corporate Limits Of The City of Paris, which would fund a corporation to carry out industrial development programs as permitted by law, no more than 1010 of the revenue of which may be spent for promotional purposes, which corporation may not undertake a project the primary purpose of which is to provide transportation facilities, sewage or solid waste disposal facilities, air or water pollution control facilities or facilities for furnishing water to the general public. Section 2. That the polling places and election officials of such election shall be as follows: DISTRICT ONE (1): Polling Place: T. G. Givens School 655 Martin Luther King, Jr. Drive DISTRICT THREE (3): Polling Place: Thomas S. Justiss School 401 - 18th Street N.W. Officials: Tina Prunty, Presiding Judge Betty Anderson, Alternate Presiding Judge DISTRICT FOUR (4): Polling Place: Paris Police Department 811 Bonham Street Officials: Ruth E. Welch, Presiding Judge Mary Bailey, Alternate Presiding Judge DISTRICT FIVE (5): Polling Place: City Hall Annex West 150 First Street S.E. Officials: Reinhardt Hollje, Presiding Judge Greg Hollje, Alternate Presiding Judge DISTRICT SIX (6): Polling Place: Crockett Middle School 655 South Collegiate Drive Officials: Martha E. (Sunny) Thomas, Presiding Judge W. J. Thomas, Alternate Presiding Judge DISTRICT SEVEN (7): Polling Place: Aikin Elementary School 3100 Pine Mill Road Officials: Mary Jo Coleman, Presiding Judge Kay Crowell, Alternate Presiding Judge Section 3. The Presiding Judge of the respective voting boxes shall designate and appoint at least two (2) and not more than four (4) competent and qualified clerks for such respective polling places and voting boxes as may be required for the efficient conduct of said election. Section 4. That absentee voting for the election described in Section I above shall be conducted under the direction of the City Clerk by herself and her deputies as ordered in separate order herefrom, beginning on the 31st day of December, 1990, through the 15th day of January, 1991, Monday through Friday, between the hours of 8:00 o'clock A.M. and 5:00 o'clock P.M. Section 5. That the officials for absentee voting follows: polling place and election of said election shall be as Section 6. There is hereby created an absentee ballot board wh ich cons i s t of the pres id ing judge, the al ternate presiding judge, appointed in section 5 above, and at least two other members to be appointed by said presiding judge. The absentee ballot board shall carry out the duties enumerated in Chapter 87 of the Election Code of the State of Texas. Section 7. Such election shall be held in accordance with the laws of the State of Texas governing general and municipal elections, insofar as the same may be applicable, and with the provisions of the City Charter and Ordinances of the City of Paris, wherein such laws and ordinances do not conflict with the above described Order. Section 8. The Chief of Police of the City of Paris is hereby directed and instructed to post a properly executed Notice of Election pursuant to this order of election, signed by the Mayor of the City of Par is and attes ted by the City Clerk, on the bulletin board in the City Clerk's Office, on the board provided for notice at the City Hall Door, at each of the poling places designated above, which are within each ward in which the election is to be held, at least twenty (20) days before the election; further, a properly executed copy of such Notice of Election shall be published at least one time not more than twenty-five (25) days nor less than ten (10) days before the election in at least one daily newspaper published in the City of Paris, and a copy of the notice shall be filed with the City Clerk of the City of Paris, together with the posting officer's return and the newspaper certificate of publication. Section 9. The pay of the judges and clerks of said election is hereby authorized and established as follows: $5.00 per hour for each judge and clerk; the election judge who delivers the returns of said election immediately after the votes have been counted to the proper office shall be paid an additional sum of $25.00 for that service, provided also, he shall make return of all election supplies not used when he makes returns of such election."
