SUBJECT: COX FIELD AGRICULTURAL LEASE EXTENSION
DATE: July 13, 2020
BACKGROtTND: We entered into a five-year lease with Carey Eatherly & Ryan Eatherly
beginning January 1, 2016 and terminating December 31, 2020. The purpose of this lease was to
provide for the Eatherlys, adjacent ranchers, to bale hay on airport property and to provide some
mowing. The lease agreement allows for an extension of an additional five (5) year period,
provided all requirements of the lease have been met and the Tenant notifies the city of their
desire to extend the lease by no later than June 30, 2020.
STATUS OF ISSUE- On June 26, 2020, the Eatherlys notified the City that they desire to
extend the current lease agreement for an additional five years. I have confirmed with city staff
member Lance Nicholson and airport manager Jerry Richey that the Eatherlys have in fact
complied with the terms of the lease agreement.
BUDGET: Will save the City money for mowing.
RECOMMENDATION: Approve a Resolution extending the agricultural lease agreement with
Carey Eatherly and Ryan Eatherly.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TEXAS, THAT:
Section 1e The findings set out in the preamble to this resolution are hereby in
all things approved.
Section The Lease Extension Agreement between the City of Paris and Carey
atherly, a copy of which is attached hereto as Exhibit A, be, and the same is hereby
approved.
Section 3. The City Manager of the City of Paris be, and is hereby authorized to

EXTENSION OF LEASE

KNOW ALL MEN BY THESE PRESENTS
WHEREAS, Carey Eatherly and Ryan Eatherly of Paris, Lamar County, Texas
enjoy an existing agricultural lease agreement with the City of Paris for approximately
350 tillable acres of land in and around the runways and taxiways of Cox Field,
utilized solely for growing hay; and
WHEREAS, Carey Eatherly and Ryan Eatherly's current lease was for a period
of five (5) years, beginning January 1, 2016 and ending December 31, 2020; and
WHEREAS, Carey Eatherly and Ryan Eatherly desire to extend their lease for
an additional five (5) years effective January 1, 2021 to December 31, 2025; and
WHEREAS, the city council of the City of Paris, acting in open session on July
13, 2020, approved a five (5) year lease extension, retaining all other requirements
of the current lease, and authorized its City Manager to execute said lease extension;
This EXTENSION OF LEASE is hereby made by and between the City of Paris,
Texas, a home rule municipal corporation, and Carey Eatherly and Ryan Eatherly of
Paris, Lamar County, Texas.
