1990-109-RES WHEREAS, it has been brought to the at tent ion of the City of Paris that the Paris Independent School ~ . . I , ' RESOLUTION NO. 90-109 WHEREAS, it has been brought to the at tent ion of the City of Paris that the Paris Independent School District has requested the participation of the City of Paris in a community-based vocational training site for students; and, WHEREAS, the Paris Public Library morning per week to shelve books vocational training; and, can have students one and periodicals for WHEREAS, in order to participate in the vocational training site program it is necessary for the City of Paris and the Paris Independent School District to enter into an Agreement for said program; and, WHEREAS, the form of agreement for the communi ty-based vocational training site attached hereto as Exhibit A, should be approved, and the City Manager, Michael E. Malone, should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the form of the Community-Based Vocational Training Site Agreement attached hereto as Exhibit A, is hereby approved; and, BE IT FURTHER RESOLVED, That the City Manager of the City of Paris, Michael E. Malone, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the Community-Based Vocational Training Site Agreement in the form shown in Exhibit A attached hereto. WITNESSETH WHEREAS, the PARIS INDEPENDENT SCHOOL DISTRICT, has the authority to conduct community-based training programs for its students, and WHEREAS, I ~1 ; It'! 1 , the COOPERATING BUSINESS is willing to allow community-based training of students according to the provisions of this agreement, and WHEREAS, the parties desire to enter into an agreement setting forth the relative conditions and obligations of such a program, now, the parties agree: 1. The COOPERATING BUSINESS shall allow community-based vocational training of students in accordance with the following: Days and Hours of Training: One (1) morning per week Primary Work Activities: Shelving books and periodicals Names of Students: To be advised ~ I Names of Staff: Beverly Lewis 2. The PARIS INDEPENDENT SCHOOL DISTRICT is responsible for: a.) Providing on-site supervision and instruction, with an emphasis on safety, production, and appropriate work behavior. b.) Maintaining quality control of all work performed by students. c.) Maintaining signed parent consent forms for all students receiving training on site. 3. The student shall not be made or considered an employee of the COOPERATING BUSINESS by reason of training, but shall be considered a student deriving vocational training from a course of study with the PARIS INDEPENDENT SCHOOL DISTRICT without compensation from the COOPERATING BUSINESS. The COOPERATING BUSINESS is responsible for: a.1 Providing on-site space and materials for vocational training. b.1 Notifying the on-site staff in event of any problems or dissatisfactions. 5. Upon completion of the agreement, the COOPERATING BUSINESS is in no way Qbligated to provide employment for the student. 6. a.1 The PARIS INDEPENDENT SCHOOL DISTRICT agrees that they will hold the COOPERATING BUSINESS ha=less from any claim of liabili ty arising out of the program resulting from the negligence of the PARIS INDEPENDENT SCHOOL DISTRICT, its agents, servants, or employees, or students. b.1 The COOPERATING BUSINESS agrees to hold the PARIS INDEPENDENT SCHOOL DISTRICT ha=less from any claim or liability arising out of negligence of the COOPERATING BUSINESS, its agents, servants, or employees in regard to students while receiving vocational training on site. 7 Tho .
