A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
APPROVING AND AUTHORIZING THE DESIGNATION OF A HAZARDOUS
MATERIALS ROUTE THROUGH THE CITY OF PARIS ALONG LOOP 286;
MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City of Paris has a system of public streets through our city that
accommodate local, regional, and interstate travel and commerce; and,
WHEREAS, to enhance the safety of our residents, it is important to keep large
trucks carrying hazardous cargo out of the center of town where residents live, work and
play; and
WHEREAS, TxDOT and the Federal Highway Administration allow municipalities to
request the designation of a hazardous cargo route within their jurisdiction in order to
limit exposure of the community to hazardous materials including explosives, gases, toxic
materials, infectious substances and corrosive and radioactive materials; and
WHEREAS, City Staff proposes to designate Loop 286 as more fully described and
depicted in Exhibit "A"., as the specified route for transporting all hazardous goods through
the city limits, allowing emergency preparedness and faster response times to any spill
incident by keeping the locations to the outer loop, where exposure is reduced and access
can be easily provided; and
WHEREAS, this designation will allow larger signage along the incoming highways
that will direct truck traffic along Loop 286 rather than through town; and
WHEREAS, it is deemed to be in the best interest of the City of Paris that the City
to formally request Non -radioactive Hazardous Materials (NRHM) route along Loop 286;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby
in all things approved.
Section 2. That the City is hereby formally requests Loop 286, as more fully
described and depicted in EXhMt "W., as the specified NRHM route for transporting all
hazardous goods through the city limits.
Section 3. That this resolution shall be effective from and after the date of
passage.

Introduction
The transport of hazardous materials through densely populated areas presents potential
dangers and unintended consequences to a community. These dangers can pose great risk
unless the community is prepared for action. Limiting public exposure, planning proper
emergency response, implementing containment methods, and organizing clean up after an
unfortunate event involving hazardous materials is crucial to minimizing these risks.
In an effort to reduce the risk of exposure to hazardous materials resulting from a crash
involving trucks carrying Non -radioactive Hazardous Materials (NRHM), the US Department of
Transportation's Federal Highway Administration (FHWA) implemented regulations in 1985 that
limit the through -routing movement of commercial vehicles carrying non -radioactive materials
classified as hazardous, such as petrochemicals, gases, and corrosive substances, to designated
highways or routes. The regulation requires each state to designate NRHM routes within their
jurisdictions. In Texas, the Department of Transportation delegates the authority to complete
the FHWA prescribed process of designating specific highways as NRHM routes to local
municipalities who also have the legal authority to enforce the use of these routes through
municipal ordinances.
Therefore, the City of Paris, Texas (City), proposes a NRHM route designation along Loop 286 for
all trucks carrying hazardous materials through its city limits. The purpose of this report is to
summarize the steps taken in consideration of this proposal and to justify the designation of
Loop 286 as the local NRHM route.
II. Hazardous Materials Definition
Hazardous material means a substance or material that the Secretary of Transportation has
determined is capable of posing an unreasonable risk to health, safety, and property when
transported in commerce, and has been designated as hazardous under Federal hazardous
materials transportation law (49 CFR, Subtitle III, Chpt. 51, Sec. 5103) (including an explosive,
radioactive material, infectious substance, flammable or combustible liquid, solid, or gas, toxic,
oxidizing, or corrosive material, and compressed gas) . The term includes hazardous substances,
hazardous wastes, marine pollutants, elevated temperature materials, materials designated as
hazardous in the Hazardous Materials Table (49 CFR, Subtitle B, Chpt. 1, Subchpt. A, Part
172.101, pages 132-300), and materials that meet the defining criteria for hazard classes and
divisions in part (49 CFR, Subtitle B, Chpt. 1, Subchpt. A, Part 173.2). If these substances are
released or misused they can cause death, serious injury, long lasting health effects, or damage
to structures and other properties as well as to the environment.
Hazardous materials sites are those sites required under Occupational Safety and Health
Administration (OSHA) regulations to maintain material safety data sheets (MSDSs) for
hazardous chemicals stored or used in the work place and must submit a Tier II report to the
Texas Department of Health and Human Services.

III. Background to Designation Proposal
Since 2014, the City has planned infrastructure improvements throughout its downtown historic
district and other areas of town in order to replace aging infrastructure, reduce maintenance
cost, and to promote redevelopment and revitalization in the community. The plans include a
number of recommended changes to on -system business routes through the center of town in
an effort to improve safety for motorists, pedestrians, and merchants alike by reducing traffic
speeds and creating pedestrian friendly environments that attract new businesses.
A major issue affecting the transformation of the downtown central area district is the high
volume of trucks traveling through town. While Paris has regulations prohibiting trucks from
traveling through town without a local destination, the signage along Loop 286 and approaching
highways is less than effective. Once inside the loop there is not a good route to turn around,
leaving truck drivers with limited options, and most continue through town and the central area
district. While large trucks can be a nuisance in an entertainment district, a truck carrying
hazardous cargo puts the entire downtown area at risk to contamination, explosions, and other
factors posed by NRHM cargo. In working with the local TxDOT offices to improve signage along
Loop 286 and approaching highways, the City proposes the NRHM route designation so that its
residential districts and historic areas are protected from the increased risk of exposure by a
traffic related incident with hazardous cargo.
IV. Process
The FHWA process requires the jurisdiction seeking a NRHM route designation to comply with
49 CFR Section 397, which calls for the following criteria to be addressed: Population density,
type of highway, types & quantities of NRHM, emergency response capabilities, results of
consultation, continuous routes, exposure risks, alternate routes, effects on commerce, delays in
transportation, climate conditions, congestion & accident history. The following sections will
elaborate on these requirements.
A. Study Area
The study area includes the City of Paris, Texas, with consideration of surrounding jurisdictions
including Lamar County, Red River County, Fannin County, Delta County, and the Choctaw
County in Oklahoma. Although the study considers these jurisdictions, priority is given to the
City. This is because the Texas Administrative Code prescribes the authority to designate and
enforce NRHM routes through municipal ordinances within incorporated areas, where counties
do not have such authority in unincorporated areas.

B. Route Alternatives
Option 1— loop 286 (Proposed Designation)
The proposed route designation is for the entire length of Loop 286 in Paris, Tx. The loop is a
continuous bypass route, and most suitable for traveling through Paris when there is no local
destination. It also provides direct access to the hospital and other emergency medical service
providers.

This "do nothing" option prevents any improvements to signage and routing for through trucks
and NRHM cargo, allowing these vehicles to enter and travel through the middle of town,
increasing exposure to residential and populated areas.

C. Roadway Network
The City has a network of roadways comprised of highways, arterials, collectors and local
streets. There are multiple state highway routes passing through the City, including: US 82, US
271, SH 24, FM 195, FM 137, FM 79, and bypass Loop 286. Most of the highways leading into
Paris have business routes that send traffic to and through the Downtown Central Area/Historic
Districts, passing through areas where people live, work and play.
In the 1960's, the Texas Department of Transportation built the bypass highway known as Loop
286. It provides continuous access to all highways entering the city while generally avoiding
residential areas. The loop is approximately 2.5 miles from the center of town in all directions.
The north loop (extending north of US 82) is a four -lane divided highway with an average speed
limit of 60 mph. All but one intersection is grade separated, providing for efficient flow of
traffic. The north loop provides access through industrial, commercial, and retail districts. The
south loop, from US 82 West to SH 24 is a five -lane undivided highway with speed limit of 70
mph, and passes through industrial and commercial districts. The remainder of the south loop is
two-lane undivided arterial. Figure C shows the City's existing roadway network and city limits,
while Figure D identifies the arterial roadways maintained by TOOT as part of the municipal
maintenance agreement.

The City's master thoroughfare plan (MTP) identifies Loop 286 as a principal arterial. TOOT is
currently performing a detailed traffic study to consider mobility improvements along NE Loop
286 while maintaining local access to the City's developable properties using frontage or service
roads. This would make the NE Loop 286 a controlled access highway through the commercial
district. If approved and constructed, this project would further enhance the safety and
containment of NRHM cargo traveling through the area.
D. Population
Paris is the county seat of Lamar County and has a population of roughly 25,000 residents within
its city limits, though the daytime population is significantly higher due to the draw of local
commerce and employment opportunities. The population of Lamar County is over 49,000,
much of which contributes to the increased traffic and population during daytime hours in Paris.
Commercial activities are concentrated to the NE Loop 286 corridor, as well as B US 82 and B US
271 North. Figure B shows the current zoning district map for Paris. The yellow and tan shapes
indicate residential districts, while red and purple represent commercial and industrial uses,
respectively. Green shapes are agricultural or undeveloped properties.

As depicted in the zoning map, Loop 286 provides a continuous route around town and adjacent
to land uses that are better equipped to withstand exposure to NRHM in the case of a spill or
incident, while business routes through the center of town leave Paris residents at risk for
exposure with less effective options for evacuation.
E. Emergency Response Capabilities
The City currently operates three fire stations and three emergency medical service stations
within the city limits. Medical services are provided by a single hospital located on the north
Loop 286, and a future hospital development is proposed along southeast Loop 286. When
responding to emergencies, the travel time from local city streets to hospitals and care centers
is only slightly increased when traveling inside the loop due to slower speeds, signalized
intersections, added congestion, and increased access points.
For example, the average travel time from West US 82 to East US 82 traveling through town at
average speed of 35 mph is 9 minutes (does not include delay for traffic signals), whereas the
travel time along Loop 286 is 7 minutes. Designation of Loop 286 as a NRHM would not have an
adverse impact to emergency response times, as travel times are improved along the loop.
F. Consultation and Public Input
In the summer of 2017, the City consulted with local TxDOT leaders who advised of the process
for obtaining the NRHM designation. Notifications were sent to all jurisdictions within a 25 mile
radius advising of the route proposal and inviting comments or concerns. Figure F (next page) is
a map of jurisdictions. No comments or feedback were received from any jurisdiction.

On June 11, 2018, a public hearing was held by the City Council to receive public input regarding
the route designation. Again no comments were received. Copies of the legal notice and
meeting minutes are provided for reference in Appendix A.
Having received no indication of opposition from residents of Paris or the surrounding
jurisdictions, the City is prepared to proceed with the formal request for NRHM route
designation for Loop 286.
V. Recommended Action
There is a significant public safety threat created by the transport of hazardous material and
wastes through the residential and central area historic districts in Paris, Tx. Loop 286 offers a
solution to this concern, but must be formally designated as the NRHM route before proper
signage and enforcement can be implemented. The loop provides ideal access, travel times,
design elements, containment opportunities, emergency response ability and safe transport for
hazardous materials through the City of Paris, and its designation as a NRHM cargo route is
respectfully requested.

Notice of Public Hearing
For Hazardous Cargo Route Designation
The City Council of the City of Paris, Texas will hold a public hearing at 5:30 p.m. on Monday,
June 11, 2018, at 5:30 p.m. The public hearing will be held at the City Council Chamber, 107 E.
Kaufman Street, in Paris, Texas. The purpose of the public hearing is to receive comments and
concerns of all affected persons and entities with regard to the designation of a Hazardous Cargo
Route.
The primary objective of designating a Hazardous Cargo Route is to minimize the potential for
incidents and risk of harm to the public, should a truck/vehicle carrying hazardous materials be
involved in an incident and the material be released. The designation of a Hazardous Cargo
Route will not remove or prohibit all trucks/vehicles carrying hazardous materials from Lamar
County roadways.
Proposed Route Description: The route designation would require that all vehicles carrying
hazardous cargo travel through the City of Paris, Texas, via Loop 286 to their intended point of
exit, rather than travel on local streets or state business routes through the center of town.

June 11, 2018, at the City Council Chamber, 107 E. Kaufman, Paris, Texas.

4. Citizens' Forum.
Jay Hodge, 3070 Aspen ... he referenced the process used for selection of mayor and
mayor pro -tem, citing there needed to be parliamentary procedures so that appointments could be
made in a fair manner. He said when one council person is not heard then one-seventh of the
citizens are not heard. Mr. Hodge also said Council would be making board appointments at
their i next meeting and they needed to make sure they had procedures in placing for making
appointments.

Louise Hagood, 556 Fitzhugh - she referenced the mayor and inayor pro -tem selection
and said the entire process took one and one-half minutes, with a single nomination. Mrs.
Hagood said an opportunity for other names to be considered was an absolute must. She
suggested the city attorney help the Council with procedures using Robert's Rules of Order.
Carolyn Williams - she said she spoke three weeks ago about a lot being cleaned and it
was done, and now you could see the stop sign. She said she had another problem, in that grass
was over the railroad track.
Mayor Pro -Tem Hughes inquired of Council Member,,; if they wished to pull any iterns
froin the consent agenda for discussion. There being none, a Motion to approve the consent
agenda was made by Council Member Knox and seconded by Council Member Trenado.
Motion carried, 6 ayes - 0 nays.

Council Member Portugal requested that item 15 be moved up, because there were a
number of people at the meeting for this item. Mayor Pro -Tem Hughes moved to item 15.
15. Discuss and act on a procedure for appointing individuals to serve as council officers, and
to serve on city council -appointed boards, committees, and commissions, and clarifying
the selection process of boards and commissions for the 2018 year.
Mayor Pro -Tern Hughes said Council Member Pilgrim placed this item on the agenda.
Council Member Pilgrim said after the last Council meeting, he had received several calls from
residents in several districts. He said residents expressed concern about not having a policy for
the nomination process. Council Member Pilgrim said they had three options received from Mr.
Godwin. He also said videos of past meetings reflected the selection process was done in several
different ways. Council Member Pilgrim suggested the fair way would be to have each council
member nominate an individual for each of the boards and commissions, and then have those
names drawn out of a hat, with the first name drawn being the first one they take a vote on.
Council Member Pilgrim said they needed a procedure instead of doing it one way one year and
another way another year. He also said they may want to do the same process for the mayor and
mayor pro -tem as opposed to changing the Charter, but could look at that at a later date.
Council Member Portugal said there was a concern that the Charter lacked a procedure
for the selection process. She did not favor the options Mr. Godwin brought fonvard. Council
Member Portugal said Robert's Rules of Order were universally used, and they did not have to
accept Robert's Rules completely but could edit them.
Council Member Trenado said Mayor Clifford was elected mayor and he knew some did
not like it but that was the vote, and the vote -would probably still have been 4-3.
Council Member Knox said she did not think they were asking to rescind the selection.
She favored a stream line procedure so they do not have this confusion in the future. Council
Member Trenado agreed with putting a procedure in writing.
't, Council Member Stone agreed that they needed some type of procedure in place so that
ej izens were not confused.
Mayor Pro -Tern Hughes said fie spoke with Mayor Clifford, who was also in agreement
that a written. procedure needed to be in place. By the rules in place, Mayor Pro -Tem Hughes
said the selection was legal. He agreed they needed to have a procedure in place and asked if
anyone wanted to make a motion. Following additional discussion, Council Member Pilgrim
said he thought they needed to get a procedure in place for selection of boards and commissions
because the selection would be in two weeks. He said they could discuss the mayor and pro -tern

selection when the entire Council was in attendance. Council Member Clayton said the language
from Robert's Rules would be best for the mayor avid mayor pro -tern election.
A Motion. that Council hear all nominations, that all names be drawn from a bat by City
Clerk Janice Ellis, and voted upon by Council in the order drawn, by a yes or no vote was made
by Council Member Pilgrim and seconded by Council Members Stone and Knox. Motion
carried, 6 ayes — 0 nays.
10. Conduct a public hearing on the TxCDBG Dickson Orange Street Project for Grant
Closeout.
City Engineer Carla Easton explained that a public healing was required on this project
prior to the grant close-out.
Iffilayor Pro -Tem Hughes opened the public hearing and asked for anyone wishing to
speak. about this item, to please come forward. With no one speaking, Mayor Pro -Tem Hughes
closed the public hearing.
11. Conduct a public heanng to receive Comment about a proposed Hazardous Cargo Routv
Designation.
Ms. Easton explained that the City was proposing to designate Loop 286 as th,i
Hazardous Materials route through Paris to limit exposure citizens to hazardous materials. Sh.*
said TxDOT and FHWA had a process for designating a highway as a Haz Mat route, and th4i
first step in the process was to solicit input from the community and adjacent jurisdictions.
Council Member Pilgrim inquired if this route included the entire loop, to which Ms. Easton
answered in the affirmative.
Mayor Pro -Tern Hughes opened the public hearing and asked for anyone wishing VF
speak about this item, to please come forward, With no one speaking, Mayor Pro -Tem Hug
closed the public hearing.
12. Discuss and award a bid for reconstruction of portions of S. Coliegiate, 33" S.E., and
Graharn Streets to Richard Drake Construction in an amount not to exceed $920,000.
Ms. Easton said the 2017 Street Program included funding for improvements to S.
Collegiate Drive from Lairvar to Clarksville: 33 d S.E. Street frorn Lamar to Clarksville; and

from N.W. to the railroad'. She also said six bids were received, and that
Richard Drake Construction submitted the lowest qualified bid in the amount of $844,302.04.

13. Receive presentation ftorn Main Street Advisory Board about completed improvements
downtown and a 2018 plan of work.

City Council received a presentation from Main Street Director Cheri Bedford and the
Main Street Advisory Board outlining completion of downtown improvements, activities
downtown, fundraising efforts, grants, and their 2018 plan of work. Paris Downtown
Association President Glee Emmite reviewed recent downtown events, such as the Cinco de
Mayo and the Arl Walk.
14. Discuss and act on ORDINANCE NO. 2018-016: AN ORDINANTCE OF THE CITY
COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDENG ORDINANCES
CREATING HISTORICAL OVERLAY DISTRICTS TO INCORPORATE "DESIGN
STANDARDS FOR THE HISTORIC DISTRICTS OFTHE CITY OF PARIS, TEXAS
AND ADDITIONS AND AMENDMENTS THERETO; PROVIDING A PENALTY
CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
City Manager John Godwin explained that the Historic Preservation Commission used
the 2009 Design Standards which were never adopted as part of the preservation ordinance. He
said the commission created a review committee to prepare a list of clarifications to the
standards. Mr. Godwin also said the Commission voted in April to adopt the design standards as
amended.
Council Member Pilgrim inquired if the ordinance had been publicized. Mr. Godwin said
it was posted on the website. Council Member Knox said she was the HPC liaison, and they had
reviewed it for a long time.
A Motion to approve this item was made by Council Member Knox and seconded by
Council Member Pilgrim, Motion carried, 6 ayes — 0 nay.s.
16. Receive and discuss annual departmental reports from Public Works, Engineering,
Utilities, and Finance,
City Council heard from Utilities Director Doug 'Harris about rebuilding of pumps at
Ground Storage, electrical and valve replacement of water transfer pumps, resurfacing the 0.5
MG clear well, repainting of the sedimentation basin components, and the contract for
installation of a screening structure to protect the headworks of tile (matment plant. Mr. Harris
said installation of VFDs on the Pat MaDse intake cumum -
completion of the headworks screening structure and purchase and installation of a belt filter
press were capital improvement projects planned for FY 2018/19.
Next, Finance Director Gene Anderson reviewed the warehouse, the utility billing office
operations, and the finance office. Mr. Anderson said the primary goal for the utility billing
office was the radio read meter project and 25.3% of the 9,800 incters were now radio read
meters. He also said the priority was funding to complete the radio read meter project. Mr.
Anderson said the goals and priorities for the warehouse were above -ground fueling station with
fleet management software and an all-weather surface loading/unloading zone. He also said the
most recent major accomplisbinent was installation of an electronic inventory system. Mr.

Anderson explained about needed renovations needed at city hall, which included windows
rotting, cracked plaster and weather proofing of the exterior building, as well as interior damage
caused by exterior problerns. Other items he asked to beconsidered were all update of the City
pay scale, and an increase in contributions to theFire Pension Fund by 2%,
City Engineer/Community Development Director Carla Easton reviewed the downtown
plan, sidewalk grant matches, the need for a chief building official, airport hangars, and
construction projects.
Public Works Director Jerry McDaniel reviewed the need for an increase in starting pay
for maintenance workers, heavy equipment needs, and swimming pool improvement needs. He
also reviewed parks development, programs for the Events Center, and status of drainage,
17. Discuss and act on Ordinance Amending Section 34-22(b), Water Rates, Section 34-23
(�)(b)(c), Sewer Rates to reflect changes recommended by the 2018 Water and Sewer
Rate Study.
Mr. Anderson explained that the City had treated water contracts with four major
industries, and that the contracts required the City perform an annual cost of service study. He
said the City retained NewGen Strategies and Solutions to conduct a Water and Wastewater Rate
Study.
Chris Ekrut with New Gen Strategies presented the findings of the rate study. In
summary, Mr, Ekrut said the retail rates for both water and wastewater were insufficient and
water usage for all wholesale customers had decreased significantly. He went over the proposed
residential and commercial water rates and residential and commercial wastewater rates,
providing two scenarios for each. Mr. Ekrut also reviewed the proposed residential total monthly
bills and a residential monthly bill comparison. Following additional discussion about the rates
