1990-075-RES WHEREAS, the City Council of the City of Paris did in Resolution No. 86-005 on January 13, 1986, approve RESOLUTION NO. 90-075 WHEREAS, the City Council of the City of Paris did in Resolution No. 86-005 on January 13, 1986, approve an agreement of cooperation with L. P. McCuistion Community Hospital, d/b/a/ McCuistion Regional Medical Center and St. Joseph's Hospital to receive medical supervision and training for the Emergency Medical Service Division of the City of Paris; and, WHEREAS, it is deemed to be desirable to provide for inhouse recertification for basic and advanced level certification training utilizing State Department of Health approved EMS Training Coordinator and it is necessary to have clinical training provided in a hospital setting; and, WHEREAS, the previous agreement should be amended to provide for inhouse training agreements in the form of Amended Agreement attached hereto as Exhibit A, and such form should be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the Mayor of the City of Paris, Eric S. Clifford, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the Amended Agreement with L. P. McCuistion Community Hospital, d/b/a McCuistion Regional Medical Center and St. Joseph's Hospital upon the terms and conditions and in the form shown in Exhibit A attached hereto. Eric ATTEST: Mattie Cunningham, , City Attorney AMENDED AGREEMENT THIS AMENDED AGREEMENT entered into this the 10th day of September, 1990, between the CITY OF PARIS, hereinafter referred to as "City", L. P. McCUISTION COMMUNITY HOSPITAL, d/b/a McCUISTION REGIONAL MEDICAL CENTER of Paris, Texas, and ST. JOSEPH'S HOSPITAL AND HEALTH CENTER of Paris, Texas, hereinafter collectively referred to as "Hospi tal", whether one or more. WITNESSETH: WHEREAS, it is agreed by the aforesaid parties to be of mutual interest and advantage to the public that an ambulance of the City with employees of City attendant thereon be located at each of said Hospitals with the said employees of City exposed to a hospital environment and gain practical experience in emergency room care; and WHEREAS, the City on this date authorizes the execution of a Contract to cover such services, THEREFORE, the City on this date effects the fOllowing affiliation with the Hospital to place an ambulance at each Hospital's facility with City employees to operate same upon the following terms and conditions: Specific Responsibilities of City of Paris 1. It shall be the responsibility of City to furnish ambulances and equipment and supplies and maintain same. 2. The City will schedule employees to operate the ambulances, pay said employees and said employees will be under direction and control of the City. 3. City will establish job requirements for said employees and their mRnnpr ()f rnnf'111f"f- Specific Responsibilities of Hospital 1. Full cooperation on the part of Hospital to help insure the success of the program. 2. Furnish space for parking ambulances furnished by City at or near the ambulance or its emergency entrance. 3. As much cl in ical exper ience as poss i ble for the City employees in connection with Hospital's Emergency Department and care of patients therein, said employees to remain in the emergency department area at all times and to be free to leave at any time they are dispatched by the City to carry out their ambulance service. 4. Permit the employees of the City to remain in the vicinity of its emergency department while on active duty and to provide sleeping facilities at the hospital while on stand-by duty. Joint Responsibilities 1. There shall be special programs and projects from time to time to further the education of the employees but these shall be agreed upon by all parties. The City of Paris will provide a State Department of Health approved EMS training coordinator to provide for in-house recertification and basic or advanced level certification training of other City employees and other persons who are approved by the City of Paris to become Emergency Technicians. Upon joint approval of course agreements, the Hospital agrees to provide clinical training for each course. This agreement will outline the specifics of the training required by the State Department of Health, EMS Division and would be provided 3. Hospital will have the right to stop any employee from carrying out an act at Hospital or on its environs that it deems inappropriate. 4. An employee of City who sustains an injury in carrying out duties assigned to employee under this Agreement shall have the same rights and obligations under the City's employment policies and Workers' Compensation policies as an employee of the City injured in any other location. 5. Any employee of the City assigned to carry out duties under this Agreement will be reassigned by City upon request by Administrator of Hospital. 6. City shall have the responsibility of keeping hours worked of employees assigned under this Agreement. 7. City shall hold harmless Hospital from liability for money damages for property damage or personal injuries or death when approximately caused by the negligence or wrongful act or omission of any City employee acting within the scope of his employment. 8. This Agreement may be cancelled by any party at any time upon ninety (90) days written notice to the other party. 9. The present method of determining which hospital an ambulance patient shall be delivered will continue during the term of this Agreement. 10. By execution of this Agreement, neither Hospital hereby assumes any responsibility for the operation of the ambulance service nor does either Hospital desire to enter into the operation of an ambulance service. 11.
